HomeMy WebLinkAboutTC Ord 1993-12-07 ORDINANCE NO. 399 N.S. ~ AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF TIBURON PREZONING OF CERTAIN PROPERlY ON PARADISE DRIVE A.P. NOS. 58-031-17 and 58-011-02 WHEREAS, the Town Council of the Town ofTiburon does ordain as follows: SECTION 1. Findinl!s. 1. An application has been received from John and Agneta Dupen to prezone approximately 1.8 acres of property described as Assessor Parcel Nos. 58-031- 17 and 58-011-02. 2. The Planning Commission held a duly noticed and advertised public hearing on November 10, 1993, and recommended prezoning of the property shown on Exhibit A, such that all property above the high water line shall be RO-1 zone and all property below the high water line shall be Marine zone. 3. The Town Council has held a duly noticed and advertised public hearing on t December 1, 1993, and January 5, 1994 and has considered all testimony in reaching its decision. 4. The Town Council finds that the project is categorically exempt from the requirements of CEQA pursuant to Section 15319 of the CEQA Guidelines. 5. The Town Council finds that the prezoning is consistent with the goals and policies of the Tiburon General Plan. SECTION 2. Anoroval. NOW, THEREFORE, BE IT ORDAINED that the Town Council of the Town of Tiburon does hereby prezone the subject property, as shown on the attached Exhibit "A", such that all property above the high water line shall be RO-1 zone and all property below the high water line shall be M zone. This zoning shall become effective immediately upon annexation of the property to Tiburon. ~ 1 ~ PASSED AND ADOPTED at an adjourned meeting of the Town Council on December 7. 1993 by the following vote: AYES: COUNCILMEMBERS: Thayer, Thompson, Nygren, Friedman, Kuhn NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None ./l-?
