RESOLUTION NO. 3286
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TmURON CERTIFYING
THE FINAL ENVIRONMENTAL IMPACT REPORT (FEIR) FOR THE ROUND HILL OAKS
PROJECT
ASSESSOR PARCEL NO. 58-301-26
WHEREAS, a Draft Environmental Impact Report evaluating the proposed Round Hill
Oaks project has been prepared and was transmitted by the Town of Tiburon to all concerned
parties for review and comment; and
WHEREAS, notice of the availability of the Draft Environmental Impact Report was
given as required by law; and
WHEREAS, written comments from the public on the Draft Environmental Impact Report
were accepted from January 12, 1998 to February 11, 1998; and
WHEREAS, the Planning Commission held a public hearing and accepted testimony on
the Draft Environmental Impact Report on February 11, 1998; and the Town Council held a
public hearing on the proposed Environmental Impact Report on June 17, 1998; and
I""" WHEREAS, agency and public comments have been addressed in the Final Environmental
Impact Report for Round Hill Oaks; and
WHEREAS, the Final Environmental Impact Report was prepared in accordance with the
provisions of the California Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED that the Final Environmental Impact Report :
1. Consists of:
a. Draft Environmental Impact Report, Round Hill Oaks, January, 1998; and
b. Final Environmental Impact Report, Round Hill Oaks, March, 1998;
2. Is hereby certified by the Town Council to have been completed in compliance
with the California Environmental Quality Act and all applicable guidelines;
3.
As set forth in Exhibit A attached hereto, pursuant to Public Resources Code
Section 21081 and CEQA Guidelines Section 15091, that the mitigation measures
described in the FEIR are feasible, and therefore will become binding upon the
Town and affected landowners and their assigns or successors in interest upon
approval of the Round Hill Oaks Precise Development Plan;

That the Town Clerk be directed, after the Town Council adopts a resolution
formally approving the Round Hill Oaks Precise Development Plan, to post a
Notice of Determination, together with a copy of this Resolution and its exhibits
and the Resolution approving the Round Hill Oaks Precise Development Plan, in
the Office of the Town Clerk, to file such Notice with the County Clerk of Marin
County, and, in accordance with Public Resources Code Section 21152, to cause
such Notice to be posted in the County Clerk's Office. The Town Clerk shall
accomplish all of the above Notice requirements within five working days
following adoption of the Resolution formally approving the Round Hill Oaks
Precise Development Plan.
5. Has been reviewed and considered by the Town Council of the Town ofTiburon;
and
6. Is hereby adopted as the Environmental Impact Report for Round Hill Oaks.
PASSED AND ADOPTED at a regular meeting of the Town Council on June 17,1998,
by the following vote:
