ROLL CALL PRESENT: COUNCILMEMBERS: Fredericks, Nikfar, Ryan, Thier, Welner ABSENT: COUNCILMEMBERS: None PRESENT: EX OFFICIO: Town Manager Chanis, Town Attorney Stock, Engineering Manager Eshoo, Town Clerk Dilena ORAL COMMUNICATIONS Riya Aghi from Raising the Bar spoke about the impacts of alcohol on young kids. CONSENT CALENDAR CC-1. Notice of Special Vacancy – Announce special vacancy on the Diversity Inclusion Task Force (Office of the Town Clerk) MOTION: To adopt Consent Calendar Item No. 1, as written. Main Street Road Closures – Consider approval of the closure of Lower Main Street on: a) March 15, 2024 (4-9PM) for the Tiburon Peninsula Little League Opening Day Celebration b) June 15, 2024 (2-8PM) for the 2024 Juneteenth Celebration c) November 2, 2024 (2-6PM) for the 2024 Diwali Celebration (Office of the Town Manager) Public comment received by: • Jane Gould asked if these closures are in addition to the Friday Nights on Main events. • Kelsey Hernandez spoke about the impacts of serving alcohol at kids’ events. • Damian Morgan said cultural events were great, but people of color should be included in all spaces and arenas. MOTION: To approve the closure of Lower Main Street on March 15, 2024 for the Tiburon Peninsula Little League Opening Day Celebration. Moved: Welner, seconded by Fredericks MOTION TO AMEND: To approve the closure of Lower Main Street on March 15, 2024 for the Tiburon Peninsula Little League Opening Day Celebration, with the condition that alcohol purchased at the Little League event bar cannot be purchased or consumed more than 40 feet away from the bar. Event Funding Requests – Consider approval of the following expenditure requests by the Diversity Inclusion Task Force: a) $8,000 from the FY2024 Operating Budget for the 2024 Juneteenth Celebration b) $8,000 from the FY2024 Operating Budget for the 2024 Nowruz Celebration c) Direct staff to include $8,000 in the Proposed FY2025 Budget for the 2024 Diwali celebration (Office of the Town Manager) MOTION: To approve 2 $8,000 expenditures from the FY2024 Operating Budget to cover costs for the 2024 Juneteenth Celebration and the 2024 Nowruz Celebration. Moved: Thier, seconded by Ryan VOTE: AYES: Fredericks, Nikfar, Ryan, Thier, Welner MOTION: To direct staff to include $8,000 in funding in the Proposed FY2025 Budget from to cover costs for the 2024 Diwali Celebration. Diversity Inclusion Task Force Strategic Plan – Review and consider adoption of strategic plan (Diversity Inclusion Task Force) Public comment received by: • Tina Shah Paikeday spoke in support of the strategic plan. • Ruben Kalra spoke in support of the strategic plan. • Karen Carrera spoke in support of the strategic plan. MOTION: To approve the strategic plan of the Diversity Inclusion Task Force. Moved: Thier, seconded by Welner VOTE: AYES: Fredericks, Nikfar, Thier, Welner NAYS: Ryan AI-4. Diversity Inclusion Task Force Makeup & Structure – Discuss makeup and structure of the task force and provide direction to staff (Office of the Town Clerk) Public comment received by: • Tina Shah Paikeday said the Diversity Inclusion Task Force voted to keep the makeup the same. • Anette Harris said she brought up the concept of changing the structure to having two or less council members on the task force while she was on the task force. • Karen Carrera spoke in support of retaining the existing makeup. The Town Attorney clarified that the Council will take a straw vote to determine the action directed to staff by Town Council to bring back any necessary resolutions to effectuate the action at a later meeting. MOTION FOR STRAW VOTE: To keep the task force makeup the same. Moved: Thier, seconded by Welner SUBSTITUTE MOTION FOR STRAW VOTE: To amend the task force makeup to include two or fewer Council members, to allow the body to elect a Chair & Vice Chair from the at-large members. Municipal Code Amendments – Consider amendments to Chapter 23 of the Tiburon Municipal Code (Motor Vehicles and Traffic) that would regular electric mobility devices – Introduction and first reading of ordinance (Department of Public Works) Public comment received by: • Mark Freiberg spoke about the hazards of fast & heavy e-bikes and the safety issue of having multiple riders on a single bike and recommended the speed limit be posted. • Tina Shah Paikeday said the speed limit for both regular bicycles and electric bicycles should be posted. MOTION: To introduce the ordinance, as amended to delete Section 23-70 to delete the reference to the Police Department safety program, and read by title only. Moved: Welner, seconded by Nikfar Mayor Fredericks read “An Ordinance of the Town Council of the Town of Tiburon Amending Title VI, Chapter 23 (Motor Vehicles and Traffic) of the Tiburon Municipal Code”. MOTION: To pass first reading of the ordinance, waive further readings, and to schedule the ordinance for adoption at a future Town Council regular meeting.
