RE: AB 57 (Quirk): Wireless Telecommunications Facilities ---OPPOSE
Dear Senator Hueso:
On behalf of the Town of Tiburon, we would like to voice our strong opposition to the
above -referenced bill. The proposed legislation would unnecessarily and unreasonably
impact the Town's ability to thoroughly review and process applications for certain wireless
communications facilities. In fact, AB 57 would go beyond the requirements of federal law
and regulations by deeming approved any application for co -location or siting of new
wireless facilities if a jurisdiction does not approve or disapprove the application within the
timelines required by the Federal Communication Commission (FCC).
In 2009, the FCC adopted rules that require local governments to review and act on
applications for the establishment of wireless communications facilities. Under that ruling,
cities have 90 days to review and act on co -location applications and 150 days for other
wireless siting applications. If cities do not act in this timeframe, an applicant can bring
action in court. During the rulemaking, wireless carriers requested that the FCC adopt the
deemed approved requirements now being proposed in AB 57; the FCC rightly and wisely
refused.
More recent FCC rulings have reduced to 60 days the time for a city to review and act on
certain wireless applications that the FCC determined to be minor in scope. Those rulings
include a deemed approved provision, but the FCC, again wisely, did not choose to apply
such a draconian timeframe to applications for more substantial wireless communications
facilities.
While we commend the bill's author on his desire to improve wireless communication
services, doing so at the expense of a community's ability to properly review and process a
wireless communications facility application is not appropriate and the bill should be
defeated.

Subject: Tom Price Park Fence Proposal
At the May 19, 2015 Parks, Open Space & Trails Commission meeting, Kevin Roberts of 1800
Vistazo West presented an idea to place a fence between Tom Price Park and the Old Rail Trail. He
asked the Commission to consider placing this item on the agenda at the next POST meeting. Two
other persons, Ellen Wittier of Belvedere and Evelyn Jeffery of Tiburon, spoke in support of the fence
at Tom Price Park.
During the meeting the proponents mentioned that they had brought this to the Belvedere Parks and
Open Space Commission, which discussed the item at its May 14, 2015 meeting. Attached is an
article from the ARK regarding this meeting. Based on a review of the meeting proceedings and
confirmation from Belvedere staff, the City of Belvedere does not support this fence.
The proposed barrier would be an amenity of the park and any potential safety issues sought to be
addressed emanate from uses in the park. Given the lack of support by the City of Belvedere it would
not be appropriate to advance this item through the Town of Tiburon.

Greetings:
This letter is a request for waiver of fee for a new sign to identify our faith community, to be placed on our
ProPertY•
We are a relatively small church, with 76 voluntary pledgers. Many are older, on fixed income and live
throughout the county. In addition to providing spiritual support and interfaith opportunities, CCC
provides space for workshops, memorials and weddings for the wider community as well as being home
base for the Hawthorne Pre -K School. In recent years we have enhanced our outdoor sacred space with a
labyrinth and surrounding earth -friendly gardens accessible for the whole community. These upgrades have
depended on substantive gifts from a few members, and we try very hard to be careful with our
contributions so we can have the most effective results.
