A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON AUTHORIZING THE SUBMITTAL OF AN AMENDED GRANT APPLICATION FOR CALIFORNIA TRANSPORTATION COMMISSION PROPOSmON 116 FUNDS FOR THE TIBURON DOCK REALIGNMENT AND RECONSTRUCTION WHEREAS, pursuant to the Clean Air and Transportation Improvement Act ("CA TIA "), the California Transportation Commission ("CTC") awards grants for ferry service improvements; and WHEREAS, the Town of Tiburon, working with the Red & White Fleet, wishes to retain its previously granted Proposition 116 funds for the Tiburon Dock Realignment and Reconstrnction Project; and WHEREAS, the CTC's guidelines require the Town Council to make certain certifications regarding its amended application; and WHEREAS, on November 18, 1992 and Febrnary 3, 1993, the Town Council authorized the submittal ofthe application for the Proposition 116 funds for the project described in said application; and WHEREAS, the project has been amended since the submittal of the application, requiring the submittal of an amended application; NO\}', THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Tiburon that: 1. The project as amended complies with all screening criteria for Proposition 116 waterborne ferry program funds. Specifically, . The Town ofTiburon is statutorily eligible for funding pursuant to Public Utilities Code Section 99651. . The Town Council has approved submittal of this amended application. . The Town of Tiburon in conjunction with Red & White Fleet, has the financial ability to implement, maintain and operate the project. . The Town of Tiburon will be able to expend the Proposition 116 proceeds within 24 months of the close of the bond sale. -- r- I ~ L .L . The proposed project will be fully accessible to persons in wheelchairs and to .. bicycles. . The Town of Tiburon will complete the environmental review of the project required by CEQA. . The proposed project is identified in the San Francisco Bay Area Regional Ferry Plan. 2. The following certifications required by Section VI-B of the CATIA Ferry Project Application Guidelines are hereby made by Town Council: . No other capital funds previously programmed, planned or approved for waterborne ferry purposes will be used for other than waterborne ferry purposes. . New development fees, taxes or exactions, or permit fees have not and will not be included in the operating budget(s) for this project. . No other state funding sources will be utilized to complete this project if costs exceed those identified in the amended application. . The Town of Tiburon has the financial and institutional ability to accept the legal liabilities associated with this project. 3. The Town Engineer is hereby delegated the authority to submit an amended application on behalf of the Town. 4. This resolution supersedes Town Council Resolution Nos. 2282 and 2901. .
