Dear Ms. Danforth:
This letter will act as an agreement between the Town ofTiburon and myself regarding the dismissal of
my claim against the Town of Tiburon as filed and served in the Cross-Complaint in the above entitled matter.
I agree to dismiss the cause of action of Indemnity against the Town of Tiburon, without prejudice. The
Town of Tiburon. and all of its agents agree, together and separately, not to pursue a Malicious Prosecution
action against me in response to my dismissal. Should I again, as part of the above entitled matter, bring a
.cause of action against the Town ofTiburon for Indemnity, the Town ofTiburon does not waive its right to
bring about a lawsuit against ~e for Malicious Prosecution.
Upon agreement, I will file the Request For Dismissal (without prejudice) and requisite notices with the
Superior Court of the County of Mann within five (5) working days of to day's date, or this agreement will be
deemed null and void.
