RESOLUTION NO. 34-2001
A RESOLUTION OF THE COUNCIL OF THE TOWN OF TIBURON
ORDERING CHANGES AND MODIFICATIONS
TOWN OF TIBURON
Stewart Drive Underaroundina Assessment District
RESOLVED by the Town Council (the "Council") of the Town of Tiburon (the "Town"),
County of Marin, State of California, that
WHEREAS, on March 21, 2001 this Council adopted Resolution No.14-2001, A
Resolution of Intention to Make Acquisitions and Improvements in its proceedings (the
"Proceedings") for the Town's Stewart Drive Undergrounding Assessment District (the
"Assessment District");
WHEREAS, in the Proceedings under and pursuant to such Resolution an assessment
was confirmed and levied by Resolution No. 26-2001, adopted on May 9, 2001
WHEREAS, the owners of the assessment parcels hereinafter referred to by assessor's
parcel numbers have duly filed written requests for making of all of the changes and
modifications hereinafter ordered which pertain to and/or effect such parcels, respectively;
WHEREAS, except with respect to changes and modifications pursuant to the aforesaid
written requests, the changes and modifications hereinafter ordered will not increase the total
amount of the assessment. or the amount of any individual assessment nor eliminate or add
any acquisitions or work which will substantially and adversely alter or affect the benefits to be
derived from the work and acquisitions;
WHEREAS, the public interest, convenience and necessity require the changes and
modifications hereinafter ordered; and
WHEREAS, the Engineer of work has filed with the Town Clerk proposed revisions to
the Engineer's Report as finally approved by this Council, to wit: revisions in the assessments
based on such written requests of the owners of the affected parcels.
NOW, THEREFORE, IT IS ORDERED that:
1. The foregoing recitals are true and correct.
2. Changes and modifications be made in individual assessments as set forth in .
Exhibit "A" attached hereto and made a part hereof.
3. The Town Clerk shall forward certified copies of this resolution to the Town
official who is the Superintendent of Streets and to the Finance Director as authority to make
the changes and modifications on the face of the assessment roll and any corrections on the
face of the List of Unpaid Assessments.

Tiburon, State of California, on this 20th day of June, 2001, by the following vote to wit:
