RESOLUTION NO. 16-2001
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON
APPROVING PLANS AND SPECIFICATIONS AND DIRECTING ACTIONS WITH RESPECT
THERETO
TOWN OF TIBURON
Stewart Drive Underaroundina Assessment Town
RESOLVED, by the Town Council (the "Council") of the Town of Tiburon (the "Town"),
County of Marin (the "County"), State of California, as follows:
1. Resolution of Intention. On, this Council adopted its Resolution of ~ntention to
Make Acquisitions and Improvements, (the "Resolution of Intention") under the Municipal
Improvement Act of 1913, Division 12 of the Streets and Highways Code of California, (the
"Act") to initiate proceedings under the Act in and for the Town's Stewart Drive Undergrounding
Assessment Town (the "Assessment Town").
2. Plans and Specifications. The Resolution of Intention referred the acquisitions
and improvements described therein to the person designated therein as the Engineer of Work
and directed such Engineer of Work to prepare and file with the Town Clerk plans and
specifications (the "Plans and Specifications") for the purpose of obtaining public bids for such
acquisitions and improvements pursuant to the Act and to which reference is hereby made for
further particulars.

3. Plans and Specifications Approved. This Council, with the aid of Town staff
and consultants, has reviewed the Plans and Specifications and hereby finds them to be
sufficient for, and that it shall stand for purposes of subsequent proceedings for the
Assessment District and the Plans and Specifications are hereby approved for the purposes of
obtaining public bids under the applicable provisions of the Public Contact Code (the "Code").
4. Public Bids. This Council hereby orders that sealed bids or proposals will be
received by the Town for the acquisitions and improvements specified in the Plans and
Specifications at the office of the Town Clerk, 1501 Tiburon Boulevard, Tiburon, CA 94920, on
April 26, 2001, at the hour of 10:00 o'clock a.m., at which place and hour the bids will be
publicly opened, examined and declared. Such bids will be referred for the purposes of this
Council's determination of the lowest responsible bidder at the meeting of the Council on June
13,2001.
5. Notice. The Town Clerk is hereby authorized and directed to cause notice
inviting sealed bids ordered under Section 4 hereof to be given by publication in a newspaper
of general circulation within the Town of Tiburon, twice, with the first publication to occur not
less than fourteen (14) days before the date specified herein for receipt for bids and the
second at least five (5) days after the first. The Clerk shall also cause notice of inviting sealed
bids to be posted in three public places within the Town, which posting shall occur not less
than fourteen (14) days before the date specified for bids. Such notices shall specify the date,
hour and place for receipt for bids and refer to copies of the Plans and Specifications on file in
the office of the Clerk (and in such other places, including, but not limited to, local builders'

6. Deposit. Each bid shall be accompanied by cash, a cashier's or certified check
or such other surety, securities or undertaking as permitted by the Code in the amount of at
least 10% of the amount of the bid. The amount of such deposit of the successful bidder shall
be forfeited to the Town if, within 15 days of the date of notice of award by the Town to such
bidder, the bidder does not enter into the contract for the acquisitions and improvements.
7. Labor Code. Under Section 1773 of the Labor Code of California, the Town
has obtained and will maintain posted at the job site(s) the general prevailing rate of per-diem
wages and the general prevailing wage rates for holidays and overtime work for each craft,
classification or type of worker required for the contract.
8. Liquidated Damages. The Town hereby establishes as liquidated damages
those specified in the Plans and Specifications payable in the amounts and upon the times
specified in the Plans and Specifications and to which reference is hereby made for further
particulars.
9. Effective. This resolution shall be effective upon its adoption by the Council.
PASSED AND ADOPTED at the regular meeting of the Town Council of the Town of
Tiburon, State of California, on this 21st day of March, 2001, by the following vote to wit:
