HomeMy WebLinkAboutTC Res 1996-05-15 (6) I. .. /" " r L r , RESOLUTION NO. 3157 A RESOLUTION OF THE TIBURON TOWN COUNCIL APPROVING AN AMENDMENT TO THE HEXAN MASTER AND PRECISE PLANS TO MODIFY THE SECONDARY BUILDING ENVELOPE FOR LOT 2 (15 CIBRIAN DRIVE) ASSESSOR PARCEL NO. 38-011-44 WHEREAS, the Town Council of the Town ofTiburon does resolve as follows: Section 1. FindinlZs. A The Town Council has received and considered an application filed by Marc Loupe and Anette Harris-Loupe to modifY the secondary building envelope for Lot 2 of the Hexan subdivision (Application #39601). The modification is requested to accommodate a swimming pool and associated decking. The application consists of the following: 1. Application form received January 4, 1996 2. Exhibits received April 4, 1996 The official record for this project is hereby incorporated and made part of this resolution. The record includes the Staff Reports, minutes, application materials, and all comments and materials received at the public hearing. B. The Planning Commission held a duly-noticed public hearing on April 24, 1996 and has adopted Planning Commission Resolution 96-04 which recommends that the Town Council approve the project with specified conditions. C. The Tiburon Town Council has held a duly-noticed public hearing on May 15, 1996 and heard and considered testimony from interested persons. F. The Town Council has found that the proposed building envelope modification is consistent with the Tiburon General Plan and Zoning Ordinance. The proposed amendment will allow appropriate development of accessory structures (i.e. swimming pool and decking) in the rear yard area. G. The Town Council has found that the project is exempt from the requirements of the California Environmental Quality Act per Section 15303 of the CEQA Guidelines. Section 2. AoorovaI. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon does hereby approve an amendment of the Precise Development Plan for the Hexan subdivision (File #39601) as follows: Tiburon Town Council Resolution 3157 May 15,1996 I /' r ,1""' "-- r ( , I. The Master and Precise Plans for the Hexan subdivision shall be amended to modifY the secondary building envelope on Lot 2 as shown on the Site Plan prepared by James Bradanini and amended by the Planning Commission on 4/24/96 (as shown on the plans received 5/9/96). This amendment would create a secondary envelope area behind the existing residence on the site to accommodate a swimming pool and decking. The amendment would also delete a corresponding area of the existing secondary envelope in front of the existing residence. 2. Site Plan and Architectural Review approval shall be required for the specific design and placement of any future improvements on the property, including the proposed pool and decking. Landscaping shall be provided to adequately screen the underside of any cantilevered elements of the pool improvements. 3. All requirements of the Corte Madera Sanitary District, as stated in their letter of March 11, 1996, shall be complied with. 4. All requirements of the Tiburon Town Engineer, as stated in his letter ofJanuary 11,1996, shall be complied with. 5. All requirements of the Tiburon Fire Protection District, as stated in their letter of January 10, 1996" shall be complied with. 6. Unless specifically stated in this approval, this amendment does not otherwise affect any specific provisions of Ordinance #267 N.S., Town Council Resolution #2095, Town Council Resolution #2296, or any other approved instruments or Town approvals associated with the Hexan Subdivision.
