TOWN COUNCIL REGULAR MEETING MINUTES Mayor Thier called the regular meeting of the Tiburon Town Council to order at 6:30 p.m. on Wednesday, April 2, 2025, in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. ROLL CALL PRESENT: COUNCILMEMBERS: Fredericks, Nikfar, Ryan, Thier (by teleconference), Welner ABSENT: COUNCILMEMBERS: None

Chuck Hornbrook said one of the Parks Master Plan subcommittees would be presenting material to the Council on 5/21 and they are working on a survey and an updated website. CONSENT CALENDAR CC-1. Discussion on Caltrans Highway 131 Bike Lanes, Location of Yellow Bus JPA Bus Stops – Consider authorization of a letter from the Council to Caltrans/elected officials on the project and impact of the project and a letter from the Council to the Tiburon Peninsula Traffic Relief Joint Powers Authority regarding bus stops

AI-2. Utility Undergrounding Assessment Districts – Receive report on recommended new policy framework by the ad hob subcommittee, and consider directing staff to complete a policy revision
based on the new framework and to lift the moratorium on the formation of new utility undergrounding assessment districts (Office of the Town Manager) Public comment was received by:
• Erin Giacoppo said a group of Mar West neighbors is hoping to form a district and thanked the Council for considering lifting the moratorium and a new framework.
• Alexandra noted the importance of considering safety with utility undergrounding. MOTION: To lift the moratorium and direct staff to solicit bids for engineering services.

Municipal Code Amendments – Hold Public Hearing and consider adoption of Municipal Code amendments to Chapter 14 (Subdivision of Land) and Chapter 16 (Zoning) that would implement regulations and provisions of SB 9, including regulations on lot splits and two-unit housing developments (Community Development Department) – Introduction and first reading of

Amendments to Chapter 23 (Motor Vehicles and Traffic) that would implement provisions of AB 1778, including additional restrictions related to Class 2 electric bicycles (Office of the Town Manager) – Introduction and first reading of ordinance [TAKEN OUT OF ORDER] Public comment was received by:
• Bob Middlestadt spoke in support of the draft ordinance.
• Bart, a retired physician, spoke in support of the ordinance.
• Patrick Seidler, WTB-TAM, spoke in support of the ordinance.
• Elizabeth Fullerton spoke in support of the ordinance.
• Warren Wells spoke of the importance of keeping e-bike regulations consistent across all the cities and towns in Marin. MOTION: To introduce the ordinance and read by title only, to pass first reading, waiving additional
readings, and to schedule for adoption at the next regular Town Council meeting. Moved: Thier, seconded by Welner VOTE: AYES: Fredericks, Nikfar, Ryan, Thier, Welner
PH-3. Town Personnel Hourly Rate Fee Schedule – Hold Public Hearing and consider adoption of a resolution that would adopt the hourly rate fee schedule for Town of Tiburon personnel (Office of
the Town Manager) MOTION: To adopt the resolution. Moved: Thier, seconded by Welner
