Deed Restriction and Covenant

This Deed Restriction made this:2 day of I/fVVJ<.-..- , 2004, by David
Williams and Dana Baker-Williams," wner" of the property located at 50 Monterey Drive,
Tiburon; a legal description of which is attached as Exhibit A.
The Town of Tiburon, a municipal corporation ("Town") has approved Owner's development
proposal subject to certain conditions of approval imposed by Town to mitigate the impacts of
said project and insure its compliance with Town law. Owners have accepted such
conditions, which include, among other things, the execution of this Deed Restriction and
Covenant. Owner hereby covenants and agrees for the benefit of the Town, and in
accordance with Town Council Resolution #12-2004, a copy of which is on file at the Town of
Tiburon Town Hall, as follows:
Owner agrees that no bathroom, bedroom, or kitchen will be installed in the area
referred to as a "play room" on the plans received by the Town of Tiburon on February
24, 2004, and approved by the Tiburon Town Council on April 7, 2004, said "play room"
area being shown on attached Exhibit B.
This covenant and deed restriction shall inure to the Town of Tiburon and shall be binding
and enforceable against all heirs, successors, transferees, purchasers and assigns of the
Owner. The Town may enforce this covenant and deed restriction by any means authorized
by state and local law, including, without limitation, administrative citation and abatement
under Chapter 31 of the Tiburon Municipal Code or any successor ordinances. This
covenant and deed restriction may be modified or lifted only with the express written approval
of the Town of Tiburon by resolution of the Town Council. This covenant and deed restriction
shall not prohibit future rights to request approval of the Town of Tiburon for unrelated
development of the subject property.
