RESOLUTION NO. 3150
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON ADOPTING AN AMENDMENT TO THE LAND USE
ELEMENT OF THE GENERAL PLAN FOR THE
NEW TIBURON TOWN HALL SITE
(1515 TlBURON BOULEVARD)
WHEREAS, the Town of Tiburon is proposing the construction of a new 9,000
square foot public Town Hall facility, proposed for approximately 0.5 acres ofland located at
1515 Tiburon Boulevard (western portion of AP#58-171-82). The Tiburon General Plan
Land Use Element Diagram LU-3 (Land Use) currently designates this property for
'Neighborhood Commercial' use; and

WHEREAS, in January 1996, the Town initiated an application to amend the Tiburon
General Plan land use designation for the subject property, changing the designation from
'Neighborhood Commercial' to 'Public/Quasi-Public'; and
WHEREAS, in February 1996, consistent with the provisions of the California
Environmental Quality Act, the Tiburon Planning Department Staff prepared an Initial
StudylMitigated Negative Declaration for the general plan amendment and the Town Hall
development project, along with a draft Mitigation Monitoring and Reporting Program
(MMRP), which determined that there was no potentially significant environmental effects
related to the general plan amendment or the project which could not be mitigated through
modification of the project or through mitigation measures adopted as conditions of approval
for the project; and
WHEREAS, a notice of the public hearing on the general plan amendment was posted,
mailed, and published in the Ark newspaper; and
WHEREAS, the Town Council conducted a joint public hearing with the Planning
Commission on March 20, 1996 to receive public testimony on the proposed general plan
.. amendment; and
WHEREAS, following the Planning Commission review and recommendations, the
Town Council reviewed the proposed general plan amendment.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon does hereby make the following findings:
1. The Mitigated Negative Declaration for the Town Hall project, which consists
of the Initial Study document dated February 1996, the Negative Declaration
form and Mitigation Monitoring and Reporting Program (MMRP), adequately
assesses the potential environmental impacts of the general plan amendment.

The proposed general plan amendment would be consistent with the Tiburon General
Plan ill that it would establish an appropriate land use designation for a site that is to
be developed with a public use facility. The amendment would acknowledge and
reinforce Tiburon General Plan Policy LU-27 by realizing the development of new and
expanded public facilities. Furthermore, the amendment would be consistent with
Policy LU-l as it would encourage the development of a new Town Hall facility that
would be conveniently located to the residents of the community.
3. The proposed general plan amendment is logical and appropriate in the a) the subject
propelty is proposed for dedication, in-fee, to the Town ofTiburon, b) would be
consistent and compatible with the Public/Quasi-Public general plan land use
designation adopted for the adjacent Belvedere- Tiburon Library site and c) would
facilita.te a combined planning effort of the Town Hall and library projects, thus
creatiIlg a civic center of public facilities.
4. The proposed general plan amendment would not be detrimental to the continued use
and future development of the lands immediately east of the 0.5 acre subject property
(Land!. of Zelinsky). This contiguous land would continue to be designated as
'Neighborhood Commercial' in the Tiburon General Plan. This designation is
consistent with the existing pay parking lot use and the general plan designation,
zoning and land use pattern of neighboring properties in Downtown Tiburon.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Council hereby
adopts the geIleral plan amendment to Diagram LU.3 (Land Use) of the Land Use Element,
changing the land use designation of the subject property, as described in attached Exhibit
"A", from 'Neiighborhood Commercial' to 'Public/Quasi-Public'.
BE IT FURTHER RESOLVED that the Planning Director is directed to file a Notice
of Determination with the County Clerk within five (5) working days of the project approval.
PASSED AND ADOPTED at ajoint meeting of the Tiburon Town Council and
Planning Commission held on March 20, 1996, by the following vote:
