TOWN COUNCIL
MINUTES
CALL TO ORDER
Mayor Gram called the regular meeting of the Tiburon Town Council to order at 7:30 p.m.
on Wednesday, September 5,2007, in Town Council Chambers, 1505 Tiburon Boulevard,
Tiburon, California.

ORAL COMMUNICATIONS
Linda Dolan, who said she represented the residents of 4 Lyford Drive, complained of the use of
the cut-out at Lyford Drive as a construction staging area. She referenced a recent article in the
Ark on the subj ect.
Ms. Dolan said that the problems associated with using the area for staging were affecting the
health and property values of the residents. She said that she had a petition with 24 signatures of
residents of2 and 4 Lyford Drive protesting the continued use of the area for this purpose. She
said that she looked forward to an amicable resolution of the problem with Town officials.
Mayor Gram asked Ms. Dolan whether she had had any written communications with Town
Staff. Ms. Dolan said that she had been in contact with Director of Public Works/Town Engineer
Nguyen and Town Manager Curran.
Tom King, resident of 4 Lyford Drive, said that his son, Tommy, son had serious allergies which
were exacerbated by the dust which was stirred up from the use of the area. He said that he
hoped these activities would be curtailed in the future.
Jeff Clark, 4 Lyford Drive, resident since 1992, said that the issue had come and gone over the
years and that the new Town Manager and Director of Public Works had "walked into" the
situation. He said that use of the area for long-term public works' projects had become

"oppressive." He said that when there weren't town projects, the area became a staging area for
moving vans and other commercial vehicles. He reminded the Council of the 2001 resolution
which restricted all of these uses in the area.
Mr. Clark asked that the Council adopt a policy to "take the area off the table."
Mayor Gram encouraged the residents to keep communicating with Staff who would advise the
Council further on the matter.
APPOINTMENTS TO BOARDS.. COMMISSIONS & COMMITTEES
Heritage & Arts Commission - One Vacancy
Town Clerk Crane Iacopi said that the applicant, Barbara Tomber, had been previously
interviewed for a position on the Library Agency Board. Ms. Tomber had subsequently applied
for the vacancy on the Heritage & Arts Commission upon the resignation of Chris Morrison.
The Town Clerk said that there had been expressions of interests from several other people but
no one else had applied for the opening.
Mayor Gram noted that the Council had appointed Bev Johnson to the Library Board but had
asked Ms. Tomber about her other interests during their interview. He said that she was well
qualified for the position, based on her past experience in another city.

Mayor Gram said that Item No.4 had been removed from Consent at the request of staff; Town

Fredericks.

PUBLIC HEARINGS
1. Tiburon Tourism Business Improvement District (TTBID) - Consideration of Second
Reading and Adoption of Ordinance to Establish District (Town Attorney Danforth)
Town Attorney Danforth said that the ordinance had come before Council at tl?e request of the
two [hotel] businesses in town, and had passed first reading by the Council on August 15, 2007.
She said that second reading and adoption was the next step in establishing the district, which
would be followed at a later date with an appointment of an advisory committee.
Mayor Gram opened and closed the public hearing. There were no comments.

expansion and location of approved building envelope for existing single-family dwelling

Director of Community Development Anderson said that the proposal before the Council was to
expand the building envelope to conform to the actual location of the house which was located to
the east of what had been approved, and to accommodate a proposed new deck and stairway.
Anderson said the Planning Commission had held a hearing on the matter and had recommended
adoption. He said there was no public opposition to the amendment.
Councilmember Smith asked how the house could have been built in other than the approved
location. Director Anderson said that Staff had researched the Town's files and that there was no

paper trail to indicate how this had happened 28 years ago.
Councilmem~er Berger said that it would be difficult for such a scenario to occur now because
project applicants are required to stake the corners of the building envelope. Director Anderson
added that the Town has provisions for both vertical and horizontal controls to be verified by
survey at the appropriate stage of construction.
Mayor Gram opened the public hearing.
Architect David Holscher, representing the applicant, said that regulations adopted within the last
four years required that a foundation [location] be re-surveyed before framing of new
construction, in addition to a vertical survey.
