RESOLUTION NO. 3195

A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON AUTHORIZING THE MAYOR TO
ACCEPT CONVEYANCE OF A PEDESTRIAN EASEMENT
ACROSS THE SITE OF THE CECILIA PLACE SENIOR
HOUSING DEVELOPMENT ON BEHALF OF THE TOWN
WHEREAS, the Town Council of the Town ofTiburon approved the Precise Development
Plan for the Cecilia Place Senior Housing Development at its meeting of July 6, 1994, by Resolution
No. 3034; and
WHEREAS, Condition 4 of Resolution No. 3034 required the project owner to dedicate to
the Town a 100foot wide pedestrian easement over the Town's existing emergency access easement
and in the same location as the existing pedestrian easement; and
WHEREAS, Cecilia Place Homes Limited Partnership, a California limited partnership, IS
prepared to convey the easement required by Resolution No. 3034 as project owner; and
WHEREAS, state law provides that the deed to the subject easement shall not be accepted
for recordation without the consent of the Town evidenced by its certificate or resolution of
acceptance attached to or printed on the deed or grant and the acceptance of the subject easement
will benefit the residents of Tiburon.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Tiburon that
the Mayor is authorized to accept conveyance of the subject pedestrian easement Tiburon as Exhibits
A and B to this resolution, which Exhibits are attached hereto and incorporated herein by reference,
and execute all documents necessary to memorialize said acceptance.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town ofTiburon
on November 20, 1996 by the following vote:
