Dear Mayor Smith and Town Council Members,
The purpose of this letter-which is supplemental to matters raised in our
appeal filed on June 6, 2006, and to other documents and testimony on record - is to
apprise you of certain legal claims arising from the action of the Tiburon Planning
Commission in denying the use permit application (CUP) of Congregation Kol
Shofar (CKS) to remodel and expand its synagogue at 215 Blackfield Rd., Tiburon.
Specifically, we assert that decision violates the right to religious exercise accorded to
members of the congregation and to the congregation as a whole, rights protected by
the United States and California constitutions, and specifically protected under the
Religious Land Use and Institutionalized Persons Act of 2000 (RLUlP A).l
Below, we analyze the liability of the Town that attends such violations, and
provide this to you in advance of your consideration of the appeal of this decision,
now scheduled for your meeting of September 19, 2006, We do so in the hope that
you will take appropriate notice of the serious nature of this matter, seek the advice
of the Town Attorney, and then act to rectify the legal and constitutional violations
arising from the Planning Commission action by reversing that decision after you
hear our appeal.
Should the Town Council fail to reverse the determination of the Planning
Commission-or, if in doing so, should it attempt to impose additional burdensome
conditions upon this project that interfere unreasonably with the Congregation's
constitutional rights to practice their faith and to do so in facilities that are necessary

to reasonably accommodate their expression of faith - our clients are committed to
pursuing their legal rights and remedies under state and federal law, including
damages and an award of attorney fees, expert fees, and other litigation expenses to
which they will be entitled under RLUIP A and 42 U.s.c. section 1988.
I. Background
CKS has approximately 600 congregants and has occupied a former public
school site in Tiburon for two decades, pursuant to a CUP issued by the Town. That
CUP permits the current uses at the site, and by definition the religious use of this
site has been found compatible with the residential neighborhood and with the
general welfare of the Town.2 The Town has annually renewed the CUP since 1985
with only minor modifications, and the use of the site by CKS has never been limited
in terms of the number of participants or the hours of operation. The approved uses
include an on-site day school and the CUP sets forth a cap on the current number of
students.
Just over two years ago, CKS submitted a proposal to the Town to refurbish
and expand its existing temple facilities. CKS determined that these are insufficient
to support fulfillment of its religious mission in terms of both size and configuration
of the buildings, and also due to their aged condition and need for substantial repair
and remodeling. A CUP application was submitted requesting approval of
improvements to the temple sanctuary, the addition of 4 new classrooms and a
multi-purpose building to enhance on-going religious and related educational
activities, as well as associated landscaping and parking improvements. Over all, the
project proposed an addition of 6,298 sq. feet of net usable space (from 29,310 NSF to
35,608 NSF), and an increase in gross building area of 7,893 sq. feet (from 43,752 GSF
to 51,644 GSF).
From the outset of this recent effort to address the needs of its own
congregation, CKS has understood the importance of being a good neighbor-it is,
quite literally, a religious tenet of the Jewish faith to be so. Accordingly, CKS has

demonstrated a high degree of sensitivity to the needs and concerns of residents in
the neighborhood. Most notably, CKS has proposed, of its own initiative, voluntary
limits on the use of the multi-purpose building for weekend activities, and has
responded to more recent expressions of concern by further limiting the number of
permitted events.
Specifically, the original application anticipated 35-40 events per year on
Saturday, with up to 300 attendees and a closing time of 11:30 p.m. CKS voluntarily
offered to limit these events to 27 times per year, capping the number of attendees at
275. More recently, CKS has come forward to suggest even further reductions,
limiting these events as follows: 4 events @ 250 attendees, 4 @ 200, and 4 @ 150, all
with closing times of 11:00 p.m. These voluntary measures will reduce the total
number of Saturday events to 12, require an earlier closing time of 11:00 p.m., and
limit attendees on an annual basis from as many as 12,000 to no more than 2,400, a
reduction of 80 percent.
Likewise, CKS offered to limit the number of attendees at Sunday events. The
original application estimated there would be 25-30 events with up to 300 attendees,
and ending by 10:00 p.m.; CKS subsequently offered to limit such events to 20 times
per year. More recently, CKS came forward with a proposal to move up the closing
time to 9:00 p.m. on Sundays, and to reduce the number of these events as follows: 3
@ 250 attendees,S @ 200, 4 @ 150, and 3 @ 100. These voluntary limits will reduce the
annual number of attendees on Sunday from up to 9,000 to no more than 2,650, a
reduction of 70 percent.
These very substantial reductions were made even though the existing CUP
imposes no such limits, and notwithstanding that the Town has not previously
imposed like restrictions on similarly situated facilities such as St. Hilary's Catholic
Church, which recently applied for and received approval for a significant expansion
to their facilities. As such, they are unquestionably a concrete measure of the concern
and sensitivity CKS has brought to the task of re-building its facilities.
After receiving the CKS application, the Town required a full environmental
impact report (EIR) to be prepared in connection with the CUP application-which
CKS agreed to despite, again, that an EIR has not been required of similar projects,

like St. Hilary's, which was approved based on a Negative Declaration. In addition
to the EIR they were required to fund, CKS submitted a multitude of its own studies
in connection with the CUP application at considerable cost, studying every
conceivable issue related to the application.
At all times, CKS has worked cooperatively with the Town and with its
neighbors to address legitimate concerns, and has continued to voluntarily
incorporate refinements to its proposal to respond to their concerns. The
crystallization of this effort is found in the so-called" Alternative 7" proposal in the
EIR, and it was this configuration that was rejected by the Planning Commission
after three hearings in April and May of this year, and in response to vocal
opposition from a faction of neighboring property owners who expressed essentially
unsupported fears about increased noise, traffic. and parking issues.
The appeal in this matter filed by CKS on June 6, 2006 asserts that the decision
of the Planning Commission is an abuse of discretion in that the evidence in the
record does not support the findings and the findings do not support the decision.
The appeal further asserts that denial of the CUP substantially burdens the ability of
CKS to carry out its religious mission in violation of the rights of its congregation to
exercise their religion. It is this latter claim that is the focus of the present analysis.
II. Liability Under RLUIP A
A. General Rule
RLUIPA applies to limit the Town, in the course of undertaking an
"individualized assessment" of proposed uses for the CKS property, from imposing a
"substantial burden" on the" religious exercise" of the congregation and its members,
unless doing so is "in furtherance of a compelling governmental interest," and is "the
least restrictive means" of furthering that interest. RLUIP A further prohibits any
discrimination on the basis of religion, including - importantly for the present
appeal- unequal treatment among religious, or between religious and non-religious,
"assemblies or institutions." Like other federal civil rights statutes, RLUIP A
authorizes an award of attorney fees and other costs to religious claimants who
achieve some measure of relief in litigation against a government agency, and

authorizes the federal government to intervene in RLUIP A cases or bring a separate
enforcement action. Finally, RLUIP A provides express authority to local zoning
authorities to grant exceptions or to modify their regulations or procedures in order
to alleviate a substantial burden on religious exercise.
At the heart of RLUIPA is the recognition that true religious liberty implies a
suitable physical location for its exercise.3 As one court has stated, "Congress's
decision to enact RLUIP A necessarily recognizes the fact that religious assembly
buildings are needed to facilitate religious practice, and the possibility that local
governments may use zoning regulations to prevent religious groups from using
land for such purposes."4 The objections-from vocal and well-financed neighbors-
to the effort by CKS to improve its severely inadequate facilities are emblematic of
the problem RLUIP A seeks to remedy, and an all-too-familiar fact-pattern found in
litigation under this statue.s
B. Jurisdictional Prerequisite: Individualized Assessments
The protections of religious liberty found in RLUIP A apply where "the
substantial burden is imposed in the implementation of a land use regulation or
system of land use regulations, under which a government makes, or has in place
formal or informal procedures or practices that permit the government to make,
individualized assessments of the proposed uses for the property involved."6 While
there was initial uncertainty concerning the scope of the term, the United States
Court of Appeals for the Ninth Circuit has now made unambiguously clear that the

Town's decision on this conditional use permit application is an individualized
assessment that triggers RLUIP A jurisdiction?
C. Religious Exercise
RLUIP A applies to protect religious exercise. RLUIP A, by its own terms, is to
be "construed in favor of a broad protection of religious exercise, to the maximum
extent permitted by the terms of th[e] Act and the Constitution,"s and the statute
extends this definition to include "any exercise of religion, whether or not compelled
by, or central to, a system of religious belief," including "[t]he use, building, or
conversion of real property for the purpose of religious exercise,"9 Under this
broadest of definitions, there can be little doubt that the renovations and additions
proposed by CKS fall well within the statute's purview.
Every aspect of the proposed project is designed to facilitate the religious
mission of CKS, which is to provide broadly for the spiritual and human needs of its
congregation and its community. Specifically, the improvements will enhance the
ability of CKS members to practice their faith, either by housing traditional worship
activities or ancillary uses which themselves are inseparable from the religious life of
the congregation.
As to the latter, the proposed classrooms and other facilities supporting the
day school are unquestionably religious exercise. As the courts have noted, the
imperative of such education is scripturally based.10 Likewise, the courts have held
that multipurpose rooms-such as that proposed by CKS-are also protected forms
of religious exercise under RLUIP A, even when they are sometimes used for arguably
secular activities. As the court in Westchester Day School concluded, "Where a
building is to be used for the purpose of 'religious exercise,' the building is not
denied protection under RLUIP A merely because it includes certain facilities that are
not at all times themselves devoted to, but are inextricably integrated with and

reasonably necessary to facilitate, such 'religious exercise.'''l1 The court in Mintz v.
Roman Catholic Bishop came to the same conclusion when it ruled that the addition of
a parish hall to the grounds of an existing church was religious exercise under
RLUlPA.12
D. Substantial Burden
RLUIP A applies where a governmental zoning decision imposes a substantial
burden on the religious exercise of a religious individual or group,13 This
constitutional test has been stated variously by the courts, but in the RLUIP A context
the Ninth Circuit, in Guru Nanak, has now adopted the "more lenient" version;
accordingly, a decision of a local zoning agency constitutes a substantial burden where
it imposes" a significantly great restriction or onus upon" religious exercise.14 We
respectfully submit that the decision of the Planning Commission in denying the
application of CKS in this matter amounts to just such an injury to the religious
liberty interests of CKS.
In Guru Nanak, the Ninth Circuit held that the county's denial of a CUP
imposed a substantial burden on a Sikh congregation seeking to build a temple on
land it had acquired in an agricultural area. The immediate reasons cited by the
court for its conclusion were that, because the applicant had "readily agreed to every
mitigation measure suggested" by the county's planning staff, and because the
purported reasons for ignoring staff's support for the project and denying the CUP
could" easily apply to all future applications," it was likely that the same
considerations might prevent the applicant from ever obtaining a CUP approval.1S
Likewise, the obsequious response of the Tiburon Planning Commission to the
speculative fears expressed by a few vocal neighbors concerning wholly insubstantial
traffic and noise impacts, must lead to the same conclusion: any applicant held to
such whimsical standards as favored here by the Planning Commission is unlikely to

From the above, it is clear that the contention by neighbors of CKS-made in
the course of hearings before the Planning Commission - that CKS should simply
move to another location or to another town entirely, is wholly inappropriate and it
is exactly the type of reaction Congress had in mind when it enacted RLUIP A.
Finally, in this context, we note that the courts have repeatedly found that a
substantial burden is imposed where a religious land use applicant has been denied
the ability to modify and expand existing facilities to meet the existing or anticipated
needs of its congregation.20 Given the extensive (and very expensive) good-faith
efforts of CKS to comply with all applicable laws and ordinances of the Town and to
modify the proposal in order to mitigate all potentially significant impacts of the
project, the denial of the application in response to neighborhood pressure
substantially burdens its religious exercise, and flies in the face of virtually uniform
court precedent.
E. Compelling Governmental Interest and Least Restrictive Means
The Town still might avoid RLUIP A liability and an attorney fees award if the
substantial burden it has imposed on CKS is justified by a compelling governmental
interest, and that interest is implemented in the least restrictive means available.21 This
standard is known in constitutional law as "strict scrutiny," and as the u.s. Supreme
Court has noted, this "is the most demanding test known to constitutional law. "22 So
demanding, in fact, that cities' undeniable interest in addressing traffic problems has
never been held to be "compelling."23 This must be all the more true for the parking,
incidental noise, and aesthetic concerns typically associated with neighborhood
development of the type proposed in this instance. In any case-and even when the
courts are willing to assume, for the sake of argument only, the existence of a

ever obtain a CUP. Furthermore, several courts have warned that even the prospect
of having to go through the process all over again may itselfbe a substantial burden
on religious exercise.16 Accordingly, the denial of this application to renovate and
expand its facilities constitutes a substantial burden on the religious exercise of CKS.
The court in Mintz v. Roman Catholic Bishop likewise concluded that the denial
of a permit to build a parish hall would impose a substantial burden, finding that" the
parish center would serve as a meeting place for the parish council, would include an
office for religious education, could facilitate gatherings related to church services
and would, in the process, alleviate crowding in the rectory."17 Preventing the
church from addressing these needs, the court pointed out, imposed a substantial
burden notwithstanding that the church had been" flourishing for ninety years."18 In
doing so, the court emphasized the obvious fact that religious congregations must be
expected to grow and to change over time:
[RLUIP A] certainly does not contemplate that a church's religious
exercise can be frozen in place. Thus, what might have been adequate
ninety years ago may not necessarily be adequate today. As time
passes, the religious needs of an institution can grow so large that the
impinging nature of zoning laws may become much more burdensome.
Similarly, the construction of the parish center at another location, as
Plaintiffs suggest, would not avoid the bylaw's substantial burden on
religious exercise at St. Ann's present location. See Saints Constantine
& Helen Greek Orthodox Church, Inc. v. City of New Berlin, 396 F.3d
895, 901 (7th Cir.2005) (holding that city had created a substantial
burden by requiring church to "search[ ] around for other parcels of
land" rather than rezoning property church already owned).19

compelling interest-they inevitably find that the government has failed to use the
least restrictive means to effectuate that interest.24
A perfect example of the potential to violate this standard is the Town's
attempt to impose a disproportionate and overly burdensome mitigation with regard
to the Tiburon Boulevard/Blackfield Drive intersection. Despite that some traffic
modeling shows the left-turn lane at this intersection will not back up, the Town still
insists on labeling this a significant impact when, at worst, there is merely some
potential that a few times a year events at Kol Shofar might result in a back up. Yet,
the Town seeks to require Kol Shofar to fund 100% of the cost of permanent
improvements - an arbitrary response well beyond any concept of a fair share.
Notably, the suggested alternative is to completely eliminate Saturday events. Both
of these purported solutions completely ignore any concept of least restrictive means
required by RLUIPA.
F. Disparate Treatment
The courts have been very quick to overturn the decisions of local authorities
where they find that a religious claimant has been treated differently and less well
then similar religious or secular property owners. In stark contrast to the treatment
of CKS, St. Hilary's Catholic Church was granted a CUP by the Town for even more
significant construction in a residential neighborhood than is here proposed, and this
was done on the basis of a Negative Declaration-not the full-scale and costly EIR
required of CKS. We will not belabor the factual similarities between that project
and the present one here; suffice it to say that this is precisely the sort of disparate
treatment that has provoked federal courts across the country to denounce local
zoning boards and order development permits issued outright to religious claimants,
and which in no small part led to passage of RLUIP A in the first instance.
The Ninth Circuit's recent decision in Guru Nanak is typical, in this regard.
While the county strenuously argued that the location of the proposed Sikh temple in
an agricultural zone was inappropriate and violated a general plan policy

discouraging development outside existing development areas, the court dismissed
this argument because other churches were already located in agricultural zones-
including another Sikh temple just a mile away.25 The court also noted, wryly, the
suggestion of one county supervisor that the temple should try to locate closer to his
own church and to other existing churches. Similarly, the court in Hollywood
Community Synagogue v. City of Hollywood pointed out with obvious concern that the
"City of Hollywood had never previously imposed a time limit on a special
exception for a religious use and had only once before imposed a time limit on a
special exception for a non-religious use."26
The contrast between the recent approval of new facilities for St. Hilary's
Catholic Church - a large mainstream congregation - and this small Conservative
Jewish congregation, could not be greater. This and other examples of the unusual
and disturbing scrutiny applied by the Town to the CKS application will certainly be
at the forefront of any resulting litigation.
G. Authority to Grant Exceptions
RLUIP A contains the following grant of authority, which broadly permits the
Town Council to act on the appeal before it to avoid liability:
A government may avoid the preemptive force of any provision of this
chapter by changing the policy or practice that results in a substantial
burden on religious exercise, by retaining the policy or practice and
exempting the substantially burdened religious exercise, by providing
exemptions from the policy or practice for applications that
substantially burden religious exercise, or by any other means that
eliminates the substantial burden.27
This provision fully empowers the Town Council to take whatever actions are
necessary to remove the substantial burden on religious exercise resulting from the
decision of the Planning Commission. Thus, there can be no argument that the Town

is somehow prevented from upholding this appeal, on account of rules, policies or
practices governing its regulation of land use.
This aspect of RLUIP A is well-illustrated in Mintz v. Roman Catholic Bishop,
where the court held that the town's decision to issue a building permit - without
requiring the applicant to obtain a variance permit-was lawful under RLUIPA as it
was done to alleviate the substantial burden on the church's religious exercise.28
Likewise, if litigation ensues in connection with the present appeal, RLUIP A
authorizes a judge to "fashion any appropriate remedy," and may order the
unconditional issuance of all necessary permits without further environmental
review.29
H. Westchester Day School Litigation
For a preview of what lies ahead should the Town uphold the decision of the
Planning Commission or otherwise substantially burden the religious exercise of
CKS, we urge the Town Council (and the Town Attorney) to review the decision of
Judge Connor of the Federal District Court, Southern District, New York, in
Westchester Day School v. Village of Mamaroneck. After a seven-day trial, he issued a
96-page ruling setting forth in exhaustive detail factual findings and rulings of law
overturning the denial of the application of this Orthodox Jewish day school to
renovate and enlarge its existing facilities. By themselves, the court's recitation of the
village zoning board's erroneous traffic conclusions required 15 pages.
The applicant in that case was Westchester Day School (WDS), an Orthodox
Jewish day school located on the same property as a synagogue and a private Jewish
high school, though each constituted legally separate entities. The property was also
used in the spring for little league softball games, and hosted community picnics for
the police department, the local firehouse, the neighborhood residents association,
and for other community and civic organizations. WDS sought to renovate certain
existing buildings it occupied, and to construct a new 44,000 square foot building
with 25 classrooms and a multi-purpose room. The village planning department
issued a Negative Declaration for the project, under the New York-equivalent of

CEQA, after imposing conditions it determined would reduce any potentially
significant impacts to a level of insignificance.
In hearings before the villages zoning board, a smaIl but vociferous group of
nearby property owners-led by the ex-chairman of the zoning board, who had
served together with some of the current board members-rose to oppose the project
and formed an organization called Save Orienta's Unique Neighborhood, or
"SOUND." The neighbors filed a lawsuit to overturn the Negative Declaration, and
the zoning board responded by attempting to rescind that document and require
instead preparation of a full environmental impact study. However, that decision
was quickly overturned by the court, which found the board's action was taken "not
because of any new information relating to any significant adverse environmental
impact of the Project, but in response to the belated public outcry led by [the former
board chair and the other neighbor opposition leader]."30 These same individuals
continued their attacks in later hearings, one even questioning whether WDS had
been" a good neighbor," complaining that the school had been slow to remove a tree
that had fallen on his Jaguar.31
Notwithstanding the limited and self-serving nature of these property owners'
complaints, WDS offered a number of project modifications in response, including
voluntary limits on enrollment. WDS supplied numerous studies and analyses from
respected experts to respond to the concerns and questions of the residents and the
village officials, and worked collaboratively to clarify and then respond to the needs
of the community. Throughout, the village staff continued to support the project,
concluding that the applicant had made every effort to respond to concerns about
potential impacts of the project.
Despite these efforts - made over the course of the one and a half years this
application was pending-the zoning board eventually voted to deny the
application. The board cited traffic, parking, and intensity of use concerns, and the
"overall physical size of the structure, its location on campus and the effect it would
have on the surrounding neighbors."32 In doing so, it passed over its own

professional planning staff to formulate findings to deny the project, and cajoled its
own traffic consultants to provide supporting analysis that contradicted their earlier
analysis.
As to concern about the size of the proposed 44,000 sq. foot structure, the
court tellingly concluded: "There is no evidence in the public record to suggest
that the size of the building, in and of itself, poses any threat to public health,
safety or welfare."33 The court went on to quote at length and disapprovingly
testimony of the zoning board member who drafted the findings, and was most
concerned about building size:
[Zoning Board member] Gabriele testified that the size of the building
troubled him in that he did not understand why a building that size
was necessary: "[I expressed concern] only in the spirit of
understanding why such a large building was required by the school in
terms of why 44,000 square feet, why not 10,000 square feet, why not
60,000 square feet. Trying to understand why a building of this type
was designed."
The court quickly dismissed this speculative and illogical concern about the size of
the building, and concluded that the proposed size was entirely justified "based on a
comprehensive analysis of WDS's needs."34 Likewise, in the appeal before you, CKS
has justified its need for the improvements in question, and there is no evidence in
the record before you that the size of the improvements themselves violate any
provision of the applicable zoning regulations, will result in any unmitigated
environmental impacts, or pose any threat to the health, safety, or welfare of the
neighborhood. Any concern about size is thus unsubstantiated and disconnected
from any actual impacts of the project, i.e., "speculative and illogical."
Judge Connor, in rejecting, each and every proffered basis for denial argued
by the village in defense of the zoning board decision, made repeated references to
the "intense and unrelenting pressure from politically well-connected neighboring

residents, including a recent ex-chairman of the [zoning board]."35 While conceding
that any new building on the property "would necessarily have some adverse impact
on the surrounding community," - noting, for example, that headlights would shine
into the homes of one neighbor, and the buildings would be visible from four
homes-the court nonetheless concluded that "WDS's pressing need against the
relatively minor adverse environmental impacts in this case compels the only
reasonable conclusion: that the [zoning board's] denial of WDS's Application for a
special permit was so contrary to the evidence and to the equities as to be arbitrary
and capricious."36
In a final note about the equities of the case, Judge Connor made an
observation that we believe applies with equal force to the religious and religious-
educational nature of the CKS project on appeal before you:
Like other religious schools, WDS performs an extremely valuable
public service, not only educating many children who would otherwise
have to be educated at public expense, but also instilling in them
principles of morality and ethics that will make them better members of
society. For these reasons religious schools are favored property uses
and zoning boards are adjured to weigh their needs heavily against
environmental concerns. In this case, it appears that the [zoning
board] did just the opposite.37
Anticipating a subsequent appeal of his decision-a reasonable assumption
given the long history of litigation and appeals - the judge in his final order delayed
his ruling on the attorney fees requested by WDS. There can be little doubt,
however, what he will do when the matter come before him again on a motion for
attorney and expert fees, along with trial costs and related expenses. In the
meantime, however, the judge ordered the village to issue the necessary permits
without further delay or imposition of additional conditions of approval, and on
the basis of the original Negative Declaration.

In sum, we believe that the position of CKS in this appeal is virtually
indistinguishable from the plaintiff in Westchester Day School. We urge the Town to
heed the plain warnings of this and other cases cited herein, and act now to rectify
the unlawful, unwarranted, and harmful action of the Planning Commission.
III. Prior Restraint on Religious Expression
The final First Amendment contention of CKS we set forth here, is that the
standards for decision on this CUP application as set forth in the Town's Zoning
Ordinance - along with the additional standards fashioned ad hoc and applied by the
Planning Commission in denying the application - unlawfully permit the exercise of
"unbridled discretion" by the Town and thus constitute a prior restraint on religious
expression in violation of the First and Fourteenth Amendments of the United States
Constitution. The Town's zoning ordinance is arguably facially unconstitutional in
this regard, and the denial of the CUP, or the imposition of unduly burdensome
conditions of approval, likewise constitutes a violation as applied of the core First
Amendment concern to protect religious expression.
The Supreme Court has held that government permitting agencies must
employ only "narrow, objective, and definite standards" where it imposes a prior
restraint on protected First Amendment expression,38 and have rejected the typically
broad formulations of the public welfare found in most zoning codes and general
plans, such as Tiburon's.39 While the courts have readily given credence to cities'

"substantial interest in preserving the quality of urban life in its neighborhoods,"
they have also insisted that cities act to protect religious liberty interests:
[Local zoning officials are] charged with the protection of the religious
freedoms that are found in the First Amendment and that form the
cornerstone of American democracy. Zoning regulations that affect
those freedoms must therefore be precise and objective in both their
terms and their application. Our Constitution and our love of liberty
demand no less.4O
Accordingly, CKS objects to the Planning Commission's overly broad and
standardless application of the Town's zoning and land use regulations in this
matter, and it urges the Town Council to grant the present appeal and issue
forthwith the requested CUP for this project.
IV. Conclusion
For the reasons set forth above, we ask that you grant the appeal by CKS of
the Town Planning Commission's action on the CUP application, and that you deny
both the appeal of the neighbors and that of the Greenwood Beach Homeowners
Association.

Dear Town Council Members,
As a neighbor and member of Congregation Kol Shofar, I am disappointed by the
lack of full disclosure displayed by the Temple's leadership before the Town of Tiburon.
At the hearing before the Town Planning Commission this spring, Rabbi Lavey
Derby, President Diane Zack, and Past-President Ron Brown ardently rejected
suggestions that the proposed expansion would bring more people to the synagogue. To
the contrary, they presented a picture of the congregation struggling to maintain its
membership of 600 families (which had tripled during the previous 20 years); they cited a
national study projecting no further growth oftemple membership.
However, they neglected to tell the Town Planning Commission and neighbors
about two large-scale projects that are already underway to bring more families into the
congregation and to increase attendance, especially on the weekends. Rabbi Derby and
President Zack enthusiastically described these initiatives at the Kol Shofar Annual
Meeting on June 8, less than a month after the Planning Commission rejected their
proposed expansion as inconsistent with the nature and character of the neighborhood.
Specifically, Diane Zack announced advanced plans (now at the hiring stage) to
develop a Jewish pre-school program, which national studies identified as a "gateway"
for young families to become affiliated. Additionally, Rabbi Derby detailed how
Kol Shofar will greatly expand the range of weekend activities "to bring more people to
shul." These will include play groups, music, dancing, art, classes, and lectures, all
occurring at the same time, particularly on Saturdays. He described this "Syna-plex" as a
proven national model to substantially increase participation and attendance, for which
Kol Shofar has already received a large grant.
Finally, at the Annual Meeting, the projection of 10 new families joining
Kol Shofar was announced.

As a person who values a religious/spiritual community, I appreciate the efforts
behind these projects. However, the deliberate misrepresentation to the Town Council
about Kol Shofar's true intentions is profoundly disturbing, Le., flat out saying
"membership will not increase," and that "the expansion is solely to accommodate
existing activities." This deception is particularly troubling considering how expanded
membership and utilization will negatively impact the neighborhoods that already are
compromised by existing noise, traffic, and parking problems from Kol Shofar.
In light of the these growth plans, it is clear why Kol Shofar never followed
through on the promise to Planning Commissioner John Kunzweiler, who requested a full
accounting of current and proposed activities. To honestly comply would acknowledge
their plans to expand not just the building, but membership and utilization patterns as
well.
This is not the frrst time Kol Shofar has misrepresented its plans to Tiburon.
Earlier in the year, Executive Director Mark Levy circulated a letter to neighbors stating
that the multi-purpose room expansion was "necessary for religious purposes." I have
previously addressed this to the Planning Commission; parties for Bar and Bat Mitvahs
are not religious events and can be held off site, as they have been for over 20 years.
Moreover, the practice of holding High Holiday Services in different venues or at
different times (e.g., early and late services) has been an accepted practice at Kol Shofar
and countless other conservative Jewish synagogues for many years.
In fact, Rabbi Derby responded to one commissioner's direct inquiry, stating
emphatically that High Holiday services have not taken place outside of Kol Shofar's
premises. However, my wife, three children, and I have attended High Holiday Family
and Neshama Minyan Services for several years, Wlder Rabbi Derby's leadership, at
Westminster Presbyterian Church on Tiburon Boulevard.
I am disappointed by the temple's repeated misrepresentation of the facts and its
case for expansion. There is no imperative (nor, the Rabbi now concedes, is there any
specific plan) for Kol Shofar to seat 1600 people for a single High Holiday Service. It
seems that Kol Shofar is trying to expand and build a party facility Wlder false pretenses.
According to Iris Lax, Kol Shofar's Capital Campaign Director, only
172 families have contributed toward the proposed expansion (fewer than the residents
who signed the petition for Tiburon to reject the expansion). Over 80% ofKol Shofar's
members do not live in Tiburon. Is it right for the neighbors of Kol Shofar, who vastly
oppose further intrusion on the community, to bear the burden of this deceitfully
presented project? Shouldn't the rules of honesty and full disclosure also apply to
Kol Shofar?

We are members of the Kol Shofar, who have lived in Tiburon for eight years. We love t1hs
town, and we and our three young children have had wonderful experiences at the Congregatibn
since we joined it five years ago. We are both physicians in practice here in Marin, so we ex~ct
to stay in the community for a long, long time.
We are quite distressed by the plans for the expansion ofKol Shofar. Renovation of the
classrooms and sanctuary certainly makes sense, but construction of a space for almost 900 people
is far beyond what the congregation requires for services, education and life cycle events. Even the
High Holidays are manageable with the current seating capacity, with early and late services (as
many congregations have), and use of the Presbyterian Church for the alternative and children's
services. Few Bar and Bat Mitzvah or wedding parties exceed 300 people, and other venues already
exist in Marin for those that are more. In other words, there is no real need for expansion. Clearly,

In addition to the unnecessary nature of the expansion, Tiburon must consider the signifidant

negative impact of the expansion on the neighboring community. We appreciate our five minute
walk to Kol Shofar, but are now dreading the noise that will inevitably come with the expansion.
When there are festivities at Kol Shofar, we hear clearly the music and amplified voices
from the peace of our back yard and even from inside our home when doors and windows are open
(which they are throughout much of the year).

At the current frequency of events, the noise is annoying but tolerable (listening to the birds
and enjoying the breeze is clearly preferable). Expansion of the events is a gross imposition o~ the
surrounding neighborhood. Not only will peace and quiet be disturbed (up until midnight tprty
weekends per year!), but property values will certainly be devalued as this area becomes Iless
desirable. Because of the land form of Ring Mountain, the noise will affect everyone from: the
flatlands to the hilltops. I

Many homeowners here are original owners (from the 1960's and 1970's). They and more
recently arrived neighbors will greatly resentthis intrusion and degradation of the quality oflife thllt
the Kol Shofar expansion will inevitably bring.
In summary, the renovation of Congregation Kol Shofar makes sense, but the expansion is
unnecessary and not in the best interests of the neighbors nor the Town ofTiburon. We urge You
to restrict Kol Shofar to its current activities, and to prevent construction of the multi-purpose
facility.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LARKSPUR
OPPOSING THE SONOMA MARIN RAIL TRANSIT (SMART) DISTRICT'S
MEASURE R ON THE NOVEMBER 7, 2006 BALLOT
WHEREAS, the purpose of this resolution is to document the Larkspur City
Council's position on the Sonoma Marin Rail Transit (SMARn District sales tax fund
raising Measure R on the November 7, 2006 ballot; and
WHEREAS, Larkspur City Council's position on the location of a SMART
terminus station in the Larkspur Landing area is documented in Resolution No. 37/05,
which is attached as Exhibit A, and clarifies Larkspur's General Plan policies relative to
rail service and why the Council could not support a terminal in that area; and
WHEREAS, Larkspur City Council's position on the adequacy of the draft and
final Environmental Impact Reports (EIRs) on the SMART project is documented in its
July 17, 2006 letter to SMART Executive Director Lillian Hames, which is attached as
Exhibit B, and outlines both factual inaccuracies and failures to respond to Larkspur City
Council's comments; and
WHEREAS, since 2002, Larkspur City Council has discussed SMART proposals
and options, the SMART Revised Expenditure Plan and EIRs at 17 regular and special
Council meetings, with and without SMART staff and/or representatives present, and has
sought and heard public comment on these documents; and
WHEREAS, after much deliberation and thoughtful review of the Revised
Expenditure Plan and the understood and unintended consequences, environmental and
otherwise, of the plan, the Larkspur City Council has made a determination to oppose
Measure R on.the November 7,2006 ballot for the following reasons:
1. Changed Nature of the Proiect. When the SMART project was initially
proposed, its purpose was congestion relief for the Highway 101 corridor
in Sonoma and Marin Counties. When the EIR analysis, factually flawed
and inadequately detailed as it was, failed to support congestion relief as a
product of the project, the purpose of the project was changed to provide
an alternate form of transportation. Unfortunately, the many forms of
alternate transportation to single track diesel rail were not analyzed in the
environmental review.
2. Cost of the Project. The cost estimates in the Revised Expenditure Plan of
June 2006 are insufficient to determine the viability of the project. Nor do
they identify or reflect potential local, state and/or federal funding sources
and financing (borrowing or bonding) costs. Based on the financial
information provided to date, the estimated cost of the project, both capital

and operating, appears under funded, even at the extraordinary overall cost
of$l.4 billion and the per passenger trip subsidy of approximately $48.
3. Effect on the Region's Taxing Capacity. Marin's Measure A succeeded
by focusing on key transportation improvements and programs to relieve
congestion. It has and will benefit tens of thousands of residents and
commuters every day for the next 20 years. SMART's Measure R raises
almost twice as much money over a similar period of time, and may
benefit a paltry 5,050 one-way weekday passenger trips at build out in
2025. Sonoma and Marin taxpayers deserve and want programs that will
truly support their transportation needs. Measure R does not provide
adequate benefit for the money. The Expenditure Plan and EIR did not
provide evidence of cost benefit for the region's taxpayers.
4. San Rafael to Larkspur Rail Sel!lDent. The capital and operating costs for
this short segment of railway are the most inefficient and least cost
effective in the entire proposal. At build out in 2025, only 182 people
traveling southbound are expected to use this station and just 40-55 of
these passengers are expected to transfer to the ferry.
5. Impact on Larkspur. The capital projects and programs outlined in the
Revised Expenditure Plan force a single community to deal with the
following impacts:
a. Disruption of existing retail, commercial and residential facilities and
occupants; and
b. Conflict with the City's adopted General Plan, Zoning Ordinance and
the Larkspur Landing Master Plan; and
c. Disruption of existing circulation patterns for bus, ferry and vehicular
travel; and
d. Rail station facilities inadequately conceptualized, failing to
accommodate for the loss of existing parking and the need for new
parking, drop offs and walking/cycling distances provided for only the
healthiest patrons; and
e. Visual blight for the Larkspur Landing, Greenbrae Boardwalk and
Greenbrae residential communities; and
f. Inadequately analyzed air quality and noise mitigation issues; and
g. Suggested use of eminent domain to force higher density
retail/commercial/residential development to support the rail project,
which conflicts with the City's existing development policies.
6. Larkspur SuppOrts Effective. Efficient Transoortation Svstem
Improvements for the Region. Although Larkspur City Council cannot
support Measure R. a well crafted transportation improvement plan that
fully analyzes the opportunities and impacts, and wisely uses the region's
taxing authority for a comprehensive network of capital improvements and
programs is supportable. Elements of a plan Larkspur City Council could
support include:
a. Enhanced intra-county and commuter bus system using the existing
transportation system, and enhanced with special lanes and/or using
the former NWP right of way as a paved busway;
b. Aggressive programs to support alternative forms of transportation
including carpooling, subsidies, flexible scheduling at schools,
government offices and employment centers, telecommuting center
and programs, technology enhancements for work productivity in
multiple locations, toll lanes and improved bicycle and pedestrian
infrastructure.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Larkspur opposes the Sonoma Marin Rail Transit (SMART) District Measure R on the
November 7, 2006 for the reasons described above.

WHEREAS, on December 19, 1990 the City Council approved Resolution No.75/90
approving an update of the City's General Plan; and
WHEREAS, the Larkspur General Plan supports a rail connection to the Larkspur Ferry
Terminal as a lleneral conceot. no analysis was made at that time or since
that time regarding the potential impacts of rail and a rail terminal on local
traffic congestion and the land uses that might conflict with the Larkspur
General Plan; and
WHEREAS, the Circulation Element of the Larkspur General Plan (i.e.. Policy v)
supports the concept of public transit including a rail connection from the
north via a grade separation with Sir Francis Drake Boulevard along the
approximate alignment of the existing trestle; and
WHEREAS, the Circulation Element of the Larkspur General Plan also clearly qualifies

connection with the ferry terminal in terms of its potential to increase local
traffic congestion (i.e., pages 80 and 82 of the Circulation Element and
Policy v); and
WHEREAS, the Circulation Element of the Larkspur General Plan further qualifies this
support relative to the impact on the City's quality of life, specifically,
Goal 1 of the Circulation Element states, "Regard quality of life in
Larkspur more important than mobility of traffic." Goal 4 states,
"Improved local or regional transit service should not negatively impact
Larkspur."; and
WHEREAS, the Circulation Element of the Larkspur General Plan, page 85, continues
on to state clearly that, "From Larkspur's perspective, it will be important
to develop and implement policies to encourage additional transit for its
own citizens. It will also be important to continue to work with other
agencies to come with a regional transit option that serves Larkspur, but
does not adversely affect it."; and
WHEREAS, although Land Use Goal 16, related Policy U, and Land Use Change 14 (p.
40) support retention of the present Airporter use and the use of the site as
a transit station, and Action Program [11] states: "Promote an exclusive
mass transit corridor along the railroad right-of-way east of Highway
101," these policies, as well as the Plan's other references to transit do not

specifically endorse rail but do allow for consideration of other transit
modes along the right-of-way, such as an exclusive bus or high occupancy
route.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LARKSPUR DOES
RESOL VE AS FOLLOWS:
That adding rail transit and a Larkspur Ferry Station as currently proposed by the
Sonoma Marin Area Rail Transit (SMART) Authority would have the following
irreversible major impacts:
. A double track, two platform station 20 feet above ground in the middle of
an existing commercial and retail center would drastically change the character of
the center with potential adverse impacts on the value of the properties and
revenues to the City, which includes the possible demolitions of a number of
office and commercial buildings.
. The visual impact of an elevated end-of-the-line train structure would be
significant whether a train station is sited within the commercial center, crossing
East Sir Francis Drake Boulevard or terminating at the larkspur Ferry Terminal
where Bay views would be blocked.
. The traffic inducing impact would substantially lower the already poor
"level of service" at the nearby Highway 101 interchange, which is now rated as
one of the ..vcrst in the Bay ..1..rea in terms of congestion. In addition East S::-
Francis Drake commute traffic is often grid locked.
. Increased demand for parking could lead to double deck parking over the
Ferry Terminal parking lot, which the City has opposed, or in new large parking
structures for the commercial center.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LARKSPUR
FURTHER RESOLVES and adopts this resolution for the purpose of clarifying its
adopted General Plan policies and opposes a rail extension to a train station at Larkspur
Landing because of the major negative impacts on our community.

This letter is in response to the Final Environmental Impact Report for the Sonoma-Marin Area
_Rail Transit Project, which was received by.the City of Larkspur on July 5,2006. In addition to
.the City's concerns about the proposed Larkspur Rail Station and the inadequacy of the Draft
and Final EIRS, the City has concerns by the Transit District's processing of the environmental
doc.ument.

First, SMART c~ntinues to.put the selection of the Larkspur Rail Station location on the City's
comments. However, the record clearly shows that the City has had issues with all of the
locations that have been presented and has asked for a thorough analysis of each alternative.
Response to comment 9-14 states that SMART intends to prepare a Draft EIS at a later date.
This would appear to be a piecemeal approach since an EIS would require comparable analyses
of the alternatives.
Second, Section 15088.5, Recirculation of an EIR PriOI to Certification, of the State CEQA
Guidelines, cle'lIly require the recirculation of an EIR when a draft EIRis "fundamentally and
basically 'inadequate" and so "conclusionary in that meaningful public review and comment are
precluded." Given the mult~tude of errors in the draft EIR, which included the need for 21
corrections to the model runs alone, the document must be recirculated for public comment to
allow .the.public time to review the revised infornlation and provide comment. Two weeks' time
is not sufficient to allow for.an adequate review of the responses and the revised data that has
been provided. Therefore, we are unable to fully comment on the responses to the City's
comments.
From a cursory review of the Final EIR, it is evident that the majority of our comments either
have been inadequately responded to or not responded to at all. For example, response to part
comment 9-2 is that "construction impacts are identified and analyzed in each impact section of
the DEIR. The analysis of project impacts includes the impacts associated with a "reverse" rail
commute." This statement does not respond to the City's specific concerns regarding
construction impacts in the' Larkspur Landing Circle area and further responses to other
comments regarding constructioninlpacts smw!yreferto a future construction plan. Given that
. there is currently a parking shortageintheareaas-well as:poorleyels of service, aJutureplanis
not aresponseto the City's concern. Genera.l~tements aboutatiell1P~ingtoobtain other access

Comment 9-7 requests that .the discussion of travel patterns include a comparison of traffic from
Sonoma C~untytoSan RafaeltotrafficfromSonoma County to San Francisco,. The response
simply states thatthe data is in a table in an appendix, TheDraftEIR,however, does not discuss
or analysis the data, Further, the response to comment 9-10 states a confusionwith.theCity's
comment implying that we have referred to "walking from theF erry to the. proposed station,"
which appears no where in our comment. .
These are just afewexamplesof where the responses areinap.pquate. Comme.tlts from our traffic
consultant are attached. Unfortunately, as stated. above, inadequate time was Jlrovided for a
thorough review of the document gIven the number of corrections thai were necessary to the
originalana.lysis.
Most importantly, the City once again requeststliatSMART realistica,lly consider the extension
to Larkspur.and the ferry terminal as a later phase of the project, which \\Iould allow for more
time;to study the alternatives to ensure that the best alternative is selected. Even SMART needs
to acknowledge that an eight minute walk for an average personJromthe station to theferry

service remain the same. According to the FEIR, the SMART project as proposed
would lutvea small marginal advantage over the No Project alternative. Tile
adVl!J!!age is so minQr, however, that, in my opinion, the selection of the rail project
would have to be based on criteria other than t.ransportation service.
Summary of Major Findings
1 .- The impact of the SMART Project on the operation of the mixed flow lanes on
Highway 101 would be minimal. The peak hour traffic volume on Highway 101
projected for 2025 would be the same with or without the SMART project
(Tables 3.6-7 a and band 3.6-8 a and b).
2 - The impact of the SMART project on Vehicle Hours of Travel (VHT) show It
0.26% improvement over the No Project Alternative in the .AM peaknour and NO
improvemCllt over the No project AlternatiVe in tbePM peak bour. (Table 4.2-1)
3 -- The Express Bus alternative sbows even tessimpact 011 Highway 101 than does
the Nn Project Alterrutrive. (Tables 4.2-2 11 and b and4.2,3 a and h). According to
the SMART analysis, the Express Bus Alternative is less effective in removing
tTa.ffic from Higlrway 101 than would be the No Project approach. This finding
Tllises concern on the procedures used to stUdy the Ex:pressBus altemative.
4 - The proposed Larkspur rail station is projected to attract 182 ~pllS8el1gerS.
Of these, between 40 and 55 are projected to translilr to the ferry each. day. The

is proposed to be located closer to the ClI! Park Hill Tunnel and thus reduce its
visual impact, reduce its impact on the MarlnAirporterand make use of the
pedesttian/bike routes being developed for the Tunnel bicycle route project. The
walk from the station to the ferry of about I ,900 feet would make use of the
existing pedestrian bridge over E. Sir Francis Drake Boulevard,

Other Selection CriteFl8.
Rail transit is sometimes selected over other transportation modes because ofthe
beneficial effects it would have Oil land use or other environmental features. In
Larkspur and most of Marin County, there is limited opportllllityfor the ran transit
system to create such an advantage, lnLarkspur and San.Rafil.e1 most of the
opportunity to create rail oriented development has been foreclosed by. the existing
devcloproent patterns, At the Marin Civic Center recent development approvals
have removed all significant areas ofundeveloped land.
The one undeveloped steain Marin where therailtransitservi.ce cou1dhave been
used to foster a modern transit oriented community, the StVincents / Silvienl
properties, has been excluded from the mil service by State law.
The proposed north. Marin stations are also constrained by the already established
development patterns.
In Sonoma County there continues to eldst several opportunities for the wlservice
to help establish new higher density central citydeve1opments. Perhaps the
selection of the SMART project could be justified by the positive impact it could
bave on these Sonoma cities.

Meeting Minutes for Regular Meeting Held July 17, 2006

1. Public comment - No members of the public were present for comment.
II, Minutes - The minutes for the Regular meeting held May 15,2006 approved.
Motion - Riessen; Second -Tripp; Vote 5-0.
IV. Finance Reports - Mulder reviewed the May and June cash reports. Mulder explained that through
June 2006 our overall revenue is still up from last year by over $18,000. This is a result of Spring
Academy, Ballet, Summer Youth programs and Adult programs. Mulder also pointed out that our
summer youth camp enrollment remained very low and that all indications show that summer camp
revenues will again fall far short of the budget. Mulder explained that projected summer camp
revenues are estimated to be $30,000 to $40,000 below budget. Last year camp revenues were
$60,000 below budget.
V. Information and Discussion Items
a. FY 2005-2006 Audit: Mulder presented and reviewed the FY 2005-2006 Audit. The excess
deposit with Bay Cities Joint Powers insurance authority was recorded as income in this fiscal
year. The end of the year total fund equity is $193,597. The net income for the FY 2005-2006
was ($3648). McCaskill presented Comparative Financial Results for the past 6 years and a
Reconciliation Statement of Internal Financial Reporting to Audited Statements for the year
ended February 28, 2006.
b. Summer Camp Programs Update: Mulder summarized enrollment and camp revenues for the
summer to date. He explained that camps have been operating very well, just with low
enrollment. A few weeks of camp have been consolidated into other weeks. Bauer explained
that it looked like overall enrollment and revenue was about the same as last year and that this
looked like a trend that was going to continue.
c. Camp Market Study, Draft Review: Mulder presented a draft for a request for proposals for a
Summer Camp Program Marketing Study and Community Recreation Program Needs
Assessment. Bauer suggested changing the scope of Phase I the Summer Camp Program
Marketing study so that it was not so specific on task. Mulder explained that George Rodericks,
Belvedere City Manager had read the draft and was supportive of the RFP. Tripp suggested that
a summary needed to be added at the beginning of the RFP. Mulder agreed to make revisions as
suggested to the RFP and include an Executive Summary. Mulder explained that he would send
out a new draft and would then present it to both the Town and City managers for consideration.

d. Tennis Court Re-surface and repair update: Mulder presented a letter that was presented to
the City of Belvdere requesting financial assistance for re-surfacing and repairing the Lagoon
Tennis Courts. Mulder also explained that the City of Belvedere has considered funding for this
project and approved it in their capital budget. Mulder explained that he and Dana Thor had met
with City officials about this project and it should be scheduled for repair in the Fall of2006.
Mulder also plans to approach the Town of Tiburon for financial assistance to repair and
resurface the Point Tiburon tennis courts.
e. RUSD Facility Use Update: Mulder explained that sununer programs at Reed School were
going well. He also noted that the RUSD Permit for program use in the Fall has been approved.
Room 0 at Reed will no longer be available due to an increase in school enrollment, instead
BTJR will be given room 15, a smaller room. Mulder is waiting for RUSD Superintendent to
return from leave to set up a meeting to discuss the fees for the upcoming school year.
f. Peter Berg Kite Day, May 2007: Mulder explained that he was approached by Margo Zender,
Chair of the Tiburon Open Space Commission regarding Peter Berg Kite Day. Mulder asked the
committee what the history of this event was and ifBTJR had been involved. Riessen explained
that BTJR had not been involved, but he believed Kite Day was a very worthwhile family event.
It was determined that BTJR would provide support for the event by promoting it in the 2007,
Spring Recreation Guide.
g. Academy Program Overview: Mulder handed out a schedule of Academy programs that are
planned for Reed, Bel Aire and Del Mar schools. BTJR will have a classroom at Reed school
and for the first time a classroom at Bel Aire. Burchert summarized the programming that is
scheduled at the school sites for the upcoming Fall 2006 Academy program.
VI. Staff Reports:
b. Special Events: Ballet Performance: Burchert presented a review on the Ballet Perfonnance
held May 10 at Reed School. Our young ballet participants performed to a packed house of over 200
people. The event was a challenge on such a small stage, but the performance went very well and
turned out to be a huge success!
