A subsequent owner has now requested that the Town accept the offer of easement. ACCEPTANCE NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon does hereby accept the offer of drainage easement over property commonly known as 26 Venus Court, as set forth in attached Exhibit "A". CRANE, TOWN CLERK I'" EXHIBIT "A" RECORDING REQUESTED BY AND WHEN RECORDED MAIL TO: Town Clerk Town of Tiburon 1505 Tiburon Blvd. Tiburon, CA 94920 Easement David L. and Margaret S. Ogden, a married couple, hereby grant to the TOWN OF TIBURON, a municipal corporation, and to PERINI LAND AND DEVELOPMENT COMPANY, and to their respective successors and assigns, a non- exclusive easement over, under and along the property identified and described in Exhibit A (attached hereto and made a part hereof) for the purpose of constructing, installing, maintaining, reconstructing, and repairing a drainage pipe and other drainage facilities. -- The above-named grantees shall further have all rights necessary or incidental to the easement granted above, including the right from time to time to enter upon, cross over and use the property of the grantor adjacent to the property identified and described in Exhibit A to the extent necessary for the purpose of mai!'.taining, reconstr1.1cting, and repairing such easement and the drainage pipe and other drainage facilities located therein; provided, that entry and use by the grante~s of the property of the grantor adjacent to the property identified in Exhibit A shall not unreasonably interfere with use or occupancy of such property by the grantor or her successors and assigns.
