Dear Ann:
This letter when you sign and return will serve as our engagement to represent the Town of
Tiburon in the prosecution of the quiet title suit against John Silvia.
I will be primarily responsible for the supervision of the case and for participating in high level
strategic decisions. My partner, Walter Schneider, will be trial counsel if any of the cases is
tried, and would make court appearances and handle depositions as he thinks necessary.
Lorianne Conklin is a very experienced associate, and will assist Walter as necessary with
preparation of pleadings, and will make court appearances, and take and defend depositions as
we think best for you.
We will never have more than one attorney appear in court or take or defend a deposition
without your consent. My rate is $450 per hour, Walter's is $350 and Lorianne's $290. In some
instances for court appearances or for certain research we may use associates or legal clerks at
significantly lower rates in an effort to reduce your cost.
You will usually receive a monthly statement from us with an itemization of the services
performed in the previous month. Because time entries are processed by computer, some entries
may not be included until the next month's statement. The monthly bill will also include out-of-
pocket costs paid on your behalf, such as filing fees, deposition costs, service fees,
photocopying, messenger services, and computer research.
Our bills are due on receipt. Ifpayment is not made within thirty (30) days, the past due amount
bears interest at the rate of ten percent (1 OCYo) per annum.
