HomeMy WebLinkAboutTC Res 1997-07-02 (6) , RESOLUTION NO. 3227 -- A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON ADOPTING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FOR THE FORMER TIBURON TOWN HALL SITE (1155 TmURON BOULEVARD) WHEREAS, the sale ofa portion of the former Town Hall property, and its use for a senior housing project was approved by Tiburon voters in June 1995 through the initiative process; and WHEREAS, the long-term proposed use of the property is for construction of an up to 25-unit senior housing facility on approximately 1.5 acres ofland located at 1155 Tiburon Boulevard (portion of58-151-23); and WHEREAS, the Tiburon General Plan Land Use Element Diagram LU-3 (Land Use) currently designates this property for 'Public/Quasi-Public' use. In October 1996, an application for a general plan amendment was initiated based on the Town's desire to move fOlWard with the planned senior housing development; and WHEREAS, the general plan amendment proposes a change in the property land use designation from Public/Quasi-Public to Very High Density Residential; and r WHEREAS, in May 1997, the Tiburon Planning Department Staff prepared an Initial Study for the project, along with a draft Mitigation Monitoring and Reporting Program (MMRP), which determined that there was no potentially significant environmental effects related to the project which could not be mitigated through modification of the project and through mitigation measures adopted as conditions of approval for the project; and WHEREAS, the Planning Commission has reviewed and considered the information contained in the Initial Study and the Draft Mitigated Negative Declaration, and any and all comments and responses thereto. In addition, the Planning Commission has reviewed the proposed general plan amendment, and recommends that the Town Council adopt the Draft Negative Declaration and general plan amendment; and WHEREAS, a notice of the public hearing on the Draft Mitigated Negative Declaration and the project applications was also posted, mailed, and published in the Ark newspaper; and WHEREAS, the Town Council conducted a public hearing on July 2, 1997, to receive public testimony on the proposed general plan amendment; ~ Tiburon Town Council Resolution No. 3227 1 . T' NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon does hereby make the following findings: 1. The Mitigated Negative Declaration for the project, which consists of the Initial Study document dated May 1997, the Negative Declaration form and the Mitigation Monitoring and Reporting Program (MMRP), adequately assesses the potential environmental impacts of the proposed general plan amendment. 2. The proposed general plan amendment would be consistent with the Tiburon General Plan in that it would establish an appropriate land use designation for a site that is to be developed with housing for senior citizens. The amendment would acknowledge and reinforce one ofTiburon's primary housing goals, which is to provide a variety of housing types which will meet the needs of present and future residents of Tiburon (General Plan Housing Element - Goal H-A). 3. The amendment would be consistent with Housing Policy H-28, which encourages the provision oflow income housing units, especially for single persons, single parents, elderly and young families; and Policy H-2, which encourages the promotion of residential opportunities through the unique powers of the Redevelopment Agency. The project site is located within the boundaries of the Tiburon Redevelopment Agency (TRA) project area. The TRA may provide funding to assist in the construction of at least four very low income units. I"" 4. The proposed general plan amendment would not be detrimental to the existing and planned uses of adjacent property (the Hilarita Apartments, Reed School, Belvedere- Tiburon Child Care Center, Tiburon Police Department. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Council hereby adopts the general plan amendment to Diagram LU-3 (Land Use) of the Land Use Element, changing the land use designation of the subject property, as described in attached Exhibit "A", from 'Public/Quasi-Public' to 'Very High Density Residential'. BE IT FURTHER RESOLVED that the Planning Director is directed to file a Notice of Determination with the County Clerk within five (5) working days of the project approval.
