HomeMy WebLinkAboutTC Res 1993-09-01 (6) ~ ~ ~ RESOLUTION NO. 2959 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON APPROVING AN AMENDMENT TO THE PRESERVE PHASE II PRECISE PLAN TO MODIFY THE BUILDING ENVELOPE AT 2 TURTLE ROCK COURT A.P. # 34-380-02 AND 03 WHEREAS, the Planning Commission of the Town of Tiburon does resolve as follows: Section 1. Findinl!s. A. On January 6, 1988, the Tiburon Town Council approved a Precise Development Plan for The Preserve at Tiburon Phase II (Resolution #2508). The Precise Plan established development parameters (including building envelopes) for 22 single family lots. B. The Town of Tiburon has received and considered an application filed by Janet and Shaun Coughlin to amend the Preserve Phase II Precise Plan to allow the enclosure of yard space with fencing at lot #14 (2 Turtle Rock Court). The application consists of the following: 1. 2. Application form received November 25, 1992. Site Plan prepared by Paesaggio received June 4, 1993, and amended by StatT. C. The Planning Commission held duly noticed and advertised public hearings on July 14, and July 28, 1993, considered all testimony, and recommended conditional approval of the Precise Development Plan amendment to the Council. D. The Town Council held a public hearing on September 1, 1993, and has found that the proposal, as conditioned, is inconsistent with the Tiburon General Plan, is in conformance with the Tiburon Zoning Ordinance, and is exempt from further review under CEQA. Section 2. Annroval. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon does hereby approve an amendment to the Precise Development Plan for the Preserve at Tiburon phase II as follows: 1. The Precise Plan for The Preserve at Tiburon Phase II is amended to extend a "fencing only" envelope on lot 14 (2 Turtle Rock Court) toward 1 ~ ~ P- Trestle Glen Boulevard as shown on the plans prepared by Paesaggio Landscape Architects dated 6-4-93 and amended by StatT, and to allow the existing improvements which encroach outside the existing envelope on the west side of the lot. 2. Site Plan and Architectural Review approval shall not be required for the construction of fence Type A along Turtle Rock Court, fence Type B along Shepherd Way and fence Type C along Trestle Glen Boulevard, per the plans. The Planning Commission has determined that the design of the proposed fencing is appropriate for the location and surroundings. 3. The extended building envelope area shall be designated as a "fencing only" envelope. No other structures (including accessory structures) may be located within this envelope. 4. The applicant shall install and maintain landscaping along the interior and exterior sides of the entire length of the new fence sufficient to substantially eliminate the view of the new fence from Turtle Rock Court and Trestle Glen Boulevard. A plan indicating this landscaping shall be submitted to the Planning StatT for approval prior to the issuance of building permits. In addition, the applicant shall post a deposit in the amount of $2,000 to ensure the installation of this required planting prior to the issuance of building permits. This deposit will be released upon completion of the required landscaping. 5. This amendment does not otherwise atTect any specific provisions of Town Council Resolution #2508.
