RESOLUTION NO. 3315
A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWNOFTIBURON
ADOPTING A NEGATIVE DECLARATION
FOR TEXT AMENDMENTS TO THE TIrnURON
ZONING ORDINANCE
REGARDING
SITE PLAN & ARCHITECTURAL REVIEW (SECTION 4.02)
Section 1. Findings.
1. The Town of Tiburon has initiated text amendments to Section 4,02 of the Town's Zoning
Ordinance, said ordinance being codified as Chapter 16 of the Tiburon Municipal Code.

The proposed amendments were determined to constitute a project under CEQA, and an
initial study was prepared. The initial study concluded that the project would not have a
significant effect on the environment, and that a negative declaration be adopted. The
initial study was released for public review on September 16, 1998, with comments
accepted until October 7, 1998. No written or oral comments were received within the
public comment period.
3. The Planning Commission, pursuant to the Government Code, held a duly noticed and
advertised public hearing on October 14, 1998, to receive public input and comments on
the initial study and draft negative declaration as well as the proposed zoning ordinance
text amendments; and the Planning Commission considered that testimony in its
deliberations. The Planning Commission subsequently adopted Resolution no. 98-22
recommending adoption of a negative declaration for the project to the Town Council.
4, The Town Council, pursuant to the Government Code, held duly noticed and advertised
public hearings on November 4, 1998, and December 2, 1998, to receive public input and
comments on the initial study and draft negative declaration, and considered all testimony,
written and oral received at the hearing,
5. The Town Council has determined that the zoning ordinance text amendments would not
result in a significant effect on the environment, and that adoption of a negative
declaration is appropriate.

NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon hereby adopts the negative declaration for the zoning ordinance text amendments (File
Z98-01),
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Tiburon held on December 2, 1998, by the following vote:
