Watrous, Planning Manager Subject: Synopsis Of Town CouncillDesign Review Board Workshop Here is a synopsis of the items discussed at the Town Council/Design Review Board workshop on June 26 and the follow-up actions to be taken: 1. Shared Views Staff directed to include description of shared view concept in Hillside Guideline for borrowed views. 2. Prevailing Neighborhood Characteristics DRB encouraged to recognize that neighborhoods evolve over time and the importance of placing findings in the record 3. Review of All Property Aspects for New Applications Where appropriate, DRB should encourage "horse trading" between applicant and neighbors to solve problems, although this often has to be done at the Councilleve!. 4. Basements and Floor Area Calculations DRB should be concerned with basements as a mass and bulk issue, not an intensity of use issue. 5. Solid Fences in Front Yard Setbacks Staff directed to prepare ordinance limiting solid fences within front yard setbacks, possibly with an exceptionprocess. 6. Tree and View Issues DRB should be wary of neighbors who try to use the Design Review process to solve View Ordinance issues. 7. Green Building Staff directed to address issue of wood-burning fireplaces when developing green building ordinances. 8. Nuisances/General Property Appearance Additional policies not necessary at this time. 9. Other Discussion Topics Skylights: Continue using various methods to mitigate. Public Facilities Policies DT-35: Support an appropriate expansion of the Belvedere-Tiburon Public Library adjacent to Zelinsky Park. Implementing Programs for Public Facilities DT-u: Facilitate expansion of the Belvedere- Tiburon Public Library by employing streamlined permit review processes typically used for major public projects. At this time, the Belvedere- Tiburon Library Agency respectfully requests that the Council direct Staff to draft the implementing ordinance for Program DT -u for consideration by the Town Council. To accomplish this, the Town Council will need to pass an implementing ordinance to set forth streamlined rules to govern the process. Please be assured that Town staff intends to bring such an ordinance to the Town Council for its consideration. We anticipate this occurring in August or September of this year. Box 518 W oodacre, CA 94973 RE: FIRE ROAD REHABILITATION ON TIBURON PENINSULA Gentlemen: On June 20, 2007, the Tiburon Town Council approved the rehabilitation of fire road segments of Town open space land subject to working out of final details with the Town Staff. The Town wishes to extend its thanks to both your agencies for promoting this important fire safety effort. The Town would like to begin the coordination of the work such that it can take place in a timely manner while-protectingtr-affic-safety,' utilitiesand-resourc-e-s that-ceuld- inadvertently be compromised or damaged during the work. The Town will request at least seven (7) days prior notice such that a biologist can mark with small flags areas near (but not on) certain segments of fire road where special status plants may exist. This measure is strictly precautionary, as fITe equipment is not anticipated to stray from previously-established fire road alignments in any manner that could damage these special plants. If you have a likely start date in mind, please let me know as soon as possible. The Fire Department will need to coordinate with the Tiburon Police and Public Works Departments regarding the delivery of heavy equipment through Town streets to the fire road locations. The Town assumes that Tiburon Boulevard, Trestle G~en Boulevard, and Shepherd Way will be the route of access for equipment reaching the Shepherd Way Extension Fire Road. The Town further assumes that Tiburon Boulevard and Gilmartin Drive will be the route of access for equipment reaching both Middle Ridge Fire Roads. The Town assumes that the bulldozer will be delivered to the ridge-top via Gilmartin Drive, and will begin its work at that location and return by retracing its route. Please let me know if any of these assumptions are incorrect. The Tiburon Public Works Department will periodically have a monitor present during the work. t'ej.57 $. . .<.. Any delivery of heavy equipment to the Vistazo West Fire Road should also be coordinated with the Tiburon Police and Public Works Departments, as traffic control and vehicle size limitations need to be addressed. The Marin Municipal Water District (MMWD) has advised the Town that there is an 8- inch water main under the Middle Ridge Ridgetop Fire Road (see attached map). MMWD requests that at least one week's notice be provided prior to start of work such that USA can be alerted to mark the location of the pipe, which is reportedly only two feet below grade. MMWD is concerned that the pipe could be damaged if exposed. Shepherd of the Hills Lutheran Church will need to be contacted to gain their permission for access over and work upon their property at the end of Shepherd Way. Once these issues have been adequately coordinated with the Town Staff, the Town Manager will execute the hold harmless and right-to-enter agreements with the County Fire Department. Please call me at your earliest convenience to discuss these details. Last December, he and his son and daughter opened two DeLano's IGA grocery stores in Tiburon where the Bell Markets were previously. In all, tne DeLanos have invested time and money into eight former Bell Markets - three in San Francisco and the rest in Marin County. His talk will be about the changes that he has seen in the grocery retail industry over the 50-plus years he has been in the business. He also will discuss the products people buy and how much more educated the customers have become. Harley is in charge of finances, procedures and legal issues; his son, Dennis, is the stores' general manager; and daughter Desiree is head of human resources and community relations. . Harley has spent his entire career in the grocery business as vice president for Lucky Stores, president of ABC Markets in Southern California and president of Bell Markets and Cala Foods. He then became a consultant to five supermarket chains in California and Hawaii before retiring to his cattle and horse ranch near Auburn, California. Last year, he came out of retirement when the opportunity arose to open DeLano's IGA stores. The DeLanos are already engulfed in the community by being part of the Wine Festival and contributing to a variety of local organizations. Chair's Report Chair Otter commented that she was pleased that the library has held two family-oriented events during this fiscal year - Blackie's Hay Day and the library's 10th birthday party. The upcoming Library Society's Chocolate & Champagne party will cater to adults. 2. BTLF Report . The date for the Library Society's Champagne and Chocolate party has been changed to Wednesday, June 6th, and will honor Elaine Petrocelli. The library is open that evening so the event will take place in the Founders Room and on the patio. . The BTLF will meet in June but not in July or August. . The BTLF approved the grant of $50,000 to the library for the collection. . Trustee Falk will be the BTLA liaison at the next Foundation meeting. 3. Library Director's report - Deborah Mazzolini At this time of year the Children's Librarian Alicia Bell visits all Reed Union School District classrooms to encourage summer reading programs. She also describes and recommends the use of other library materials. Director Mazzolini noted that Ken and Joan Rosenthal made a substantial donation to the library upon the recent sale of their car. Joan's letter expressed her affection for the library and was warmly received by the Board. 4. Financial statement for April 2007 At 830/0 into the fiscal year library finances are within budget. On the revenue side, the second half of Tiburon's tax was not received until May so this bodes well for the final tally. 5. Committee Reports . The packet includes the Program Committee schedule through June. . The Film Series summary for The Damnedest Finest Ruins is reported. . The current art exhibit is by Del Mar art students. Belvedere Tiburon Library Agency May 21, 2007 Minutes Page 2 TRUSTEE CONSIDERATIONS: 8. land Negotiation Proposal from the Town of Tiburon The Agreement to Convey Real Property from the Town of Tiburon to the Library, prepared by the Land Negotiation Committee, has been reviewed by Attorney Gary Ragghianti and he has conveyed his opinion that there is nothing remarkable or disturbing about it. Congratulations are in order given that this is a major hurdle toward the expansion process. The agreement does not ask for any transfer of funds and is subject to only minor terms and conditions. Comments from the Board included questions about the use of meeting space once completed. The Town will be given priority over other non-Library users and that use will be provided at no cost. The Library Director made it clear that this would not be a problem and that currently the Town uses the Founders Room on occasion for various meetings. The Army Corps of Engineers will soon submit their report that the water level of the drainage ditch is at an appropriate level. In 2004 the Initial Study was completed and accepted by Tiburon Town Council and given the status of a Mitigated Negative Declaration. A motion to accept the Agreement to Convey Real Property made by Trustee Fong and seconded by Trustee Kuhns was approved unanimously. 9. Belvedere Community Foundation Vote of Support Many thanks were expressed by the Board for the Belvedere Community Foundation's $100,000 seed money, payable over four years, for the expansion. This donation and the conveyance of the land are taking the project to a whole new level of support. 10. Building Program Planning Update The letters of interest from architectural firms have been received. The Architect Selection Committee will choose semi-finalists and visit one of each firm's projects with their representative. They will then narrow down their choice to three that will make a presentation to the BTLA. Stephanie Pug ash has joined the Committee. 11. Building Maintenance Program Update The shingle cleaning/staining and trim painting project has begun. The cleaning has been completed and made a noticeable difference in the appearance of the building. A new slurry seal will be applied to the parking lot in June. The Children's patio will be cleaned in time for the Library Society party. 12. Preliminary Budget FYE June 30, 2008 The Library is estimating a 60/0 increase in tax revenue for the coming fiscal year. With other anticipated revenues, the income after debt service will be approximately 7% higher for FY07/08. The salaries and wages (line item 7010) budget shows a pre-COLA 50/0 increase due to the additional hours approved by the BTLA this year for a Young Adult Librarian. This includes a two- hour a week increase for four staff members. The bottom line does not include the new expense line for project development costs for a mobile office and two salaried positions. At this point it is unknown how much the selection of the architect will cost. Belvedere Tiburon Library Agency May 21,2007 Minutes Page 3 13. Personnel: job description and position approval Director Mazzolini distributed a revised draft of a job description for the Capital Campaign Manager that was written with the assistance of Chair Otter and Sharon Kahn. This position will report to the Library Director. It was recommended that a confidentiality clause be added since this employee will be privy to private information of potential donors. The question of how long the contract should be in effect was discussed. From a legal standpoint Trustee Kuhns recommended a one-year renewal contract to start. Stephanie Ziegler, applicant, noted the new location had many more advantages such as ground floor parking, nicer bathroom facilities, better location and ground floor access. She confirmed with Commissioner Collins that the parking situation would be much more desirable, as they would no longer need to validate parking for customers. Chair Fraser closed the public hearing. Commissioner O'Donnell supported the draft resolution, stating that this was a good business in a nice location. Vice Chair Aguirre stated that this was a sound business, and would be consistent with the Town's direction to promote such uses downtown. Commission Collins agreed with the comments of other Commissioners and asked that a reference to the location of the two employee parking spaces allocated to a remote parking lot be included in the resolution. ACTION: It was MIS (Collins/Aguirre) to adopt the draft resolution conditionally approving the project, as amended to identify the addition of two employee parking spaces in the resolution. Last year, PG&E's shareholders provided approximately $380,000 to 63 community-based organizations and local governments to support economic and community development projects. This year's program will disburse up to $400,000 in grants to help meet more of our communities' economic development needs. We welcome both new applicants and previous recipients of charitable grants from PG&E. We intend to fund those projects that we believe hold the potential to make the greatest impact on a community's economic health, with special emphasis paid to business attraction, retention and lIgreen" business development. Qualified organizations may apply for grants of $2,500 up to $10,000 (although PG&E may fund successful applicants at amounts less than their full request). Collaboration among organizations to benefit communities is encouraged where feasible, and reviewers will look at how well proposed projects lImesh" with those of other organizations in the community. Thus, we encourage applicants to create partnerships with other economic development organizations to both maximize effectiveness and leverage the available funding. While grants can only be awarded to government agencies and 501 (c)(3) nonprofit organizations located in our service territory, an organization that is not a government agency or 501 (c)(3) may apply in partnership with a qualifying organization. FOCUS will collaborate with local governments to determine Priority Conservation Areas, based upon local plans and the results of the Green Vision project. All local governments interested in having Priority Conservation Area Designations will have the option of applying at a later date. INCENTIVES Regional agencies are working to align many existing and future financial incentives for local governments that have designated priority areas. Potential sources include future funding from MTC's Transportation for Livable Communities and Housing Incentive Program, as well as additional discretionary transportation funds from MTC's Regional Transportation Plan 2009 Update. The State is also considering aligning funding from the recently passed housing and resource bonds to regional priorities, potentially including FOCUS priority areas. LONG-TERM REGIONAL STRATEGY FOCUS is a long-term strategy, and new sources of incentives are likely to arise in the future that will be available to Priority Development and Conservation Areas. The intention of FOCUS is to target areas for development and conservation incentives for the next few decades. If a city does not receive incentives in the first round, it will remain eligible for future rounds of funding as available. There will also be opportunities for other cities to apply for priority area designations if they do not participate in the first round of applications. ADDITIONAL ASSISTANCE Priority areas will also be focal points for regional agency efforts. Regional agencies will offer services to assist local governments with priority area planning and development activities. Having a regional strategy to target investments and assistance in these areas will make our comlnunities stronger and advance protection of our natural areas and working lands. By working together, local and regional partners can collectively move forward to address growth and conservation needs for future generations. As part of the FOCUS Prograln, nominations are now being accepted for regionally designating priority conservation areas in the San Francisco Bay Area that contain lands important for protection via purchase fee title or easement within the next few years. Priority conservation areas are areas of regional significance that have broad community support and an urgent need for protection. These areas will contain important agricultural, natural resource, watershed, historical, scenic, cultural, recreational, and/or ecological values and ecosysteln functions. Knowing the region's near-term conservation priorities for targeting protection efforts will promote collaboration and investment in these areas that are critical to the region's quality of life and ecological diversity. The identification of the region's conservation priorities is an ongoing process and involves n1any regional and local partners. The FOCUS Program has been working closely with the Bay Area Open Space Council and Greenbelt Alliance who are leading a complementary, collaborative process called Green Vision. Green Vision is bringing land use planning and land conservation professionals together to craft a long term vision for protection of important conservation areas throughout the Bay Area by acquisition and policy. The fair housing organizations investigated 35 apartment complexes in California, Arizona, Nevada, Texas, Kansas, Georgia and Florida, all of which failed to meet the accessibility requirements of the Fair Housing Act and the Americans with Disabilities Act. These 35 properties, totaling more than 10,000 individual apartment dwelling units, represent only a sample of the at least 84 Spanos properties that are covered by the federal Fair Housing Act. The Fair Housing Act makes it illegal to discriminate based on race, color, national origin, religion, sex, disability or familial status. Since 1991, AG Spanos has engaged in a continuous pattern and practice of discrimination against people with disabilities by designing and/ or constructing multifamily dwellings with significant design flaws that render them inaccessible to people with disabilities. Examples of accessibility barriers include no handicap parking spaces, steep slopes, steps instead of ramps, narrow door widths and passageways, insurmountable thresholds, arid' inaccessible bathrooms and kitchens. Still others place environmental controls and electrical sockets beyond the reach of wheelchair users, and have constructed leasing offices, common restrooms, recreational and entertainment facilities in such a way to make them inaccessible to wheelchair users.
