RESOLUTION NO. 2881
A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF TIBURON
OPPOSING THE ANNEXATION OF THE
RABIN PROPERTY INTO THE
RICHARDSON BAY SANITARY DISTRICT
WHEREAS, property owned by Irving and Varda Rabin located at 382S
Paradise Drive (AP #'s 39-021-07 to 39-021-12) is currently included in Sanitary
District #S pursuant to LAFCO Resolution No. 91-12 and Sanitary District #S
Resolution No. 91-6; and
WHEREAS, Sanitary District #5 plans to expand the capacity of its Playa
Verde plant to accommodate the Rabin property as well as other developed and
undeveloped properties on Paradise Drive; and
WHEREAS, in order for this expansion to be able to proceed financially, it
is important that all properties currently located in Sanitary District #S remain in
the District.

NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town
of Tiburon that:
1)
The Town encourages formation of an assessment district by all
affected property owners in order to fund the expansion of Sanitary
District's #5's capacity to serve Paradise Drive properties on a public
sewer system.
2)
The Town opposes the annexation of the Rabin property or any other
property currently in Sanitary District #5's sphere of influence into
the Richardson Bay Sanitary District or Sanitary District #2.
3)
The Council urges the Local Agency Formation Commission not to
support the transfer of property out of Sanitary District #S for the
reasons stated above.
