ORDINANCE NO. 457 N.S.
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF TmURON
PREZONING APPROXIMATELY 0.27 ACRES OF PROPERTY LOCATED AT
4930 PARADISE DRIVE
ASSESSOR PARCEL NO. 38-052-08
WHEREAS, the Town Council of the Town of Tiburon does ordain as
follows:
Section 1. Findin1!s.
A. An application has been initiated by the Town of Tiburon to prezone
approximately 0.27 acres ofland described as Marin County Assessor's
Parcel No. 38-052-08.
B. The Planning Commission held a duly noticed and advertised public hearing
on March 8, 2000 and recommended prezoning of the property to RO-2 zone.
C. The Town Council has held duly noticed and advertised public hearings on
March 15, 2000 and April 5, 2000 and has considered all testimony in
reaching its decision.
D. The Town Council finds that the project is categorically exempt from the
requirements of CEQA per Section 15319 ofthe CEQA Guidelines.
E. The Town Council finds that the prezoning is consistent with the goals and
policies of the Tiburon General Plan.
Section 2. AODroval of Prezonin1!.
NOW, THEREFORE, BE IT ORDAINED that the Town Council ofthe
Town of Tiburon does hereby prezone the subject property, commonly known as
4930 Paradise Drive and further identified as Marin County Assessor Parcel No. 38-
052-08, to the RO-2 Zoning District. This zoning shall become effective immediately
upon annexation of the property to the Town of Tiburon.
Section 3. Severability.
If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional, such decision shall not
affect the validity of the remaining portions of this Ordinance. The Town Council

hereby declares that it would have passed this and each section, subsection, phrase
or clause thereof irrespective of the fact that anyone or more sections, subsections,
phrase or clauses be declared unconstitutional on their face or as applied.
Section 4. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after the date
of passage, and before the expiration of fifteen (15) days after its passage the same,
or its legally required equivalent, shall be published with the names of the members
voting for and against the same, at least once in a newspaper of general circulation
published in the Town ofTiburon.
This ordinance was introduced at a regular meeting of the Town Council of
the Town of Tiburon on March 15, 2000 and was adopted at a regular meeting of
the Town Council of the Town of Tiburon on April 5, 2000 by the following vote:
