Pursuant to Town Council Resolution No. 16-2007 (Appointments Procedure), the Town Clerk published a Notice of Current & Pending Vacancies on Boards & Commissions in the Ark, and posted it Town Hall and the Belvedere -Tiburon Library. This notice serves to inform the public of current or pending vacancies and invites applications for the positions. The Town Clerk also recently published a notice of pending vacancy for a Town representative to the Library Agency Board of Trustees, as well as a notice of two vacancies on the Heritage & Arts Commission. The incumbent Library trustee, Tom Gram, is eligible for another term under the Library Agency by-laws and he has informed the Town of his interest in being considered for reappointment. No other applicants have stepped forward to be considered for this position. The two vacancies on Heritage & Arts are a result of the resignations of Commissioners Patti Pickett and Phillip Ramirez. The Town has received one application, from Victoria Fong. The Town Clerk will schedule a date for the Council to interview her at a future meeting. Staff also contacted one of the previous applicants for the commission who was interviewed by Council in 2014, to inform them of the current vacancy. Staff has received a positive response of interest, but no formal letter as yet. The Council has the option, or can decline, to re -interview any previous applicant. RECOMMENDATION Staff recommends that the Town Council: 1. Appointees serve staggered, four-year terms. The Commission establishes educational programs and awards focusing on the unique history of the area. The Commission works on special community projects and events and is interested in planning events that would provide a forum for local artists to showcase their work. Qualifications: Town Council Resolution No. 31-2014 states that the commission shall be comprised of nine (9) members whose qualifications shall be as follows: Five (5) members must be residents of the Town of Tiburon; Four (4) members may be residents of any part of the greater Tiburon Peninsula (comprised of the Town of Tiburon, City of Belvedere, and any unincorporated area including Paradise Drive and the Strawberry/Eagle Rock/Bay Vista area). The applicant proposes to expand the existing building envelope on the site. On May 13, 2015, the Planning Commission adopted Resolution No. 2015-04 (Exhibit 3) recommending to the Town Council that the precise plan amendment be approved. PROPOSAL The proposed amendment seeks to expand the existing building envelope on the site in order to accommodate existing lawfully constructed improvements outside the building envelope and construct future spa, deck and building expansions within the expanded building envelope. TOWN OF TIBURON PAGE 1 OF 3 Town Council Meeting June 3. 20]5 HISTORY The Miraflores Precise Plan was originally approved in 1975. The house on this site was approved in 1976 and constructed shortly thereafter. Although the approvals at that time indicated that the house would comply with the approved building envelope, portions of the decks at the rear of the house were constructed outside the envelope, which was a fairly common occurrence with homes in many of Tiburon's early planned developments. In 1977, the Tiburon Board of Adjustments and Review approved a variance (File #27726) to construct an attached garage three -car garage on the left (east) side of the house. The Board approved a variance for the garage to extend beyond the building envelope for this property, which appears to be an acceptable procedure at the time; precise plan amendments for such requests have been required since 1980. ANALYSIS The house at 172 Avenida Miraflores is situated close to the front property line. Miraflores Lane borders the lot on the east and a private driveway leading to several nearby homes borders the lower portion of the lot. Substantial mature landscaping and fencing screens much of the site from view of other homes in the vicinity. The proposed precise plan amendment would expand the building envelope 20 feet to the east to accommodate the location of the existing garage and allow space for the installation of a spa, deck and possible building expansions in the future. The envelope would also be expanded to the rear (south) of the house along the line of an existing roadway and utility easement to accommodate the portions of existing decks that currently extend beyond the building envelope. Any future improvements within the proposed expanded building envelope would be reviewed through the Town's design review process and would appear to be well screened or buffered from other homes in the immediate vicinity. REVIEW BY THE PLANNING COMMISSION The Planning Commission held a public hearing on this application at its May 13, 2015 meeting. At that meeting, the Planning Commission supported the proposed request and found that it was in conformance with the overall intent of the Miraflores Precise Plan and the Tiburon General Plan. The Commission voted 4-0 to recommend the application for approval. Draft minutes of the May 13, 2015 meeting are attached as Exhibit 4. ENVIRONMENTAL REVIEW Staff has preliminarily determined that the subject application is categorically exempt from the requirements of CEQA per Section 15301 of the CEQA Guidelines. MEMO regarding request for Building Envelope Modification at 172 Avenida Miraflores We are requesting a modification to the Building Envelope Line to account for existing conditions, allow minor modifications and expansions to the structure and decks, and allow us to add a spa. Our property is generally separated from neighbors with a street bordering 2/3 of the property and a 50' easement across the other 1/3 of the property. The easement generally follows an arc on the South-West corner of the property that had been transected for the building envelope line. Approximately 1/2 of the back decks and about 2 square feet of the living room currently fall outside the building envelope line, but inside the easement arc in this area. We are requesting to move the building envelope line to follow the easement arc. If approved, we intend to make some minor modifications and additions to the decks and home in this area and are attempting to modify the building envelope to allow a staff level determination of those changes. Planned changes to our building in this area will be under the existing roof and deck area. We are requesting the back building envelope line to be moved 20' over and parallel to the existing boundary. This move allows the current garage - approved at the time of construction with about 1/3 of the garage outside the envelope line - to fall within the proposed building envelope and will allow us to add a spa. We will still have a significant buffer between the new line and the street on that side of the property. Thank you for your consideration. PUBLIC HEARINGS 2. 172 Avenida Miraflores: Request to Amend the Miraflores Precise Plan (PD #21) to Expand the Existing Building Envelope; File #PDPA2015001; Charles and Vicki Strotz, Owners/Applicants; Assessor's Parcel No. 039-261-12 [DW] Planning Manager Watrous gave the staff report, stating this is a request to amend the Miraflores Precise Plan for the property at 172 Avenida Miraflores to expand the existing building envelope on the site in order to accommodate some existing improvements that are outside the building envelope and to construct a future spa, deck and building expansions within the expanded envelope. He described the improvements on the site and stated that staff found the project to be consistent with the Miraflores Precise Plan and General Plan. He recommended that the Commission hold a public hearing on this item, consider and hear all testimony and if the Commission concludes it is consistent with the Precise Plan, adopt the draft resolution recommending conditional approval of the amendment to the Town Council. Charles Strotz, applicant/owner, said that he was available to answer questions. He said the overall size of the proposed expansion envelope would be generally consistent with other building envelopes in the Miraflores Subdivision and retain the open, visual appearance of the site. Commissioner Williams asked if future development of a spa and deck would be to the south of the house. Mr. Strotz said that their current thought was to place the spa to the right of the house and the decks and other improvements would occur in the southwest corner of the lot. Vice Chair Kulik asked Mr. Strotz for a more detailed description of future development on the site. Mr. Strotz said that they plan to construct a small bathroom extension and revise the decks in the southwest corner of the property. He said there is significant space on that side of the house as Miraflores Lane provides an ample buffer to the property owner on the other side of the lane. The public hearing was opened. There were no public speakers and the public hearing was closed. Commissioner Williams said that she could find that the proposed project was consistent with the land use element of the General Plan, specifically Policy LU -13, in that it would not impact the neighborhood character, and was also consistent with the Miraflores Precise Plan, and she supported approval of the amendment. Commissioner Corcoran echoed Commissioner Williams' comments. He said that this did not seem to be a controversial expansion and was relatively minor in nature in light of the physical features of the surrounding area. He said that the project would not have a dramatic impact on the surrounding properties and was consistent with the General Plan. Commissioner Weller concurred. Vice Chair Kulik concurred, said he knows there is some precedence for amendments like this, as the Commission recently considered a request for a pool house nearby on Miraflores Lane. He said that there is roughly 40 years of mature foliage that blocks the entire area from public view, so he thought that any privacy or public view concerns would be mitigated. ACTION: It was M/S (Corcoran/Weller) to adopt the resolution making a recommendation to the City Council that the proposed building envelope expansion is consistent with the intent of the Miraflores Precise Plan.
