Help save water! This is in response to your recent letter in which you requested to pursue traffic safety improvement alternatives other than a new traffic signal at the intersection of Tiburon Boulevard (State Route 131) and North Knoll Road. Specifically, you expressed concerns about traffic flow impacts resulting from a new traffic signal at this location and requested additional information about accident patterns, alternatives considered. In addition, you parlayed the local technical advisory committee recommendation to eliminate the existing pedestrian crosswalk at this intersection. Lastly, you suggested that the pedestrian facilities, ordinarily included with a proposed signal project and required by the Americans with Disabilities Act (ADA), be pursued as a separate project (without a signal). As you are aware, accident data and alternatives considered were recently reviewed and coordinated with staff from Mill Valley, Tiburon, Marin County Public Works Department, and the Transportation Authority of Marin (TAM). A summary of the information exchanged is attached for your use. Accordingly, Caltrans will proceed with certain short-term incremental improvements at this location, consisting of enhanced signage/delineation/marking/lane separators system to effectively restrict southbound through and left turn movements (from North Knoll Road). In addition, the restriction of eastbound U-turn on Tiburon Boulevard at North Knoll Road can be included as part of this work, pending public support or acceptance resulting from an outreach currently underway by the Marin County Public Works Department. It is expected that the proposed interim improvements will be completed by spring 2016. The effectiveness of the measures employed will be monitored through our regular safety monitoring program's quarterly reports. Should this location continue to be identified as a high accident concentration location, we will further coordinate with stakeholders in pursuit of other remedial measures, including traffic signalization. It must be noted that the Technical Advisory Committee (TAC) organized by TAM recommended the removal of the existing marked crosswalk at this location in conjunction with a new sidewalk along the north side of Tiburon Boulevard between North Knoll Road and Redwood Highway Frontage Road, along with respective signage, pedestrian barricade, and other appurtenant provisions that direct pedestrians along a safe path. Outright elimination of the "Provide a safe, sustainable, integrated and efficient transportation system to enhance California's economy and livability" Mr. Jim McCann August 11, 2015 Page 2 existing crosswalk at this intersection not only raises tort liability concerns but also may be perceived as in conflict with the complete streets vision, now broadly endorsed by most transportation agencies towards accommodating all roadway users, including motorists, transit riders, bicyclists, and pedestrians. Moreover, eliminating an existing marked crosswalk must be processed through the procedure outlined in the California Vehicle Code Section 21950.5, intended to reflect full public disclosure and support. Lastly, providing ADA upgrades without a new signal does not necessarily address all safety concerns at the intersection and may possibly exacerbate certain conditions. This update has been divided into four sequential work phases: (1) business/operations; (2) regulatory actions; (3) planning activities; and (4) personnel matters. This update marks the first comprehensive review of the Commission's policies and procedures since 2000. Underlying the update is the Commission's interest to ensure all current statutory obligations and directions are incorporated as well as reflect the membership's collective preference in how it chooses to implement LAFCO law in Marin County. Current Work Phase / Update to Planning Policies The Commission is currently proceeding through the third of four work phases to the scheduled policy update and this involves revising LAFCO's planning policies. The focus of this phase is to telegraph core planning principles and expectations to guide future and corresponding regulatory actions (boundary changes, agency formations, consolidation, etc.) through timely and regular sphere of influence updates and municipal service reviews. A draft proposal on this third phases was presented to the Commission for discussion at August 13th meeting and is now available for public review and comment in anticipation of tentative membership action on October 8th. A summary of key revisions proposed as part of this third phases follows with a complete version available for viewing and or downloading at www.marinlafco.org. Herb'Aleiner Alternate Members Keene Simonds Executive Officer Notice of Review/ Comment Draft Update to Marin LAFCO's Planning Policies August 26, 20I5 • Commission Intentions in Establishing and Updating Spheres of Influence New policy statements have been added with respect to outlining the Commission planning intentions in designating spheres of influence; the Legislature's version of urban growth boundaries and the gatekeeper with respect to future boundary changes and outside service extensions. This includes making explicit the expectation of the Commission that land placed within a city/town's sphere of influence be planned and ultimately developed by the affected city/town. A corresponding statement is also added that it is the Commission's expectation that any land located outside any city/town's sphere of influence should be planned by the County of Marin and not a city/town. • Deference to LAFCO's Schedule in Making Sphere of Influence Changes A new policy statement has been added with respect to outlining general direction in reviewing spheres of influence to improve predictability when changes are considered with deference to the Commission's timetable. This includes encouraging local agencies and the general public to defer requests for individual sphere of influence amendments in favor and deference to the Commission's comprehensive updates. • New Review Standards for Sphere of Influence Changes New policy statements have been added with respect to outlining general standards in reviewing spheres of influence and involves narrowing the evaluation criteria. This includes amending the current planning horizon for spheres of influence designations from 15 to 10 years. A new standard is also added for special district spheres of influence to show consistency with applicable general plan or community plan and need for services within the next 10 years. • LAFCO Study Schedule / Processing Sphere Change Requests New policy statements have been added to direct the Commission to adopt a study schedule calendaring spheres of influence updates and the informing documents - i.e., municipal service reviews - to cover five-year planning cycles.
