SF[u.13 l�- TOWN CLERK TOWN OF TIBURON PLEASE RESPECT OUR SMALL-TOWN's SECURE AND PEACEFUL NEIGHBORHOODS by upholding the decision made by your vote on Aug. 19. In response to: "...get a life"" Well, we have "a life" and we love it and we appreciate it and and we want to keep it!! It's what we came here for and what we don't want to lose — a special rural -like close community whose varied individuals respect one another's privacy, security, peace and values. Many of us residents have "had a life", lived in wonderful places and came here and paid our dues to be able to have the specialness that entails "Tiburon Life". We residents didn't come here looking to live in tourist traps like Maui, Key West or Cabo. THEY were once lovely, quiet, peaceful and secure places to live too... Let's not turn into one of them. It is very upsetting to hear community officials speaking of financial gain they may "be entitled to" because "everyone is going to do it and we can't control it anyway". What would our nation of laws and order and responsibility for ourselves and others be without some regulations? Why have governing bodies like town councils, and planning commissions and zoning laws that have been working for several decades? Maybe we need more responsible, mature and caring elected officials who have a sense of community and not just their own opportunistic "values" of financial gain. Are you so naive as to believe that sophisticated thieves, drug dealers and sex offenders won't see this affluent and relaxed community as an ideal place to case out? Neighbors are subject to strangers as renters come and go frequently. We soon know it's fruitless to keep on an alert or watchfulness because of the constantly changing movement of people and equipment — house cleaners, carpet cleaners, and other maintenance workers that need to follow the flow of commercial ins and outs. Common sense about caring who is coming and going gives way to "what good will it do" when absentee homeowners are unavailable, far away or don't care. Ask the police, awareness and prevention are better than what comes after the crime... Open your homes to the public and soon you open your lives to what public exposure can bring. And who DO we report problems to??? After dark, our local police can only be reached by a faraway dispatcher, who often doesn't care. Maybe, if it is a "serious enough crime", police will be sent. I've lived 50 feet from an absentee -owner short term rental for 2-3 years and have experienced some no -fun times. Recently at 2:30 AM a bus -like vehicle stopped at the bottom of our close driveways and turned on his loud dinging "back-up warning" bell. For 15 minutes this continued while various people climbed in and out of the vehicle. I assume everyone tried to figure out where they were and where they were going. The noise and disturbance were no fun in the dark AM hours. The next day, about 10 members of a wedding party came out of the rental next door as the motorized cable car waited, blocking our narrow street for some 20 minutes. Then he backed up 1/2 block (dinging bell blaring again) and got caught in a steep grade at the corner, almost tipping the whole vehicle and passengers over. All this was because the vehicle was too big to turn around and the driver didn't know how to navigate our narrow steep streets. Not anything to call the police about, but a complaint could have been filed if I'd know where and how...?? Yes, I "have a life", and I don't need to listen to the blare of a back-up dinging bell for 15 minutes in the early morning hours when a driver is lost. 1 So, again, PLEASE consider the kind of life we residents came here for and respect our wanting to keep the specialness of it. Swanson There Goes the Neighborhood Reacting to a sudden wave of Airbnb and other short-term home rentals in Tiburon, our Town government is discussing creating a law that would limit in some way the length of short-term Tiburon home rentals. First, I have no personal axe to grind. The ccrs of our homeowner's group of 30 does not permit short term rentals. Tiburon is a community that prizes its neighbors and neighborhoods. For example, Point Tiburon, a very neighborly complex, (I don't live there) has a recent policy that limits absentee owners to a small percentage. One reason: if current owners want to refinance, lenders are reluctant; lenders believe that short-term renters will not keep the condos up to Pt Tiburon standards. Another reason: Pt Tiburon owners do not want speculators coming in to buy properties and then immediately to put them on rental sites. Both of these are situations that could affect any Tiburon neighborhood. The Town advises that they are unable to enforce any limited short-term rental policy. The Town says that it depends on neighbors to tell them if a rental is creating problems. For the Town to expect neighbors to turn vigilante does not strengthen our neighborhoods. How can a law be law without enforcement? Either Tiburon allows such short-term rentals, or it does not. i Homeowners who believe that they have a reasonable request for renting their residence; e.g., they are being relocated for a time, or plan several months of travel, etc. could be considered on a case-by-case basis. This ban addresses a problem which our town does not have. Vacation rentals have existed in our town for many years, and the number of complaints they have generated are minimal compared to those generated by permanent residents. Yes, our town has problems, like dealing with increasing school traffic, but vacation rentals is not on that list of problems which need to be solved. We are an educated, forward -thinking community located in a spectacular place with easy access to so many of the Bay Area's jewels. Why would we not want to welcome visitors here? Are we afraid of visitors? Then why do we have Fridays Nights on Main? And other festivals? And ferry service to Fisherman's Wharf and Angel Island? The point has been raised that the burden of regulation is too much for a small town to bear. While I appreciate that crafting a just and thorough regulation may be challenging, I feel that if a law is in place that is fair and respects the rights of property owners, neighbors and the community as a whole, it will be followed and regulatory expenses will be minimal. If allowed, the town will bring in revenue through taxes- couldn't this be used to offset any regulatory administrative expenses? The idea that a ban will cost nothing is also not accurate, as if you pass the current regulation then someone on staff at the town will have to scour the web for any illegal activities and prosecute them. The well-being of the town and our community is upheld best with a different regulation- one which allows people to rent out their primary residences while they are away- with certain stipulations about appropriate activities and numbers of guests, etc. The world is changing, and expecting that we can remove ourselves from it is unrealistic. Vacation rentals of primary residences allows people of modest means to live here, as homeowners if they are able. Do we really want to be a town of only the wealthiest people, who can only live here if they can leave their home empty when they travel? I suspect if we looked back in the police records that there have been at least as many problems with empty homes as there have been with short term rentals- like the man who was living in his mother's empty home unbeknownst to her and robbing houses in our neighborhood. We had the good fortune to travel to Spain this summer and stay in Air B&B's the entire trip, and it was like visiting friends of friends each place we stayed. We met our hosts, got referrals to local businesses, and developed a real sense of the authentic nature of each town. Our 11 year old son was shocked when he heard that the council had voted to outright ban rentals of less than 30 days. He said, "Tiburon doesn't want to let people come stay in other people's homes? I don't want to live in that town. I don't want that to be our town." Thank you for your time and service. As you vote on this issue, please think of what is really best for the town. My current view is that short term rentals should only be possible more than 31 days and after thorough screenings of the persons leasing and being leased to. I also believe licenses should be issued and taxes paid to the town with a good portion of that revenue paying for law enforcement for those very leases. I think perhaps applications should only be granted to US citizens to allow for accountability. No one with a sketchy driving record or noises violations should be accepted. The short term rentals should only be allowed for a certain number of months per year. I have used Airbnb to travel throughout the world with great satisfaction, but at the meeting it became clear that many of the speakers do not have personal experience with VRBO, Airbnb or similar platforms. Perhaps a town hall informational meeting could present the rental process through one or more of these platforms to bring attendees to the same understanding of how tenants can be vetted, what restrictions landlords can put in place, and how the process works. It would be great to have someone from Belveron East on the work group to "represent" the homes of Belveron and BelAire which are similar. I would be more than glad to volunteer my time. Unfortunately, I probably have a conflict of interest here. I am the President of Belveron East Neighbors Association and I don't want to appear that if 1 am in such a work group 1 am representing the whole neighborhood. Our HOA has not made an official stand on this though in general most support having vacation rentals like AirBnB with some limitation of # of days per year, minimum days etc. Therefore without an official stand then I might be conflicted here. Therefore, Frances who you know has been involved on this subject as well and has the same view as I do on this topic. She is no longer on the BENA board and therefore has no conflict of interest. I had spoken to her and she said she would be interested in helping out town council on the subject. She couldn't make the town council the other day but would be a great addition to your work group. We created a report to help all of us to see how and where we fit into the region and to distill its complexity to three principles that matter most for the region's future: people, places, and prosperity. The report provides a set of proposals for making our region a more resilient, equitable place with a diverse economy. It is the start of a discussion that will help shape regional actions to address our most pressing challenges.
