The Association of Bay Area Governments (ABAG) has released preliminary regional housing needs numbers for Bay Area cities and counties for the next housing element cycle (2007- 2014). Final numbers are expected in July 2007. The preliminary numbers for the Town of Tiburon are shown below in comparison with numbers for the current cycle (1999-2006). Work on the state-mandated Housing Element update will begin this coming fiscal year (2007- 2008), The Town will need to identify new potential affordable housing sites, increase units totals on currently designated affordable housing sites, or a combination of both in order to adequately identify suitable sites for affordable housing production and maintain a state-certified Housing Element. A table showing preliminary numbers for all cities in Marin County is attached. Subject: Invasive Plant Species on the Tiburon Open Space Parcel The Peninsula Middle Ridge, Tiburon As a resident of Tiburon since 1972 and as a professional botanist (LSA Associates, Inc. Environmental Consulting, Pt. Richmond, CA), I would like to draw your attention to changes in vegetation that are occurring as a result of the invasion of non-native plants species on the above-referenced property. The portion of the Middle Ridge of concern is located to the west of the Hacienda Drive fire-road, between Hacienda Drive and Gilmartin Drive (see aerial photograph). This section of the Ridge supports three federally- and State-listed threatened and endangered species, [Tiburonjewel-flower (Streptanthus niger), Tiburon paintbrush (Castilleja affinis ssp. neglecta), Marin dwarf flax (Hesperolinon congestum)]. The species are restricted to serpentine soils; Tiburon jewel-flower is restricted to the Middle Ridge and the southern part of the peninsula French broom (Genista monspessulana), a known invasive species, was planted, mainly on the south side of Gilmartin Drive, to prevent soil erosion for the residential development in the 1960' s-70' s. It has since spread to the open space on the north side of Gilmartin Drive. This species along with pampas grass (Cortaderiajubata) are rapidly spreading into rare-plant habitat on the Ridge. Because these two non-native species have no "natural" enemies, they spread at the expense of native specie~ and, on the Middle Ridge, into sensitive serpentine grassland habitat. Serpentine crops out in three places on the Tiburon peninsula: 1) on the southern portio~ near Old St. Hilary's Church; 2) on Ring Mountain; and, 3) on the Middle Ridge. .Due to recent land use issues on the southern portion of the peninsula, t~e occurrence and habitat of rare plants have received much attention; French broom and pampas grass are being removed from this area by volunteers. The Marin County Open Space District is in the process of developing a management plan for Ring Mountain, in order to preserve the rare plants and their habitat in that area. The condition of the rare-plant populations and their habitat on the Middle Ridge has, however, gone unnoticed. In my opinion, the three rare plant species that occur on the Middle Ridge are severely threatened by pampas grass and French broom. The invasion by the non-native species have reached such proportions that a concerted effort between the Town and a work crew with equipment suitable for the removal of the large plants is necessary to restore the ecological balance in the area and to protect the habitat arid the rare plant populations. .-/ Furthermore, large Monterey pines (an invasive tree species) present on the western slope (just below the escarpment) are mostly dead or dying, therefore, in addition to encroaching upon the habitat of rare plants they are also creating a fire hazard. Numerous seedlings/saplings and smaller trees have established in this area of the Middle Ridge. These trees should be removed before the non-native habitat created by the pines spread any further. I believe that it is our moral obligation when acquiring land as Open Space to be good stewards of that land. We talk much about our historical heritage in this town. After consulting with the former Chief of Police and our own legal counsel, we have sought to identify the lines with signage that we considered (in keeping with the "good neighbor" traditions of the Town of Tiburon) the least visually obtrusive. Unfortunately, such signage has been repeatedly removed and/or destroyed. We have found ourselves in a position of continually replacing removed and destroyed property at considerable expense in both time and money. Sadly, the signage alone did not seem to accomplish our objectives, therefore we installed a low profile black colored fence. Again, due to vandalism and theft, we were faced with continually replacing the fence at considerable expense in time and money. We are writing to inform you about several matters that should be clarified. The use of the concrete driveway on our property in front of the McIntire residence has been granted to them exclusively through an easement that has been recorded. They and their guests have full legal rights and authority over that portion of our property per the terms of that easement. A copy of the parcel map and the legal easement has been provided to the local police department. New signage will be installed directly on the property line so as to clarify where our private property line is designated. Further, the Tiburon Police Department has been appointed as our agent in enforcing the "No Trespassing" on the land that belongs to'St. Hilary Church. Chair's Report On behalf of Chair Ann Otter, Library Director Mazzolini reminded the BTLA of the Birthday Party on Saturday, April 21. 2. BTLF Report - Carol Kurland · The Petrocelli Luncheon was a complete success - sold out, smoothly run, and beautifully set. . The 10th birthday party for the Library will be held April 21 st. · The Library Society's Champagne and Chocolate party is on June 4th. 3. Library Director's report - Deborah Mazzolini · Items of relevance are on the agenda. 4. Financial statement for January 2007 Tom Perot reviewed the financial statement through March, 2007, highlighting the ERAF (Educational Revenue Augmentation Fund) revenue that has been received and noting that the next major tax revenues will be received later in April. The operating budget is on target at 700/0 expended. Questions were raised by BTLA members about ERAF. The City of Belvedere and the Town of Tiburon are assessed at a little over 11 % while the Library is assessed at 380/0. This greater assessment is due to the fact that the Belvedere- Tiburon Library was originally a part of the Marin County Library System which is a special district. The BTLA asked that information on ERAF be sent to both Steger Johnson and Bill Kuhns for their review. 5. Committee Reports · The Film Committee will screen the movie 1906: The Damnedest Finest Ruins on April 27. The Director reviewed the evaluation summary that is done by the Film Committee at each showing. · The Program Committee has a full schedule of events to offer during the next few months. A calendar of their upcoming events is in the BTLA packet. · The Art Committee is holding a reception on Tuesday, April 17, for the watercolors currently on exhibit by Roberta Keiler. Approval of warrants and in house check registers dated January 2007 A motion to approve the Consent Calendar made by Trustee Johnson and seconded by Trustee Epstein, passed. Belvedere Tiburon Library Agency April 16, 2007 Minutes Page 2 TRUSTEE CONSIDERATIONS: 8. Staff Department Report - Jacki Schafer, Young Adult Services Young Adult Services Librarian Jacki Schafer was introduced to the Board. Library Director Mazzolini informed the Board that Jacki was appointed in September, 2006, and has already had a major impact on teen services. In addition to the good work she has done for the teens, Jacki also works several hours a week on the Reference Desk. Jacki reviewed the unique patterns of teens, noting the big difference in needs between an eleven year old middle-schooler and an eighteen year old high-schooler. She has developed programs that can include these age ranges. The goal is to get the kids into the Library by structuring programs that are educational and entertaining. There is a Youth Advisory Committee that meets once a month and recommends programs and materials of interest. On Tuesday afternoons Jacki has started a Teen Drop-in study program in the Founders Room. Kids are coming in to do homework, group study, and to socialize. There are programs that encourage positive socialization and anime movie nights. Jackie noted the new space for her desk and the alcove area for teens to use. The collection in that area houses materials of particular interest to teens, including college catalogs, graphic novels and manga, and books written for that age group. It is a challenging age group, but interesting and fun. Jacki noted that teens really want to be listened to, respected, and given a place where they can comfortably gather. Director Mazzolini also informed the Board that in addition to the work that Jacki is doing at Reference and for Young Adult services, she also has created the new signage that is now displayed throughout the Library. 9. Building Program Planning Update The Library has received letters of interest and architectural qualification packages from fourteen architectural firms. Currently Jim Levorsen, Hank Bruce, Rita Fink, and Director Mazzolini are reviewing the submissions. The Architect Selection Committee will then meet to further the review and develop a short list for further consideration. The Town of Tiburon is in the process of developing a proposal on the land behind the Library. After that is received, which should be by the end of April, a date will be set for the negotiating committee to meet. 10. Building Maintenance Program Update A request by the Town of Tiburon to slurry seal the parking lot later this spring was discussed. A motion to approve the project in conjunction with the Town of Tiburon in the amount of $5,944 was made by Trustee Fong and seconded by Trustee Kuhns. The Bo~rd approved the motion, The shingle cleaning, staining, and trim painting is scheduled to begin during the week of May 1, 2007. 11. Preliminary Budget FYE June 30, 2008 The Library is estimating a 60/0 increase in tax revenue for the coming fiscal year. This draft also includes other anticipated revenues for FY07/08. As usual ERAF has not been budgeted. This draft of the budget does not yet include a cost of living adjustment (COLA). The salaries and wages (line item 7010) budget shows a pre-COLA 50/0 increase due to the additional hours approved by the BTLA this year for a Young Adult Librarian and small increases in staff hours that reflect actual hours worked. This includes a two-hour a week increase for Mary Vella. The new expense line for database development and a development consultant is not yet included in the bottom line expenditure. COLA for California/SF for 2006 is approximately 3.60/0. For all past budgets, that has been the statistic used by the BTLA for cost of living adjustments to the step and track amounts. Personnel: Staffing Director Mazzolini reviewed the staffing recommended for the Library in order to prepare the Library for a fund raising drive. The BTLA previously approved a position for database coordinator. After discussions with four Fund Raising Consultants, it become apparent that the Library needs to do some organizational and planning work before moving forward on a major donor initiative. This includes budgeting for a person, on a contractual basis, to prepare the Library for a capital campaign. Director Mazzolini distributed a very rough draft of a job description. After a lengthy discussion, the BTLA members stated their agreement with moving in that direction. A final job description will be written for approval of the BTLA at their May meeting, 13. Policy on Use of the Study Room Director Mazzolini noted that there is competition for the use of the Study Room and in order to accommodate local student after-school use, she suggested changes to the current policy. There are very few study rooms in the area and the Library is getting usage requests and signups from many out-of-town tutors and others who stay in the room for long periods of time. The changes would give priority to local student use and limit the number of hours a room can be used. Mary Falk, organizer of the Library's Netsharks, noted the need for the Netsharks to occasionally use the study room for training. Director Mazzolini informed the BTLA that the policy gives prime consideration for use of the study room to library needs which covers the use of the room by the Netsharks. This law, which the Board of Supervisors enacted in response to public request, received very positive responses from citizens all throughout the county, even those who are not protected by the new law. We have received requests for the ordinance and implementation materials from several counties in California, including Contra Costa County, Sutter, Mendocino, Humboldt, Alameda, and Sonoma Counties. The City Council of Novato will consider a similar ordinance on June 19, 2007. Over 60 California communities have now updated their smoking ordinances to include additional outdoor smoking restrictions based on recent studies - the CAL-EPA Air Resources Board and Surgeon Generals' reports both showed that there is no safe level of exposure to second hand smoke). Because the business education program went so well, no citations have, been necessary. Our office mailed over 3,000 business information kits to businesses that are located in County, Unincorporated areas. These kits included a smoke-free self sticking decal, similar to the heart shaped ones used by cities in the 1990's based on Novato's model. We also set up a website to help the public understand and comply with any new tobacco control laws enacted by jurisdictions throughout the county. (We will include your city once you update your smoking law). This website received over 29,660 visitors in just 90 days, and we are developing a case study about how to publicize new ordinances with easy-to-remember websites. The scientific criteria that now enables municipalities throughout California to restrict smoking in outdoor public places (entrances, . cafes , etc.) is also located on this website: www.smokefreemarin.com An interesting and humorous side effect of the ordinance (and the reason for this memo): our office has received requests for close to 400 no-smoking decals 5/29/2007 Page 2 of2 from businesses in towns and cities around the county. These businesses are not in County, Unincorporated areas - these businesses are in your communities. They were disappointed that the law did not pertain to them. So nearly 400 decals are posted on entrances in businesses throughout our county by business owners who want to pretend that the law applies to them! (Compliance should be smooth since your businesses are complying before your city passed the law). Using State Department of Health Services funds, we purchased enough signs for the business owners in your communities, but we prefer to provide these to your businesses after your city council updates its smoking ordinance. Our state plan enables us to provide staff support to each city council prior to enactment as well as during the implementation and enforcement period. We will continue, as we have for the past 17 years, to help educate your businesses and write educational warning letters to businesses to help them comply with your new law following enactment. This results in 990/0 compliance (Marin has the highest compliance rate in California with smoke-free laws). During the 1990's all our local jurisdictions enacted similar smoke-free laws. This uniformity helped streamline implementation and enforcement as well as inspection for restaurant inspectors. M::ly 17, 2ffJ7 Dear City and County Officials: In 2005, the California Air Resources Board (ARB or Board) approved a regulation to reduce toxic diesel particulate matter (diesel PM) emissions from diesel-fueled public agency and utility fleet vehicles beginning in 2007. Diesel PM, the tiny soot particles from diesel engines, was identified as a toxic air contaminant in 1998. Exposure to diesel PM is a significant health hazard, particularly to children whose lungs are still developing, and the elderly who may have other serious health problems. Each year in California, diesel PM contributes to 3,700 premature deaths, 2,200 hospital admissions, 100,000 asthma attacks and respiratory symptoms, 8,500 cases of chronic bronchitis, 620,000 lost workdays and 3.6 million minor restricted activity days. Reducing exposure to diesel PM is one of ARB's highest priorities. The Fleet Rule for Public Agencies and Utilities regulation is particularly effective because it reduces diesel PM concentrations in the heart of residential communities where municipal and utility vehicles frequently conduct business. But while the regulation brings significant clean-air benefits, it also brings cost increases to municipal fleet administrators, who already may be on very tight fiscal budgets. Depending on the age and type of vehicle, implementing the regulation can average from $3,000 to more than $40,000 per vehicle. During the development of the regulation, one of the major issues of concern was how a municipal fleet administrator would pay for the cost of the regulation. The Board shared this concern, and approved modifications to the regulation with this in mind, including extending the initial compliance deadline for most fleets, and allowing low-population counties additional time to budget and plan for the cost of compliance. The first implementation deadline of the regulation is December 31,2007, when twenty percent of a municipality's vehicles between the model years 1960 through 2002 must be in compliance with the regulation. As both elected county officials and Board members, we understand compliance by many municipal fleet administrators will be challenging. Because of this, we encourage county and city governments to support the efforts of their municipal fleet administrator in complying with this regulation.
