A RESOLUTION OF THE TOWN COUNCIL
OFTHETOWNOFTIBURON
AUTHORIZING THE TOWN MANAGER
TO EXECUTE A RELOCATION AGREEMENT
WITH PACIFIC GAS AND ELECTRIC COMPANY
REPLACING AN EXISTING RIGHT OF ENTRY
WITH A PERMANENT EASEMENT FOR UNDERGROUND UTILITIES
WHEREAS, the Town ofTiburon owns property located on Tiburon Boulevard which
property is commonly known as Blackie's Pasture; and
WHEREAS, in 1991, the Town granted the Pacific Gas and Electric Company ("PG&E")
an easement along Tiburon Boulevard for certain facilities; and
WHEREAS, on July 19, 1995, the Town Council adopted Resolution 3112, requiring that
all overhead utilities along Tiburon Boulevard in the Blackie's Pasture area be moved
underground; and
WHEREAS, by letter agreement dated May 16, 1996, the Town granted PG&E a right of
entry to facilitate the undergrounding. This letter agreement reflects that PG&E would require a
new permanent easement after completing the project; and
WHEREAS, PG&E has proposed a Relocation Agreement that would create a new
_ easement for the undergrounded facilities and relinquish PG&E's rights to the pole line portion of
the 1991 easement, and the Town Engineer has reviewed and approved the agreement.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town ofTiburon
that the Town Manager of the Town of Tiburon is hereby authorized to execute the proposed
Relocation Agreement with PG&E.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Tiburon on June 17, 1998, by the following vote:
