would like to thank you for issuing a proclamation declaring April as Fair
Housing month, and embracing the concept of fair housing as a fundamental
human right.
The proclamations were read during the 2006 Fair Housing of Marin
Poster Contest Awards Ceremony. It was a very meaningful event for all
of the school children.
Thank you for sharing with us in striving to enrich the cultural diversity of
Marin County.

On behalf of the Belvedere- Tiburon Joint Recreation Committee I would like to extend
our appreciation to both the Town of Tiburon and the City of Belvedere for its continued
support of our agency. Our mission is to provide quality recreational and educational
programs that inspire and enrich the lives of children and adults in the community while
maintaining a self-supporting agency. Weare very proud of our purpose and believe that
the programs and services we provide are vital to the well-being and quality oflife of our
residents.
It is our understanding that both the Town of Tiburon and the City of Belvedere have
been planning to complete a Recreation Master Plan for the Tiburon Peninsula. The
Belvedere- Tiburon Joint Recreation Committee would like to extend our support for this
project. We also feel that as a local recreation services provider we can provide
assistance to the Recreation Master Plan process. Please keep our committee appraised
of this project and let us know how we might be able to assist in this endeavor.

Subject: ReQuest for Sanitarv District No.5 Sewer Easement along Fire Road
Dear Dave,
Sanitary District No.5 currently owns and operates a small package sewage
treatment plant at 3700 Paradise Drive. The current package plant is over 40
years old and has met the end of its economic life and is in need of replacement.
The District has reviewed three alternatives for sewering its current customers
on the northeastern side of the peninsula, which are replacing the current
package plant and outfall pipe, pumping the sewage along Paradise Drive to the
Main Treatment Plant, or pumping the sewage over the ridge to Gilmartin Drive
to an existing sewer line owned by Richardson Bay Sanitary District. The most
cost effective way of serving the District customers of the northeastern side of
the peninsula would be to decommission the current package treatment plant
and replace it with a pump station, which would then pump the sewage to the
Main Treatment Plant located at 2001 Paradise Drive.
Sanitary District No.5 wrote a letter to Richardson Bay Sanitary District in
early December 2005, regarding the proposed over the ridge solution, for
serving the District customers on the northeastern side of the peninsula.
At the December 20, 2005, Richardson Bay Sanitary District board meeting,
the Board of Directors unanimously approved District 5's proposal for
entering into an agreernent with Richardson Bay Sanitary District for
using and maintaining the gravity sewer line on lower Gilmartin Drive.
The District has also received a letter from Mr. Irving Rabin located
at 3825 Paradise Drive granting the District, free of charge, an easernent
on his property for a pump station and force main sewer pipe.
The proposed alignment would require the installation of two four (4) inch or one
six (6) inch diameter pipe line from the top of the ridge (top of Gilmartin Drive)
along an existing fire road located in the Town ofTiburon's open space, to
connect with an existing sewer system on Gilmartin Drive. Sanitary District No.5
is requesting an easement from the Town ofTiburon to move ahead with

BILL" - ASSEMBLY BILL 1234
Resolution #1293 provides that Board members can be reimbursed their expenses
for attendance at conference or organized educational activity including travel,
meals and lodging.
The Board unanimously to passed Resolution #1293, MIS Sotelo, Brunini.
11. RESOLUTION AWARDING ADDITIONAL RETIREMENT COMPENSATION TO
DISTRICT MANAGER
Prasident Morphew recognized District Manager, Frank T. Dillie, Jr. for his
professional and competent services rendered to the District over the past 30
years. With Board approval the District will give Mr. Diitle the 1999 F150 Ford
pickup truck as compensation for past meritorious services rendered.
The Board unanimously to passed Resolution #1294, MIS Sotelo, Brunini.
12. RESOLUTION APPOINTING BONNER BEUHLER MANAGER OF THE
RICHARDSON BAY SANITARY DISTRICT
Resolution #1295 appoints Bonner Beuhler as District Manager, effective January
1, 2006, at the salary and remuneration presently paid by the District for its
General Manager.
Director Brunini motioned 10 approve Resolution #1295, Director Sotelo seconded,
Resolution #1295 passed, Ayes; Directors' Brunini, Sotelo and Willat, Noes;
Directors' Benvenuti and Morphew.
13_ SANtT ARY DISTRICT NO.5 - PROPOSAL TO CONTRACT WITH RICHARDSON
BAY SANITARY DISTRICT FOR USE OF GILMARTIN DRIVE SEWER
Manager Dittle informed the Board that Sanitary District #5 is looking for an
alternative solution for servicing the eastern side of the peninsula. District #5 is
considering abandonment of the Package Treatment Plant, by pumping all of the
sewage westerly up over the Tiburon Ridge to the west side sewage collection
system on Gilmartin Drive, and thence to the Main Treatment Plant of District #5.
Modifications to the sewer line on Gilmartin Drive, as well as, Tiburon Blvd.be
necessary. This proposal would require cooperation between Sanitary District #5
and Richardson Bay Sanitary District as a portion of the system on Gilmartin Drive
is owned by RBSD. District #5 would like to enter into an agreement with RBSD to
maintain the gravity sewer line owned by RBSD, and RBSD would collect and
forward the current EDU charges collected from the homes on lower Gilmartin
Drive to District #5
Mr. Dillie recommended that the Board approve the concept. The Board
unanimously approved, MIS Sotelo, Brunini.

Dear Mr. Knauber:
Thank you for the recent opportunity to meet with you and members of your Sanitary District
Board of Directors to discuss the sewer system needs in the Paradise Drive area of the Tiburon
Peninsula.
The Town is very supportive of a proposed sewer system to serve this entire area which includes
both the incorporated and unincorporated areas located on the northeast side of the Tiburon
peninsula. We are also aware of considerable support for such sewer service by various property
owners in that area. Mayor Kuhn's recent memo, which was copied to you, reflec'..s the Town's
concern regarding septic tank systems and the overall need for installation of a Paradise Drive
sewerage system.
There is considerable information available relating to the construction and the estimated
installation cost of a Paradise Driv~ area sewer.1ge system. The Town is also prepared to assist
Sanitary District No.5 in the formation of an assessment district to serve this purpose. Mayor
Kuhn and I are available to meet with you and your Boardmembers to discuss this matter in more
specific detail.

Dear Ms Bigall,
On May 5, 2006 the Board of Trustees for The Reed Union School District abstained
from voting on the supplemental assessment for the Del Mar Supplemental Assessment
District. The Board believes that the District should never have been included in the
assessment and that the issue needs to be resolved by the Del Mar Homeowners who will
directly benefit from the undergrounding of utilities.
The Board wants to be a good neighbor and contribute to our community but believes
that the $86,000 assessment will be better used supporting the students in the Reed Union
School District.

As you know, due to the recent stonns through April of this year, a portion of Paradise Drive
between Seafirth and the Romberg Center suffered a small landslide causing part of the road to
wash away and the closure of the road approximately 4 weeks ago,
I spoke to the County yesterday to get an update. Kevin McGowen, the County's chief of
engineering, indicated that it may not be completed for another 8 weeks (3-4 weeks to select a
contractor and 4-5 weeks for construction). Given this schedule, the repair of Paradise Dr. may
not be completed until mid to late July, 2006,
Estimated cost for repairs have ranged as high as $400,000 with Mr. McGowen indicating that it
may be approximately $150,000 just for the construction repair. The County has been working
diligently on this matter.

AB 1234 requires specified elected and appointed officials to take ethics training if the
officials receive compensation for their service or are reimbursed for their expenses.
The basic requirement is two hours every two years, although the first deadline is
January 1, 2007 for those officials in office on January 1, 2006 (AB 1234's effective
date). As a service, the League of California Cities and the Institute for Local
Government are making such training available to local officials in Marin County and

Dear Mayor Smith:
Faced with cuts in homeland security spending, on January 3, 2006, the U.S. Department
of Homeland Security (DHS) announced that it would change the way it allocates urban
area security funding known as Urban Area Strategy Initiatives (UASI). DHS identified
35 candidate areas eligible to apply for and receive funding in 2006. These 35 newly
identified candidate areas promote a "super" UASI concept designed to build greater
regional capabilities across a geographic area.
The 2006 candidate area in the San Francisco Bay Area includes the Cities of San Jose,
San Francisco, and Oakland, each of whom received UASI grants in 2005, and adds the
Cities of Berkeley, Daly City, Fremont, Hayward, Palo Alto, Richmond, Santa Clara,
Sunnyvale, Vallejo and jurisdictions in a 1 O-mile buffer extending from the border of the
combined area.
Each candidate area was required to submit one combined application to the state Office
of Homeland Security (OHS) and OHS then submitted one application to the federal
DHS. The application was due to DHS on March 2, 2006.
A 2006 Bay Area UASI governance structure was established to act as the final vote and
approval authority of the UASI plan priorities submitted in the application. The approval
authority consists of the City and County of San Francisco (2 votes), the Cities of San
Jose, Oakland (lvote each) and the Counties of Santa Clara and Alameda (1 vote each)
and the California Office of Emergency Services - Coastal Region (1 vote).
The change in urban security funding policy came as a surprise to most urban areas,
especially those jurisdictions just added to the candidate area. When ABAO became
aware of the policy change, we issued a meeting notice and facilitated an afternoon
gathering of the jurisdictions that comprise the Bay Area candidate area. The meeting

served as an update on the status of the joint application, but more importantly called
attention to leaders that they must be aware of and actively mitigate natural and man-
made threats that face the region.
In the coming weeks ABAG will be working in cooperation with member agencies to
plan and conduct a symposium on Homeland security emergency planning issues for
elected officials and city /town managers and county administrators. In the meantime, if

providing agility supplies in the park. Unfortunately, the park you are referring to
belongs to the City of Belvedere and not the Town of Tiburon. I am forwarding a
copy of your letter as well as a copy of this letter to George Rodericks, the City
Manager of the City of Belvedere.

Summary and Requested Action
The deadline for creating subregions within the RHNA process (RHNA subregion) is August 31,
2006. Creation of a RHNA subregion requires a resolution by each city councilor board of
supervisors. If your jurisdiction is interested, please send a representative to an informational/
organizational meeting at the Association of Bay Area Governments' (ABAG) offices on June 16,
10 a.m. to Noon.
Discussion
Changes to the Housing Element law enacted in 2004 provide an opportunity for local jurisdictions
in the San Francisco Bay Area to create subregions that are empowered to perform housing need
allocations at the subregional level. Subregions will be responsible for conducting the subregional
allocations in parallel with the ABAG's regional allocation.
ABAG has not previously conducted a RHNA with RHNA subregions in place. The statute provides
a broad framework for how to proceed (see over). In addition, in September 2005, ABAG secured
from the Department of Housing and Community Development (HCD) an extension for RHNA and
for local jurisdictions to amend their housing elements. As a condition of the extension, HCD and
ABAG agreed to a more specific timellne than provided by statute. Major events on the timellne
are:

coordination of the allocation effort. Therefore, we are asking interested jurisdictions to meet,
discuss and, as appropriate, agree on a course of action around the following issues:

. What are their expectations?
. What role does ABAG expect to play in the RHNA subregional process?
. How will problems be identified and resolved?

What is a subregion?
Revisions to the Housing Element Law provide an opportunity for the formation of one or more "subregions"
that will have the responsibility for distributing the housing need for a subregion among the members of a
subregion.'
Who can be in a subregion?
. Two or more cities in a county and that county can form a subregion or
. Any combination of geographically contiguous local governments.2
How do you form a subregion?
The policy bodies of each member of the subregion must adopt a resolution authorizing its inclusion in the
subrEilgion and notify ABAG by August 31, 2006.3 ABAG must adopt a resolution approving the subregion.
How does a subregion make decisions?
All decisions of the subregion
. shall be approved by vote as provided for in rules adopted by the local governments comprising the
subregion or
. shall be approved by vote of the county or counties, if any, and the majority of the cities with the
majority of population within a county or counties.'
How is the subregion's housing need determined?
ABAG Is required to determine the subregion's housing need "in a proportion consistent with the distribution of
households assumed for the comparable time period of the applicable regional transportation plan." s ABAG
will hold a public hearing and consider proposals to revise the subregional need.
How does a subregion distribute the subregional housing need to its members?
. Subregions must follow the same substantive and procedural rules and guidelines that govern how ABAG
develops its methodology for allocating the regional need and for the actual allocation. For a general
outline, please see attached RHNA timeline.6
. In addition, each subregion and ABAG "shall enter into an agreement that sets forth the process, timing,
and other terms and conditions of the delegation of responsibility by the council of governments to the
subregion." 7
What is the timing for the subregions' RHNA process?
. HCD has agreed to provide the region's housing need to ABAG by March 1, 2007. This was done in order
to shift the pertinent portions of the RHNA process to earlier points in time. This, in turn, relieves the time
pressures caused by two processes that could occur towards the end: (1) statutory appeals of the final
RHNA allocation and (2) ABAG needing to perform subregional allocation if a subregion fails to do SO.8
. HCD has committed to providing the regional housing need to ABAG by March 1, 2007. ABAG intends to
issue the subregional need(s) within 21 days after receipt of the regional need from HCD
. ABAG has established deadlines of March 30, 2007 for adoption of a methodology and June 30, 2007 for
issuance of draft regional allocations. ABAG expects that its delegation agreement with each subregion will
include the same timelines for the equivalent subregional task.
