Planning Commission Recommendations Regarding Seasonal Rental
Unit Permits
On July 8, 2015, the Planning Commission held a public hearing on proposed zoning ordinance
text amendments that would prohibit short-term vacation rentals in Tiburon. As noted in a previous
memo from Scott Anderson, the Planning Commission voted to recommend to the Town Council
that a ban on vacation rentals not be enacted and offered specific direction regarding numerous
zoning amendments aimed at address concerns that have been raised regarding these uses.
The Commission recommended that the Town Council consider the following changes to the
Town's existing regulations:
1. Change the term "seasonal rental unit" to "vacation rental."
2. Require adequate on-site and/or off-site parking.
3. Require a 7 day minimum for any rental.
4. Do not allow permits for properties with commingled rights (common areas,
pools, access, parking, etc.) with neighboring units, unless there is unanimous
consent among property owners or there are written CC&Rs in the case of a
condominium or townhouse complex.
5. Require permittees to submit an annual reporting statement to the Town.
6. Require courtesy notices to be sent by the Town to neighboring property owners
prior to issuance of a vacation rental permit.
7. Increase fees and penalties to recover costs of enforcement.
8. Only allow permits for homes that are the "primary residence" of the property
owner.
The vacation rental item is at this time tentatively scheduled to be heard by the Town
Council on August 19, 2015.

Update Regarding Signal at North Knoll Road and Tiburon Boulevard Intersection
On July 9, 2015, engineers from Marin County, Mill Valley, and Tiburon met with CalTrans to
discuss traffic issues, particularly the proposed signal at North Knoll.
CalTrans agreed to take an incremental approach to reducing safety problems at this intersection. The
incremental solution may include the following changes:
• Extending the median to provide engineering controls to prevent a left turn from North Knoll
to Tiburon Boulevard
• Installing yield lines at the crosswalk
• Improving crosswalk striping
• Improving and replacing signage
• Reducing vegetation heights to increase visibility
There was a general consensus that eliminating U-turns at this intersection might help safety, but that
additional study and outreach was needed prior to making this change.
It is important to note that the driver for changes at this intersection is excessive vehicular accidents
over an extended period of time. Safety concerns were first highlighted in 2007, and accident rates
triggered concerns again in 2011. In 2012, CalTrans initiated a signal warrant study. The study was
completed in 2013, and indicated that a signal was warranted for safety reasons. Actually, four
separate warrants were met, but safety was the primary driver.
Since 2013, CalTrans has continued to monitor this intersection. For the five year period ending in
June 20I5, there were 31 accidents at the intersection. Crash data indicates that fourteen of these
could have been prevented by the installation of a signal. Of these fourteen accidents, eight were Iegal
left-hand turns from Tiburon Boulevard to North Knoll Road and six were illegal left turns from
North Knoll Road onto Tiburon Boulevard. Two pedestrians have been involved in accidents in eight
years.
Project programming (getting money) at CalTrans can take years. To allow the interim solution to
proceed and to not lose funding should a signal be required, CalTrans will retain the project
programming. However, CalTrans currently plans to implement the above intermediate solution and
monitor its effectiveness to determine if these changes are sufficient to address safety problems.
Further, CalTrans has shown interest in alternative ideas for a signal if a signal is required.

Subject: Update Regarding Freeway Metering Lights
On July 9, 2015, engineers from the Town of Tiburon, Mill Valley and Marin County met with
CalTrans regarding traffic issues at the 131 and 101 interchange.
As part of the meeting, we discussed metering lights. The Council has expressed concern that the
metering lights could exacerbate back-ups on Tiburon Boulevard.
During our discussion, Sean Nozzari, a Deputy Director at District 4, was able to confirm that the
metering light will turn green when cars back up on the ramp. Therefore, when the ramp reaches
the point where it would back up on Tiburon Boulevard, the light would turn green and the ramp
would operate as if the metering lights were not installed. Based on this, it would seem we can
safely assume that metering lights will not increase backups onto Tiburon Boulevard.
It is my experience that back-ups normally occur at the Frontage Road signal. However, in those
instances when back-ups have occurred from the freeway the metering ramp project may actually
provide some benefit:
1. The project as currently envisioned will provide additional ramp storage. This could help
move vehicles off Tiburon Boulevard in the area of the ramp.
2. The worst back-up I have personally experienced from the freeway was related to an
accident on the freeway. It was bad. Ramp metering has been shown to increase safety
adjacent to entrance ramps, so metering could lower the occurrence of such accidents.
Certainly there are remaining questions regarding the metering project. However, given this
latest information, it would seem that the ramp metering project will not exacerbate back-ups
onto Tiburon Boulevard.

CANDIDATE'S INFORMATION PACKET
A Candidate's Information Packet is being prepared to facilitate your filing for election to run for a
seat on the Tiburon Town Council in the November 3, 2015 Municipal Election. Each Candidate
will receive the same information. Along with the official Nomination Paper, this packet will contain
various documents, instructions and general information that you will need during the course of the
election campaign. Please refer to these documents throughout the campaign period.
NOMINATION PAPERS
A candidate for office of Town Council MUST BE A REGISTERED VOTER in the Town of Tiburon.
The Nomination Paper is an official filing form, to be issued by the Town Clerk. The first day
Nomination Papers can be obtained for circulation is Monday, July 13, 2015. In order to be
accepted for filing, the form must be signed by not less than 20 or more than 30 registered voters
of the Town of Tiburon. A voter may sign only one petition for each office; however, each vacancy
in the November 3, 2015 election is considered a separate office; therefore, a voter may sign up to
two (2) petitions for this election. A candidate may sign his or her own nomination form.
You may circulate the Nomination Paper yourself, or you may have someone else circulate it, but
YOU MUST SIGN THE NOMINATION PAPER AND TAKE AN OATH PERSONALLY IN THE
OFFICE OF THE TOWN CLERK.
It is recommended that you obtain the full 30 signatures to ensure that there are sufficient valid
signatures. It is also recommended that you file early enough to allow time for verification of the
signatures with the County Clerk and to allow time for a supplemental form to be circulated if there
are any problems.
Please note that each person signing the Nomination Paper must both sign and print his/her name
and give a complete address (no post office boxes are acceptable). Successive signers may not
use ditto marks to indicate that the Town is the same as on the line above.
The last day to file Nomination Papers is Friday, August 7, 2015, at 3:30 p.m. If any ONE of the
incumbents has not filed by 3:30 p.m. on Friday, August 7, the filing period will be extended for
non -incumbent candidates only to Wednesday, August 12, 2015, at 5:30 p.m. Nomination Papers
may be withdrawn up to the last day and hour for filing, but no later.

The Nomination Paper must be accompanied by a $25.00 filing fee made payable to Town of
Tiburon.
YOUR NAME ON THE BALLOT
The way your name appears on the Nomination Paper is the way it will appear on the ballot.
Be careful of the exact spelling and punctuation of your name. You may use a nickname in
parentheses or quotation marks only. No personal titles will appear on the same line with your
name on the ballot (Miss, Mrs., Ms., Dr., Rev., M.D., Ph.D., etc.).
There is a space on the nomination form for a ballot designation. The ballot designation shall be no
more than three words designating the principal profession, vocation or occupation of the
Candidate.
The word "incumbent" may be used by elected incumbent Candidates. If you are an appointed
incumbent, you may use the words "appointed incumbent". If you do not want a ballot designation,
please write "None Requested".
The ballot designation may not:
1. Mislead the voter.
2. Suggest an evaluation of a Candidate, such as Aoutstanding, leading, expert, or eminent.-
3. Abbreviate the word "retired" or place it following any word or words that it modifies.
4. Use a word or prefix, such as "former" or "ex-", which means prior status.
5. Use the name of any political party.
6. Use a word or words referring to a racial, religious or ethnic group.
7. Refer to any activity that is prohibited by law.
More in formation on selecting a ballot designation is contained in the attached 2013 Candidates'
Guidelines issued by the County of Marin, as well as on the Ballot Designation Worksheet.
CANDIDATE'S STATEMENT OF QUALIFICATIONS
You may, if you choose, submit a Candidate's Statement of Qualifications at the time of filing the
Nomination Paper. This statement will be published in the Voter's Pamphlet sent to all registered
voters within the Town of Tiburon, along with the Sample Ballot, prior to the election. The official
form to be used for this statement is attached. The Candidate's Statement may not exceed 200
words; the Candidate is responsible for the cost of printing the statement.
For this election, the cost of printing the Candidates' Statement of Qualifications is estimated to be
$190.00 ($480 for both English and Spanish). A check in this amount should be made out to the
Town of Tiburon and given to the Tiburon Town Clerk at the time of filing. The Town Clerk will
deliver the statement to the County of Marin for printing.
The Candidate's Statement can be typed on a separate piece of paper but must be submitted with
the form provided. The law implies uniformity in the printed appearance of all statements; therefore,
do not use capital letters, unusual spacing, markings, asterisks, etc.

Please review the statement carefully, as it cannot be changed after the filing deadline (3:30 p.m.
on August 7, or 5:30 p.m. on August 12, 2015, if the filing period is extended). It can be withdrawn
(not changed) the day after the filing period has ended. A proof will be sent to the candidate prior to
printing only for correction of printing errors; other changes are not permitted by law.
Candidate's Statements submitted at any time during the filing period are kept confidential until the
last day and hour for filing. After that time, they become public record.
ORDER OF NAMES ON THE BALLOT
A drawing of the letters of the alphabet will be conducted by the Secretary of State in Sacramento
on August 13, 2015, to determine the order of names on the ballot for all candidates. Each
candidate will be placed on the ballot in the order that each of the letters of his/her surname was
drawn.
CANDIDATE'S INTENTION STATEMENT — Form 501
State law requires that any person who intends to raise or spend any campaign funds for his/her
candidacy for elective office must report this information BEFORE funds are solicited or received.
A Candidate Intention (Form 501) must be filed with the Town Clerk and is attached to this memo.
CAMPAIGN COMMITTEE STATEMENT OF ORGANIZATION — Form 410
The Political Reform Act provides that candidates, and committees supporting Candidates, disclose
all contributions and expenditures. If you will be establishing a Committee and expect that the
Committee will receive contributions totaling $1,000 in this calendar year, or make expenditures
totaling $1,000, you must select a Committee Treasurer (the candidate can be either the Treasurer
or Assistant Treasurer) and file a Statement of Organization (Form 410) with the Secretary of State
as soon as the Committee raises $1,000. This form will be provided to you, along with a copy of
your Campaign Disclosure "Manual 2" for Candidates and their Controlled Committees.
STATEMENT OF ECONOMIC INTEREST — Form 700
ALL CANDIDATES MUST FILE A STATEMENT OF ECONOMIC INTERESTS WITH THEIR
NOMINATION PAPERS. This allows the public to know what investments or business interests
you have within the jurisdiction. Complete the attached Form 700 and check the box for "candidate"
statement.
FILING SCHEDULE FOR OTHER CAMPAIGN STATEMENTS — Form 460
During the campaign, Campaign Expenditure Statements (Form 460) must be filed no later than
September 24. 2015 for the first reporting period; and by October 22. 2015 for the second reporting
period. "Late" funds must be reported within 24 hours. A final Campaign Expenditure Statement
must be filed no later than December 31, 2015, unless you want to keep your campaign bank
account open by paying a $50 annual filing fee to the Secretary of State (and filing a semi-annual
statement on an ongoing basis).

Dear Ms. Wiebke,
Thank you for responding to my request for a safe and accessible means to
cross Tiburon Blvd. (State Route 131) at Blackfield Dr./Greenwood Bay Drive.
As you know, I initially made this request on July 18, 2013. While I appreciate
that a renovation of this intersection is planned, I believe the "late 2018" time
line is unacceptable given the level of hazard present at this site. I am fully
aware that Caltrans has many areas where accessibility requires your attention.
I would appreciate a thorough, current analysis of the pressing need for work at
this high traffic (vehicular and pedestrian) site and revisiting your schedule to
include a completion date much sooner than late 2018.
With traffic congestion on the rise on our state highways and local roads and
arterials, Strawberry -Tiburon Peninsula residents and the local workforce seek
opportunities to patronize neighborhood -serving retail and commercial stores
nearby. This intersection is right at the entry of the Cove Shopping Center, a
local magnet for pedestrians, cyclists, residents with disabilities, older adults in
nearby apartment buildings, as well as school children and residents crossing
there to access Strawberry Point School, two Churches, a Synagogue, two
pre-schools, and the Tiburon schools a bit further away. This confluence of
communities has waited patiently for improvements here; in the meantime, our
needs have grown, especially given the need to find other ways to get around,
including bikes, feet, scooters and other motorized and non -motorized vehicles.
