RESOLUTION NO. 18-2001

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON
DENYING AN APPEAL BY JOHN MEDRICKY AND STEVE BENDINELLI
OF THE APPRO V AL OF SITE PLAN AND ARClllTECTURAL REVIEW
FOR PROPERTY LOCATED AT 757 HAWTHORNE DRIVE
WHEREAS, on February 1, 2001, the Design Review Board held a public hearing to
consider the approval of a Site Plan and Architectural Review application for construction of a
new single-family dwelling on property located at 757 Hawthorne Drive, proposed by Gustavo
and Dee Ann Ezcurra; and
WHEREAS, after receiving public testimony, including concerns raised by neighboring
property owners regarding potential visual and view impacts which could be caused by the
proposed addition, the Board determined that the proposed construction would have not have a
significant impact on the views from the nearby homes at 735 and 740 Hilary Drive, would not
create mass and bulk that would result in significant visual impacts for the home at 740 Hilary
Drive, and would be compatible with the character of the surrounding neighborhood; and
WHEREAS, the Design Review Board found that the proposed project was consistent
with the guidelines for Site Plan and Architectural Review applications, and consistent with the
~ Tiburon Hillside Design Guidelines, and approved (by a vote of 4-1) the Site Plan and
Architectural Review application for this property; and
WHEREAS, on February 12, 2001, John Medricky and Steve Bendinelli, ("Appellants"),
owner of the nearby properties at 740 and 735 Hilary Drive, respectively, filed an appeal of the
Board's decision to approve this application; and
WHEREAS, on March 21,2001, the Town Council of the Town of Tiburon held a duly-
noticed public hearing on the appeal; during which public testimony was heard regarding the
extent of the proposed construction and the potential impacts which could be caused by the
proposed project; and
WHEREAS, after hearing all testimony and reviewing all documents in the record, the
Town Council found that: 1) the amount of the view from the ceremonial rooms of the house at
735 Hilary Drive which would be blocked by the proposed construction would be minimal, and is
currently partially blocked by existing trees; 2) the proposed construction would not result in
mass and bulk that would create a significant visual impact for the house at 740 Hilary Drive; 3)
the proposed construction would be consistent with the character of the surrounding
neighborhood; and 4) the Design Review Board correctly applied the guidelines for Site Plan and
Architectural Review applications and the Tiburon Hillside Design Guidelines in reviewing and
approving this request; and

WHEREAS, based on the above findings, the Council determined to deny the appeal by
the Appellants and uphold the Design Review Board's approval of the project (a vote 00-2).
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon memorializes that the appeal of John Medricky and Steve Bendinelli was denied on
March 21,2001, as set forth in this resolution.
PASSED AND ADOPTED at a regular meeting of the Town Council on April 4, 2001, by
the following vote:
