RESOLUTION NO. 2909
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON CERTIFYING A NEGATIVE
DECLARATION WITH RESPECT TO AMENDMENTS
TO CHAPTER 14 OF THE TIBURON MUNICIPAL
CODE REGULATING SUBDMSIONS
WHEREAS, the Town of Tiburon has initiated amendments to update the
Town's subdivision regulations codified in Chapter 14 of the Tiburon Municipal
Code; and
WHEREAS, on November 18, 1992, the Tiburon Planning Department
prepared an Initial Study for the project which determined that there were no
potentially siguificant environmental effects related to the project; and
WHEREAS, the Tiburon Planning Department determined that based
upon the Initial Study, a Negative Declaration was required for the project
pursuant to CEQA; and

WHEREAS, on December 30, 1992, a Draft Negative Declaration was
completed, and Notice of such was posted and advertised in the ARK to
commence a 21 day public review period for review and comment on the Negative
Declaration pursuant to CEQA; and
WHEREAS, a notice of the public hearing on the Negative Declaration was
also published in the Ark on January 6, 1993; and
WHEREAS, after the close of the public review period on January 27,
1993, the planning Commission conducted a public hearing to receive public
testimony on the Draft Negative Declaration and thereafter adopted Resolution
No. 93-04 recommending that the Council certity the Negative Declaration, noting
that no comments had been received; and
WHEREAS, the Town Council has held duly noticed public hearings on
March 3 and March 31, 1993, and has reviewed and considered the information
contained in the Initial Study, Negative Declaration, and any comments and
responses thereto.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the
Town of Tiburon does hereby make the following findings:

Notice of the public review period and. hearing on the Negative Declaration
was given as required by law and said hearing was conducted pursuant to
Sections 15073 and 15074 of the State CEQA Guidelines and pursuant to
provisions of the Town's Local CEQA Guidelines.
2. All individuals and groups desiring to comment on the Negative
Declaration were given the opportunity to address the Town Council.
3. The Negative Declaration for the projeet consists of the Initial Study,
Negative Declaration document, and any supporting information which
may be referenced therein.
4. The Negative Declaration was completed in compliance with the intent and
requirements of CEQA, the State CEQA Guidelines, and the Town's Local
CEQA Guidelines.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town
Council hereby certifies and adopts the Negative Declaration for the amendments
to Tiburon Municipal Code Chapter 14 as complete and adequate for the
purposes of approving the project.

PASSED AND ADOPTED at an adjourned meeting of the Town Council of
the Town of Tiburon held on March 31, 1993, by the following vote: .
