RESOLUTION NO. 60-2005
A RESOLUTION OF THE TOWN COUNCiL OF THE TOWN OF TIBURON
APPROVING MODIFICATIONS TO THE ST. HILARY CHURCH AND SCHOOL
CONDITIONAL USE PERMIT AT 761 HILARY DRIVE
ASSESSOR PARCEL NOS. 055-253-20 & 055-221-06

WHEREAS, on October 26, 2005 the Planning Commission held a public hearing to
consider the approval of an application (File #10504) to modify the conditions of approval of a
previously approvl:d conditional use permit (File #19908, Town Council Resolution No. 3643) to
expand the facilitiā¬:s for an existing church (St. Hilary Church) and school located at 761 Hilary
Drive. The application consists of an application form and supplemental materials dated October
5,2005. The official record for this project is hereby incorporated and made part of this
resolution. '1he record mcludes the StatY Reports, minutes, application materials, and all
comments and materials received at the public hearing; and
WHEREAS, after receiving public testimony and considering the application, the
Planning Commission adopted Resolution No. 2005-16 recommending to the Town Council that
the requested modifications be approved; and
WHEREAS, The Town Council has tound that the project is exempt from the
requirements of the California Environmental Quality Act per Section 15301 of the CEQA
Guidelines; and
WHEREAS, on November 9, 2005, after holding a duly noticed public hearing and
considering all testimony and all documents in the record, the Town Council concurred with the
findings made by the Planning Commission and found that the project is consistent with the
Tiburor. General Plan and is in compliance with the Tiburon Zoning Ordinance and other
applicable regulations. The Town Council finds thaI the IlIodifid couditlOiiS of apprc"Q] wo\11<1
not result in additional noise or traffic impacts on the surrounding residential neighborhood. The
Town Council also finds that the requirement for a traffic monitor on school days at the Hilary

r"' Drive entrance to the property is no longer necessary due to revised traffic patterns and
installation of speed bumps on the subject property that have reduced the volume and speed of
traffic in this area. The Town Council also finds that the requested modifications are minor in
nature and are in keeping with the spirit and intent of the previously approved use permit for this
project.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town ofTiburon
does hereby approve the application to modify the conditions of approval set forth in Town
Council Resolution No. 3463 as follows:

The subject permit shall be reviewed by the Planning Commission at a public
hearing six (6) months after completion of the gymnasium. Additional reviews
shall occur once every six (6) months for the next year thereafter, and annually
after the first 18 months. During these reviews, or as part of subsequent
conditional use permit applications, the Planning Commission shall have the
authority to modify the restrictions of this permit to further restrict the uses on the
site, including, but not limited to, the potential to prohibit CYO use of the
gynmasium on weekends and/or weekday evenings; or have the ability to relax the
restrictions contained within this resolution if the Commission determines that
such modifications would be consistent with the spirit and intent of this resolution
and would not result in additional impacts on the surrounding neighborhood. The
Town reserves the right to amend or revoke this Conditional Use Permit for cause,
in accordance with adopted regulations of the Town.

II. A school representative shall be posted for the primary purpose of controlling
vehicular speed at the comer of Rock Hill Drive and Hilary Drive on all school
days from 7:30 a.m. to 8:10 a.m.
21. Th~~ CYO use of the gymnasium shall be limited to September through March of
each year. Hours ofCYO use shall be limited to 8:00 a.m. to 7:30 p.m. on
Mondays, Wednesdays and Fridays; 8:00 a.m. to 7:30 p.m. on Tuesdays and
Thursdays; and 9:00 a.m. to 5:00 p.m. on Saturdays. CYO uses shall be
prohibited on air Sundays.
