RESOLUTION NO. 04-2006
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON
CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT (FEIR)
FOR THE LING RESIDENTIAL DEVELOPMENT (PO #24)
ASSESSOR PARCEL NO. 055-261-10
WHEREAS, the Town Council of the Town of Tiburon does resolve as follows:
Section 1. Findinas.
WHEREAS, a Draft Environmental Impact Report (DEIR) evaluating the
proposed Ling Residential Development (Precise Development Plan) has been
prepared and was transmitted by the Town of Tiburon to all concerned parties for
review and comment; and
WHEREAS, notice of the availability of the DEIR was given as required by law;
and
WHEREAS, written comments on the DEIR were accepted from the public from
April 8, 2005 to May 23, 2005; and

WHEREAS, the Planning Commission held a public hearing and accepted
testimony on the DEIR on May 11, 2005; and
WHEREAS, on June 8, 2005, the Planning Commission directed that responses
to comments and a Final Environmental Impact Report (FEIR) be prepared; and
WHEREAS, agency and public comments have been responded to in the FEIR;
and
WHEREAS, on December 8, 2005, the Planning Commission held a public
hearing and received testimony on the Ling FEIR, and adopted Resolution No. 2005-19
recommending to the Town Council that the FEIR be certified; and
WHEREAS, the FEIR was prepared in accordance with the provisions of the
California Environmental Quality Act and the Town's local CEQA Guidelines; and
WHEREAS, the Town Council held a publicly noticed public hearing on the FEIR
on January 4, 2006, and heard and considered the FEIR and received public testimony;

WHEREAS, the FEIR identified certain potentially significant adverse effects on
the environment caused by the project.
NOW, THEREFORE, BE IT RESOLVED, that the Ling Final Environmental
Impact Report:
1. Consists of:
a. Ling Draft Environmental Impact Report, dated April 2005; and
b. Ling Final Environmental Impact Report, dated November 2005.
2. Is hereby certified by the Town Council to have been completed in
compliance with the California Environmental Quality Act and local CEQA
guidelines.
3. Has been presented to the Town Council of the Town of Tiburon, which
has reviewed and considered the information contained in the Final EIR.
4. Reflects the independent judgment and analysis of the Town Council.
5.
Is hereby adopted as the Environmental Impact Report for the Ling
Residential Development.

of Tiburon on January 4, 2006, by the following vote:
