RESOLUTION NO. 3126
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON AUTHORIZING A STATEMENT
OF CHANGE IN BOUNDARIES CONSISTENT WITH
WITHDRAWAL FROM COUNTY FREE LIBRARY SYSTEM
WHEREAS, the Town of Tiburon and City of Belvedere are
currently part of the Marin County Free Library system and receive
library services from the County; and
WHEREAS, on April 19, 1995, the Town Council passed Resolution
No. 3086 authorizing execution of a Joint Powers Agreement with the
City of Belvedere to create a Belvedere-Tiburon Library Agency; and
WHEREAS, on May 3, 1995, Ordinance No. 413 N.S. establishing
a municipal library was adopted at a regular meeting of the Town
Council of the Town of Tiburon; and
WHEREAS, on September 20, 1995 the Town Council of the Town of
Tiburon adopted Resolution No. 3120, a resolution of the Town
Council of the Town of Tiburon expressing the intent of the Town of
Tiburon to withdraw from the Marin County Library District;
and
WHEREAS, on November 1, 1995, the Town Council of the Town of
Tiburon adopted Resolution No. 3125, approving the exchange of
property tax revenues to be used exclusively for public library
purposes from the County of Marin to the City of Belvedere and the
Town of Tiburon; and
WHEREAS, on October 25, 1995, the City Council of the City of
Belvedere adopted Resolution No. 95-36, approving the exchange of
property tax revenues to be used exclusively for public library
purposes from the County of Marin to the City of Belvedere and the
Town of Tiburon; and
WHEREAS, California Education Code S19104 requires that the
Town Council prepare and submit to the County a statement of change
in boundaries, as set forth in Government Code SS54900 through
54903, inclusive; and
WHEREAS, the exterior boundaries of the Municipal Library
contemplated by the aforementioned Ordinance No. 413 N. S. are
coterminous with the exterior boundaries of the City of Belvedere
and the Town of Tiburon, as more particularly described in that

certain map attached hereto as Exhibit A, incorporated herein by
reference; and

WHEREAS, the portion of the area served by the Marin County
Free Library System in the Town of Tiburon and the City of
Belvedere, which will no longer be served by said system is
coterminous with the exterior boundaries of the City of Belvedere
and the Town of Tiburon, as more particularly described in that
certain map attached hereto as Exhibit A, incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town
of Tiburon that:
1) The Town of Tiburon hereby resolves and states that, as
a result of the withdrawal of Tiburon and Belvedere from the Marin
County Free Library System, the boundaries of the area of Tiburon
and Belvedere served by said system will change, such that the area
described in Exhibit "A" to this Resolution will be removed from
the County assessment roll.

The Mayor is authorized to execute such further documents
necessary to carry out the intent of this Resolution as
in the recitals set forth hereinabove.
PASSED AND ADOPTED at a regular meeting of the Town Council of
