Cc: Nicholas Nguyen; Ann Danforth; Dave Bernardi Subject: bi-monthly report & legal issues DIGEST Dear Heidi et aI., It has been a number of weeks since I gave Alex our last bi-monthly report and update. As of today, we are awaiting PG&E's final sign-off on the gas line, so that we may schedule our demolition contractor to start on site. We are continuing to move forward with all aspects of the project, including finalizing the five-sail design with our programmer before sending cut-sheets to the water-jet cutter. Sail construction will be done concurrently with fountain construction. We are awaiting a final okay on our plan submittals for all major systems ordering for the fountain components. We hope to get written confirmation from Dave this week to proceed. We are also awaiting a final okay on our textured concrete plaza surface that encircles the fountain area (this does not include Pederson's concrete circle which will not be of the same texture.) Ann was unclear as to who needed to okay this, as it is not called out in our contract. We left a sample in the Town office. Please let us know if this is acceptable. Weare anxious to get started with the construction. Each week we have been told it will be one more week for PG&E. Hopefully, they will really be done by the end of this week! These delays have made it difficult for us to plan our life and work. We had expected to be on another job by early summer. Now we will be in Tiburon until at least the first of August, perhaps even mid-August given the further delays by PG&E. We will give you a definite expected completion date when we are eight weeks from being done. We are preparing a bid for work on the plaza redesign which includes three art benches and custom concrete work and demolition. If we are given the contract in a timely manner, this should not cause extra delays to our completion of the fountain (although custom benches will likely go in after fountain completion). Additional custom concrete finishing would be done concurrently with fountain construction. Lastly, it would be great to plan some sort of grand opening with the Town. Ms. Zelinsky said she does NOT want it to coincide with a "Friday on Main" and would like a separate date. I do not know if the town has any money to put towards an opening, or if there are in-house P.R. people. N ow is not too soon to plan. Per your request, below is an accounting of the Fountain Plaza Art Project to date. I have separated the General Fund expenditures from the Fountain Plaza Art Project Fund expenditures. General Fund Expenditures The Town originally budgeted $20,000 in FY 2005-06 for the preparation work associated with the installation of the fountain plaza art project. In addition, the Town Council approved two separate budget amendments for work associated with the art project. The first amendment was in the amount of $30,000 for the PG&E work associated with the relocation of the gas main, and the second an additional $17,100 for landscape architect services. To date, the Town has spent $50,737.58 in General Fund monies and $67,100 has been budgeted to date. At this point, the preparation work for installation of the art is complete with the exception of the landscape architect services. As a side note, the City of Belvedere has a $22,000 contribution to the art project budgeted in their draft FY 2006/07. Without explanation, the signs urged passers-by to "Get Ready." At least one local complained that public works employees were littering the area with evangelical pronouncements. Actually, it's all part of an ambi- tious new program to have every Tiburon and Belvedere household ready to survive a regional disas- ter, such as a major earthquake or wildfire, and be self-sufficient for at least three days. "We have a shot of becoming the first community in the nation to pull this off," said Larry srriith, chairman of the Tiburon Peninsu- la Disaster Preparedness Task Force, during a recent session with dozens of volunteer trainers. "And I submit to you that neigh- borhood pride will kick in. . . . Ka- trina has shifted our whole out- look on individual responsibility." Spurred on by the emergency response fiasco of Hurricane Ka- trina, these efforts have also been galvanized by the centennial of the 1906 earthquake. Just last week, the American Red Cross announced a similar drive to train 1 million people in the Bay Area to make their house- holds more disaster-resistant. Besides urging residents to "Get Ready," the bright yellow signs that were first posted March 24 on the Tiburon peninsula also provided an Internet address - www.getready94920.org. With their curiosity piqued, residents of Belvedere and Tiburon logged on. The Get Ready Web site regis- tered 9,000 hits in the first two days and 17,000 by this week. The Web site provides informa- tion on where and when locals can sign up to take a two-hour f,:'.:\;' ')~<,;'," Tiburon Fire Marshal Ron Barney discusses the different kinds of shutoff valve wrenches and their uses at a training session. training session in disaster pre- paredness, or apply to become a trainer. There are 5,200 house- holds on the Tiburon peninsula. Household training classes began last week, and so far more than 400 residents have signed up for training. At the training sessions, resi- dents receive a copy of a 50-page manual that has been customized for the peninsula. The step-by- step manual includes recommen- dations on developing an emer- gency plan and maintaining an adequate food and water supply, as well as a shopping list of items to buy, such as crank-operated ra- dios and portable toilets. It also advises where to store emergency gear and what to do during an earthquake, such as tips on shutting off gas, electricity and water, when necessary. Because people may not be at home when a disaster hits, they are also en- couraged to store emergency kits in their cars and at their offices. "If we prepare ourselves indi- vidually, it'll have a huge impact on how we respond as neighbor- hoods or as a community," said Chief Rich Pearce of the Tiburon Fire Protection District, which in- cludes Belvedere and Tiburon. "We want folks to be self-reliant for at least the first 72 hours. . . . The goal is to train one person ,"; ~ ;:I......7 "i"~ from every household." The Get Ready campaign is sponsored by two nonprofits - the Belvedere Community Foun- dation and the Tiburon Peninsula Foundation - and supported by the municipal governments of both cities. It was started in October after Katrina devastated New Orleans. A forum on emergency prepared- ness held at St. Stephens Episcopal Church in Belvedere attracted 125 people. A similar forum a year ago had drawn only three locals. "As bad as it was for the people affected by it, Katrina was a god- send for disaster preparedness," said Dr. Tom Cromwell of Belve- dere, an anesthesiologist whose . Disaster Medical Assistance Team (organized by the Federal Emer- gency Management Agency) treated victims in the New Orle- ans Superdome after Katrina slammed into the Gulf Coast. "That really focused the entire country on disaster prepared- ness." Cromwell has been involved with a local committee promoting disaster preparedness since the 1991 Oakland hills fire. I realize this is a rare request but I know there is no way to close the Post Office parking lot Monday through Saturday. Bernardi, Interim Director of Public Works/Town Engineer; Town Attorney; Town Council Town of Tiburon 1505 Tiburon Boulevard Tiburon, CA 94920 Re: McCart Court Drainage Problems Dear Mr. Bernardi, Town Council and Town Attorney: Mr. Bernardi: Your letter of March 22,2006 stating that the Town is not responsible for an inadequate catch basin installed on Town property by the Town is ludicrous. On the afternoon of April 12, 2006, during a heavy downpour, two Roto Rooter trucks pulled up and started to dredge out the catch basin. Out of curiosity, since you have informed me that the catch basin is not the Town's responsibility, I asked one of the workers who had called them out. They said the Town called. Also, he stated he could not find a drainage pipe but was hitting a concrete wall. After they left, I checked the catch basin and it was still half filled with water and Roto Rooter had placed two orange cones at the location. It appears that no one at the Town knows what the other half is doing or responsible for. Town Council: I initially wrote to you because I was getting nowhere in the past with Town engineers who know nothing of the law, and only wish to stall the issue until they can move on to better-paying jobs. I am appalled that not one of you took the time to look into the situation but just passed it on to yet another inadequate engineer. When you were elected/appointed to serve on the Town Council, did you not do so in order to represent the citizens of Tiburon ? You are sorely amiss in your responsibilities. Town Attorney: I am attaching a copy of case law from Summary of California Law. As you can see, the Town is clearly committing inverse condemnation against our property and more so against the property located at 4 McCart Court. The Town is liable for damage caused by flooding, erosion, pollution, etc. by its failure to install proper drainage. The owners of 4 McCart Court are new owners and are still residing overseas. Hopefully, in a few months they will be returning to the States and we can join forces to tackle this problem. As you can see from the agenda, we are facing attack from those who think we don't do enough, and from those who think we do too much. On a lighter note, the minutes of the last two meetings show that the RBRA has been very responsive in addressing the additional challenges posed by this heavy winter. Hopefully the. day or two of sunilight this week is a harbinger of things to come. Staffs thanks for Boardmembers' quick response in attending the special meeting. The Harbor Administrator's documents contain one near-term option for addressing the drifting vessel problem. While Belvedere West Shore residents may not want to spend more than they already do to live on the water, the program option put together by Mr. Price has the potential to effectively intercept many of the adrift vessels that might otherwise end up on their docks, and do so starting almost immediately. Other options Inay also be effedive, although those that require direct RBRA involvement will take additional time, to go through a bidding process, etc. The mooring field topic continues to Inove forward. Attached is a spreadsheet detailing the latest thoughts on potential costs and revenues for such a program. As you can see, the potential exists for the mooring program to be operating at a profit within four years. Initial budgetary contributions from member agencies are substantial, and your Board will undoubtedly wish to thoroughly discuss this. The proposed budget was included in the Board packet for the February 2006 meeting. Hopefully all Board members have had an opportunity to run this by their respective Council's, as action on this budget should take place at this April meeting, according to RBRA by-laws. RICHARDSON'S BAY REGIONAL AGENCY MINUTES OF FEBRUARY 16, 2006 HELD AT SAUSALITO CITY COUNCIL CHAMBERS MEMBERS PRESENT: Board President Paul Albritton (Sausalito); Charles McGlashan, (Marin County); Paul Smith, (Tiburon) ABSENT: Jerry Butler; (Belvedere); Chris Raker, (Mill Valley) STAFF: Bill Price (Harbor Administrator); Ben Berto (RBRA Clerk); Jennifer Vuillermet (RBRA Counsel) Session Called to Order at 5:35 PM. Approve Minutes of December 15, 2005 Meeting Minutes were approved unanimously. Accept report of Harbor Administrator Mr. Price explained that this had been a bad season for sinking and drifting boats due to the weather. He outlined the process for Schoonmaker Point Marina's new pump-out system, and how it will assist the functioning of the Waste A weigh boat. Member Albritton asked about the commercial tugs and barges located offshore form Sausalito Marine, and Price explained that he was working with Les Shorter Jr., of Mas Aqua, to remedy the situation. Member Smith stated that in his experience it was common practice for barge operators to store their gear between jobs at the last job site. President Albritton asked if RBRA could issue a citation, and Price responded that no regulations addressed this problem, but a code amendment dealing with storage of commercial construction equipment on the anchorage should be considered. President Albritton stated that the Sausalito PD was pursuing the purchase of a patrol boat. The Board asked that an interagency Ineeting to discuss enforcement issues on Richardson's Bay be agendized for the June meeting. Report was approved unanimously. Approval of prior expenditures for months of December 2005 and January 2006 The expenditure reports were approved unanimously, but the Board asked that Staff present a pie chart outlining expenditures and revenues to date at the next meeting. Mooring Plan discussion Jeffry Blanchfield, Chief Planner for the BCDC, was in attendance and spoke at length on BCDC's policies relating to Richardson Bay, and RBRA's history, especially with respect to anchorouts. He explained the Richardson Bay Special Area Plan (RBSAP) and the reasons it was created under the auspices of Marin County Supervisor Al Armnbaru, the regional Water Quality Control Board and BCDC. The RBSAP took two years of planning with a 48 member committee, which focused on navigational issues, tidal restoration, water quality and recreational access. He pointed out that Richardson's Bay operated under numerous laws, regulations, and agencies, including public trust doctrines, McAteer / Petris Act, and local government zoning plans. Significant portions cost analysis and find an appropriate contractor capable of responding round-the-clock to elnergency situations with a two-man crew and a capable vessel. President Albritton voiced the need for Belvedere to take the lead in paying for this additional service. Member McGlashan said that this would be an interim program that would be resolved once better moorings were put in place, assuming a Mooring Program could be approved and financed. Special Meeting Staff explained that the Special Meeting had been convened for the purpose of considering and taking action on a resolution accepting an amendment to the Department of Boating and Waterways' Grant #03-214-502 through the Abandoned Watercraft Abatement Fund. This Grant will provide the RBRA with $45,000 to continue its efforts in the disposal off abandoned vessels in Richardson's Bay. It was also explained that the RBRA would be required to match 100/0 of the total grant amount in order to receive the grant. The Resolution was passed unanimously. Items from the Public No members of the public were present. Board Member Matters Member Butler outline the contents of a letter he had submitted to his Council in Belvedere that addressed the issue of vessels breaking loose and causing damage on West Shore Road. He explained that a letter from an attorney had been received by the City of Belvedere, and that a series of demands had been outlined in that letter. He felt that it was important for the RBRA to maintain a single voice in this process. Member McGlashan advised all that he had contacted the Coast Guard and that they had provided some hope that their efforts in rescue operations would be increasing. Bill Price said that the shallow waters would hamper most Coast Guard operations, and that the Corps of Engineers could not be relied upon for support since their mission is clearing debris from active commercial channels. Price mentioned that Dave's Diving SeIVice was interested in providing an emergency response team that would be available on a 24 / 7 basis. If the service was contracted through a West Shore Road community association, there would be no need to go through a public request for proposals process. Member Butler asked what kind of indemnification would be available to Dave's Diving, and Price said that would have to be part of any contract. Price also stated that he had been holding the boat involved in the damaging accident in December 05' s storm, but to this point no one had contacted him regarding its disposition frOtTI either the Insurance Company representing the Robinson's, or from Belvedere Police Department. RICHARDSON'S BAY REGIONAL AGENCY HARBOR ADMINISTRATOR'S REPORT APRIL 14, 2006 WORKING RELATIONSHIPS · Dept. of Boating and Waterways - 1) Submitted a claim reimbursement for $23,669 for demolition costs related to the removal of 13 abandoned watercraft since January, and another $11,083 related to the removal of three additional vessels. 100/0 matching funds paid by RBRA were $3,859. 2) Staff applied for and obtained a supplemental $45,000 grant to be added as an addendum to the original DBW / A WAF contract. A Resolution was approved by the RBRA Board at the Special Meeting on April 3,2006 accepting the additional funding and the RBRA' s required 100/0 expenditure. Still working on obtaining a grant proposal to fund the W aste Aweigh program for operations and maintenance costs for the next three years. · Department of Fish & Game - The two salmon pennits have been renewed, but the sale has not occurred due to the uncertain nature of the California salmon season, which may not open this year at all. · City of Sausalito - Met at Station Golden Gate with Sausalito Police Departlnent and the Coast Guard in our regular round table format to discuss and address harbor issues. Marin County Sheriffs DepartInent was not in attendance. Next Richardson's Bay Interagency meeting is scheduled for Monday, 9/1 /06. DEBRIS REMOVAL · Disposed of 6 vessels as well as 3 skiffs. 8 boats are currently impounded. · Community Service Progr31n workers have been maintaining area beaches over the past two months. Supervised Adult Offender Work Program workers have not conducted additional concentrated clean-up efforts on beaches during the winter since boat disposal has taken precedence · Worked with a volunteer crew (much thanks to the dynamic Sudy Schneider and Fran Regalot) and my AOWP crew to clean up debris and tires from Arambaru Island. No spider bites to report. · Pulled two vessels away from Belvedere before they became a source of further problems. One was a 32' classic wooden sailboat that grounded in the mudflats and the other was a 28' fiberglass motor cruiser found derelict and adrift. WATER QUALITY · Two anchor outs have been added to the pUlnp-out program · Working with US Coast Guard to ensure that an anchor-out stays on the pump-out program. The individual was cited by USCG during a boarding and has since paid their bill to MT Head and is back on the service without requiring a Nuisance Abatement hearing. OTHER · Serving as an inspector for the California Clean Marina Recognition Program, we inspected Clipper Marina in Sausalito which scored among the highest in the State. RICHARDSON'S BAY REGIONAL AGENCY Dear West Shore Road Resident, Living on the waterfront exposes you to a very dynamic natural environment. As many of you who have lived in the area for some time can attest, wind-driven debris or vessels are an unavoidable fact of life on the lee shore in Belvedere. As Harbor Administrator for the Richardson's Bay Regional Agency, I have been asked to put together a response guideline for persons who have waterfront property that is exposed to wind- generated debris or a vessel that is adrift. We are working on a program that will address your concerns, but in the interim, we would like you to follow the guidelines here to deal with the threat immediately. A good look-out can often forestall disaster! If a vessel, object or debris is spotted adrift and threatening, a call to emergency responders can save property damage and salvage costs as well. Please report any such sightings quickly, even if you are not sure of the situation. If debris or a vessel. is has drifted onto your property, the best solution is for you to promptly contact a local salvage operator and make arrangements for them to remove the debris or boat. Time is of the essence, because the longer the object stays in place, the harder and more costly it will be to remove. Dave's Diving has agreed to be on stand-by for any problems at West Shore Road, on a 24 hour a day basis. He is a local Sausalito resident, which will increase response time for emergencies. He has a local crewmember as well, so storm response will not be as dangerous onboard his fully- manned vessel.
