RESOLUTION NO. 2846

A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON CERTIFYING A NEGATIVE
DECLARATION FOR THE ADOPTION OF CERTAIN
ZONING ORDINANCE TEXT AMENDMENTS
WHEREAS, the Town of Tiburon has initiated certain text amendments to
the Tiburon Zoning Ordinance (No. 360 N.S., as amended); and

WHEREAS, on January 24, 1992, the Tiburon Planning Department
prepared an Initial Study for the project which determined that there were no
potentially significant environmental effects related to the project; and
WHEREAS, the Tiburon Planning Department determined that based
upon the Initial Study, a Negative Declaration was required for the project
pursuant to CEQA; and

WHEREAS, on_February 5, 1992, a Draft Negative Declaration was
completed, and Notice of such was posted and advertised in a newspaper of
general circulation (The Ark) to commence a 21 day public review period for
review and comment on the Negative Declaration pursuant to CEQA; and
WHEREAS, a notice of the public hearing on the Negative Declaration was
also published in a newspaper of general circulation (The Ark) on February 5,
1992; and
WHEREAS, after the close of the public review period, the Planning
Commission conducted a public hearing on February 26, 1992, to receive public
testimony on the Draft Negative Declaration; and
WHEREAS, after said hearing, the Planning Commission adopted
Resolution No. 92-04 recommending that the Town Council certify and adopt the
Negative Declaration as complete and adequate; and
WHEREAS, on March 17, 1992, the Town Council conducted a public
hearing to receive public testimony on the Draft Negative Declaration; and
WHEREAS, the Town Council has reviewed'\nd considered the
information contained in the Initial Study, Negative Declaration, and any
comments and responses thereto, and has considered the recommendation of the
Planning Commission.

NOW, THEREFORE, BE IT RESOLVED that the Town Council of the
Town of Tiburon does hereby make the following findings:
1. Notice of the public review period and hearing on the Negative Declaration
was given as required by law and said hearing was conducted pursuant to
Sections 15073 and 15074 of the State CEQA Guidelines and pursuant to
provisions of the Town's Local CEQA Guidelines.
2. All individuals and groups desiring to comment on the Negative
Declaration were given the opportunity to address the Planning
Commission and Town Council
3. The Negative Declaration for the project consists of the Initial Study,
Negative Declaration document, and any supporting information which
may be referenced therein.

4. The Negative Declaration was completed in compliance with the intent and
requirements of CEQA, the State CEQA Guidelines, and the Town's Local
CEQA Guide!.ines.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town
Council hereby certifies and adopts the Negative Declaration for the Zoning
Ordinance text amendments as complete and adequate for the purposes of
approving the project.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Tiburon held on March 17, 1992, by the following vote:
