HomeMy WebLinkAboutTC Res 1993-02-03 F RESOLUTION NO. 2900 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON AMENDING RESOLUTION NO. 2764 ESTABLISHING THE FEE SCHEDULE FOR THE COMMUNITY DEVELOPMENT DEPARTMENT WHEREAS, the Tiburon Municipal Code requires that any changes to the Department of Community Development's filing and processing fees be set forth by Resolution of the Council; and WHEREAS, the Town did adopt Resolution No. 2764 on February 20, 1991, to establish such fees; and WHEREAS, the Town has determined that amendment and clarification of the fees relative to Negative Declaration processing and Environmental Impact Report processing is warranted. ~ NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Tiburon that "Category 2: Environmental Clearance" on Page 13 of the Community Development Fee Schedule is amended to read as shown on Exhibit "A", attached . hereto and incorporated by reference. The revised schedule shall be applicable to all projects which have not been deemed "complete" for processing. PASSED AND ADOPTED at a regular meeting of the Town Council on February 3, 1993, by the following vote: AYES: COUNCILMEMBERS: Friedman, Thayer, Thompson, Kuhn None NOES: COUNCILMEMBERS: ABSENT: COUNCILMEMBERS: Nygren -. ALVIN R. KUHN, MAYOR ATTEST: " I'" 1 EXHIBIT A ~ CATEGORY 2: ENVIRONMENTAL CLEARANCE 1. Determination of Exemption: $25 2. Initial Study & Negative Declaration: $1,750. 3. Environmental Impact Report: $1,850+" .(In addition to actual cost of the EIR as prepared by a consultant, a fee of 25% of the EIR contract amount shall be charged to recover Town costs to administer the contract). Recovers the cost of Staff time spent on the Initial Study & Negative Declaration and recovers the cost of Fish and Game fees. The portion of these fees required pursuant to Section 711.4 of the California Fish and Game Code ($1,250) shall be refunded if the Town determines that there is no evidence that the project will have a potential adverse effect on fish or wildlife.
