Dear Ms. Curran,
Thank you for your communication and time schedule for the completion of our project,
The first block of Centro East has 15 utility boxes [ manholes) which had to be reset
because of the asphalt paving. A rather messy and not very nice system to patch after
the work is complete.
All 15 boxes look patched but our box in front of 2070 Centro East is the messiest of
all. Concrete 'milk' and spillage is all around. Cars driving by pick it up and spread it.
Please ask the contractor, Ghilotty, to clean the street around the box. If he using
muriatic acid not to dump it into our planting at the side of the road but to suck it up.
There are clean ways to do it.
It is bad enough that we have to live with these awful patches. Please help us. Thank
you for your understanding.

You are correct that it is messy situation.. We (Rocco Colicchia - Harris &
Associates and I) are working with AT&T to resolve all bad AT&T boxes with
the first priority being the noisy boxes on Paradise. Rocco is working on getting
AT&T's concurrence to a substitute "super-duper frame and lid" (my words) to
replace the AT&T frame and lids that are failing. We will resolve the box
situation you are referencing but it maybe up to February 2008 for the resolution
to be in place.

There is a color difference between the recent overlay and the more recent asphalt
concrete collar (underneath is a cement concrete collar). The asphalt concrete
collar helps to "lock-in" the boxes that have been raised to grade. This difference
in color will gradually disappear as the asphalt concrete ages (bleaches out) and
will be hardly noticeable in maybe 6 to 10 months.
The trench plates tend to move as vehicle traffic goes across the plates and have
to be re-secured via asphalt concrete berming every so often. We will have either
Maggiora & Ghilotti or our street crew clean up around the box/trench plate
situation in question. Thank you for your letter.

COMMISSION AND STAFF BRIEFING
Staff Update - Community Development Director Anderson gave the following report:
· The Ling project has been re-submitted and the addendum to the EIR has been
sent out to the EIR consultant and they are underway on it;
· The Parente project has returned with a scaled back design, and this project is also
out with the consultant for an EIR addendum;
· The Alta Robles project, for which a scoping meeting was held in August, will
have story poles up in early October as well as the staking of the roadway. Staff is
anticipating the scheduling of a field trip for sometime in mid-October. Staff will
also receive a mock-up of the EIR format for the project which will be made
available to Planning Commissioners to review;
· The public pathway improvement plans for the Ho lot split project, located
between Mar West Street and Esperanza Street, have been received. A condition
of approval required the applicant to return with details of the path improvements,
which will be coming before the Commission on September 26 or October 10,
2007, prior to the parcel map proceeding onto the Town Council;

. Staff has received the Design Review application, which is still incomplete, for
the Kol Shofar synagogue expansion project. That application will most likely
will be heard by the Board sometime in late October or early November.

PUBLIC HEARING
1. 1501 TIBURON BOULEVARD: RECOMMENDATION TO TOWN COUNCIL
ON A ZONING ORDINANCE AMENDMENT IN THE FORM OF ADOPTION
OF AN ORDINANCE ESTABLISHING A STREAMLINED DEVELOPMENT
REVIEW PROCEDURE FOR.THE BELVEDERE-TIBURON LIBRARY
EXPANSION PROJECT; Belvedere- Tiburon Library Agency and Town of
Tiburon, Owners and Applicants; Assessor's Parcel Nos. 058-171-62 (portion),
and 058-171-93 and 058-171-94
Community Development Director Anderson said it has been the Town's practice to
adopt streamlined processing procedures for major public projects, based on the fact that
time and scarce public resources will be saved by having such streamlined procedures.
Similar procedures were adopted for the Town Hall project, the Police Station and for the
original Belvedere- Tiburon Library construction. The streamlined process for the library
expansion was placed into the General Plan when it was adopted in 2005, and the
program and policy that discuss the streamlining process are included in the written staff
report.
Director Anderson said under current regulations, the library addition would be required
to go through a conditional use permit process by the Planning Commission, and a site
plan architectural review process by the Design Review Board before proceeding to
building permits. Under the proposed streamlining ordinance, all of those powers and
authority for review of the project would be vested with the Town Council, which would
be required to hold at least one public meeting and review plans for the project. The
Council has the ability to refer the project to any of its commissions or boards for
comment. Anderson emphasized that in conducting its review and evaluation of the
project, the Council shall utilize the standards and criteria that the Planning Commission
and Design Review Board would have normally applied absent the adoption of the
streamlined procedures.
Staff has prepared a resolution and a draft ordinance attachment, which is the proposed
streamlining ordinance. The Town Council is scheduled to consider the matter next week
at its meeting on September 19, 2007. Staff's recommendation is that the Commission
hold the public hearing, take public comments, and then move to adopt the resolution
recommending approval of the streamlining ordinance to the Council.

Director Anderson noted the receipt of a late correspondence from Stephan Volker
opposing the adoption of the ordinance. He said the letter raises legal issues that will be
considered by the Town's legal counsel and by the Town Council at its hearing.
Public Comments:
Mary Falk, Chair of the Library Agency Board, thanked the Commission for considering
the request for the streamlining permit process for the expansion project. They are
grateful to the Town staff and officials for everything they have done in its quest to
provide the best possible services for its residents.
Alan Fenster expressed opposition to the streamlining ordinance and asked that the letter
from his attorney, Mr. Volker, be made part of the record.
Vice-Chairman O'Donnell asked Mr. Fenster ifhe was a party to the earlier lawsuit
against the library. Mr. Fenster confirmed that he was a litigant in that case. '
Commissioner Collins referred to the letter of opposition dated July 25,2007, noted it
had been made part of the record, said he had not reviewed it and felt the Town's legal
counsel would review it prior to the Council meeting. Regarding staff s recommendation,
he felt it conformed to the general plan and he supported its approval.
Commissioner Kunzweiler echoed Commissioner Collins comments, said he was in favor
of the streamlining process, noted some of the Planning Commissioners were the author
of the general plan, agrees the library is an essential project and the process should be
done as fiscally soundly as possible. He said this does not mean steps will be ignored.
He expressed confidence in the ability of the Town Council to review this project and
noted that most if not all of the Councilmembers had served on Planning Commission
and/or Design Review Board at one time. He voiced his support for adoption of the
resolution.
Commissioner Fraser said he had also not reviewed the letter of opposition and echoed
fellow Commissioners' comments in support of approval of the resolution. He said the
Library expansion project was previously heard and there was overwhelming community
support as well as Planning Commission support for it. He noted that the general plan
incorporated the streamlining process for the library expansion and he supported it.
Vice Chairman O'Donnell said it was hard for him to justify the letter going into the
record when it was received at 4:57 p.m. today. He agreed the library was an
overwhelmingly valuable asset and its expansion is important. He said the groundwork
for development of this ordinance is well-documented and he supported the streamlining
process.

Chairman Aguirre said he was also supportive of recommending that the Council adopt
the ordinance. He would suggest that anyone in opposition would be involved in the
Council's hearings on the project. He reiterated that the project would be reviewed using
the standards of the Design Review Board and Planning Commission. He echoed
Commissioner Kunzweiler's point that the Councilmembers are highly qualified to
perform the review and he supported the staff recommendation.
Commissioners agreed the letter was received too late to be considered by the Planning
Commission, confirmed with Director Anderson that it would be made part of the record
and would be reviewed and considered by the Town Council prior to its decision.
ACTION: It was MIS (Kunzweiler/O'Donnell) to adopt the resolution as
submitted, recommending approval of the streamlining ordinance to
the Town Council. Vote: 5-0.

2. PLANNING COMMISSION MINUTES - Regular Meeting of August 22,
2007
Commissioner Kunzweiler referred to minor changes in the minutes as follows:
Change two references on Page 2, "... .business, Fitness in Tiburon..."
Commissioner Collins requested adding to the minutes:
Change Page 2, 2nd paragraph to, "Commissioner Collins inquired as to
what percentage of the applicant's clients were local residents and she
responded there were approximately 90% residents. that the source of the
business was limited to therapeutic massage through her licensing, the
business was presently referral-based, and there will typically be two
therapists at anyone time."
ACTION: It was MIS (Collins/O'Donnell) to approve the Planning Commission
Minutes of August 22, 2007, as amended. Vote: 5-0.

Re: Pending Strike at Marin General Hospital
Dear Community Leader:
Marin General Hospital (MGH) has received a two-day strike notice from the labor union that
represents our registered nurses, the California Nurses' Association (CNA). The notice indicates
that the strike is scheduled for 7:00 am October 10 through 7 am October 12. (This labor action
only affects registered nurses - other MGH staff who provide patient care are not on strike.)
Weare writing to you, as a community leader, to let you know how we plan to handle the strike.
It is the intention ofMGH to conduct patient operations as usual. All of our departments-
including the Emergency Department - will be functioning. We do not plan to transfer patients
or cancel elective surgeries or procedures.
Our number one priority during this time will be to our patients - to assure that they receive
quality, safe care.
To assure adequate nursing staff to care for our patients during the strike, MGH has made
arrangements with a national firm - U.S. Nursing - that will provide experienced, licensed nurses
during the two-day strike period.
We are extremely disappointed that the union leadership has issued this strike notice. MGH and
CNA have held 11 bargaining sessions since June, and progress was being made. The fact that
neither party has yet presented a single wage proposal makes this strike notice highly premature.
Our issue is with the union leadership - not our registered nurses. MGH nurses are dedicated,
professional caregivers and we respect their rights to collective bargaining.

Dear Ms. Peggy Curran:
As you may already be aware, it is our goal at Comcast to ensure that you office
remains informed of the programming services we offer to our customers who
subscriber to our services and reside in your community.
In an effort to successfully transition into an all Digital Network, effective on or after
October 18, 2007 we are adjusting the location of the California Channel on the Limited
Basic level of service from channel 78 to the Limited Basic + Digital level of service on
channel 108. It will be necessary for the customer to subscribe to any level of Digital
Cable service in order to view the California Channel programming.
The shared programming that currently airs opposite the California Channel on channel
78 will continue to air its content during its regularly scheduled hours.
The California Channel airs live programming whenever possible. When the Assembly
and Senate meet simultaneously, for example, we air one house live and tape delay the
other house upon conclusion of live coverage. Thus, if the coverage is not aired live, it is
aired the same day. When there are no live sessions or committee hearings, we
broadcast recently recorded hearings that we were unable to air due to time constraints.
This adjustment will not result in a price increase to the already existing price list at this
time.

Restriction of Hazardous Substances in Electronics
Dear Governor Schwarzenegger:
As part of our municipal efforts to support Extended Producer
Responsibility and as an associate of the California Product Stewardship
Council, we urge your signature of Assembly Bill 48 by Assembly
Member Lori Saldana, which will expand existing California law to
require manufacturers to phase out the use of specified, non-essential
hazardous materials in most consumer electronics, consistent with
provisions of the European Union Restriction of Hazardous Substances
(ROHS) Directive.
The California Department of Toxic Substances Control (DTSC) has
found that most electronic devices 'exhibit the characteristics of toxicity,'
and such devices are banned from disposal in solid waste landfills.
Moreover, an analysis by the California Integrated Waste Management
Board reveals that Californians discard of more than 515,000 tons of
these toxic electronics annually. The cost to local agencies of properly
managing this toxic waste stream would exceed $275 million annually.
While California has and will continue to enact and promote policies and
programs to increase the recycling of these devices, the most logical and
cost effective strategy is to follow the lead of the Europeans and phase
out the use of toxics in the first place.
There is little argument that most electronics contain a myriad of toxic
materials, including lead, mercury, and cadmium. Human exposure to
these carcinogenic substances can result in damage to the nervous,
kidney, neurological and reproductive systems. For this reason,
California has already banned the mercury and lead use in a wide
variety of consumer products. According to the U.S. EPA, approximately
700/0 of the toxic heavy metals found in landfills come from electronic
wastes. The EPA has also concluded that most landfills will ultimately
leak.

This measure builds on existing California law and will prohibit the sale of any
electronic device in the state that cannot be sold in Europe due to their toxicity.
California has a responsibility to protect public health and the environment from
the exposure of harmful and toxic materials. Following the European ROHS
directive allows for the opportunity to achieve this objective without requiring
manufacturers to create a unique product line for California. At the same time,
the adoption of this measure ensures that California does not become the
dumping ground for toxic devices that can no longer be sold in Europe.

MARIN COUNTY TITLE 22 (DEVELOPMENT CODE) AMENDMENTS
NOTICE IS HEREBY GIVEN that the Marin County Planning Commission will conduct a public hearing to
consider proposed revisions to the Marin County Title 22 (Development Code), which includes zoning
and subdivision regulations for the unincorporated areas of Marin County. The project includes proposed
amendments to Chapters 22.42 (Design Review) and 22.20 (General Property Development and Use
Standards) to: (1) clarify and expand streamlining procedures for small to modest scale Design Review
projects (as defined by limits on building floor area) subject to compliance with specified criteria and
design guidelines; (2) require Design Review for major remodels and demolition/rebuilding projects
currently subject to ministerial review that have a greater potential for resulting in community issues,
particularly in hillside areas and older neighborhoods; and (3) revise the standards and procedures for
processing deviations from setback and height standards for detached accessory structures. Copies of
the proposed Development Code amendments may be obtained from the Marin County Community
Development Agency Planning Division, 3501 Civic Center Drive, Room 308, San Rafael, between the
hours of 8:00 a.m. and 4:00 p.m., Monday through Friday (excluding holidays).
The project is exempt from the requirements of the California Environmental Quality Act (CEQA)
pursuant to Sections 15307 and 15308 of the CEQA Guidelines because the proposed amendments are
intended to strengthen and ensure consistent application of standards for the maintenance, restoration,
enhancement, and protection of natural resources and the environment.

Wednesday, November 7, 2007, in the Planning Commission Chambers (Room #328 - Administration
Building), Civic Center, San Rafael, California, at which time any and all persons interested in this matter

amendment of the Bolinas Community Public Utility District sphere of influence and the

7. Reorganization of the Lands of Von der Werth et al Including Annexation to City of Mill
Valley and Detachment from Homestead Valley and Almonte Sanitary. Districts,

Executive Officer's Report and Recommendation: Proposed Annexation of
the Lands of Hill to Sanitary District # 5 (File # 1286)
Summary
The applicant requests annexation of 0.84 acres developed with one single-family residence
to the Tiburon Sanitary District. The proposal area is unincorporated territory, located in
the vicinity of Paradise Lane and T eaberry Lane on the north side of the Tiburon peninsula.
The purpose of the proposal is to extend the District's public sewer to replace an existing
septic system. The affected parcel adjoins several other Teaberry Lane vicinity annexations
approved by the Commission since 2002 that were associated with construction of the Shaw
sewer extension.
The proposal area is not contiguous to the boundary of the Town of Tiburon. In order to
comply with the terms of LAFCO's Dual Annexation Policy, the Town recommends that
property owners be required to enter into an agreement with the Town of Tiburon to
provide for the future annexation to the Town, as has been the practice in recent similar
annexations. Staff recommends approval subject to standard terms and conditions.

County Community Development Agency (CDA)
County CDA staff reports that the proposal area is designated SF3, 1 unit/1 to 5 acres in the
County's General Plan and ML (medium low density residential) in the Town of Tiburon
General Plan. Zoning for the area is R1-B4 single family residential (1 acre minimum lot
size) .
County Environmental Health
The Environmental Health Division reports failure of septic systems on nearby parcels due
to aging systems, steep slopes and poor soils. Upon connection to the public sewer,
applicants will be required to obtain a permit to abandon the existing septic systems.
Town of Tiburon (Community Development)
"The Town has no record of an 'annexation agreement' existing for this property. The Town
of Tiburon would support a LAFCO deferral of the dual annexation policy provisions for
this application provided that such agreement is secured and recorded."
Tiburon Sanitary District
The District has given written consent to the proposed annexation and waived protest
proceedings.
Discussion
The proposal area is located in the unincorporated Paradise Drive area on the Tiburon
Peninsula on Teaberry Lane. The applicant seeks public sewer service to replace an on-site
wastewater system for an existing single family home. Neighboring residences on Teaberry
Lane are already receiving service from Tiburon Sanitary District. The District has sufficient
treatment capacity at its Paradise Cove plant to provide service. The area is within the
adopted sphere of influence of Sanitary District #5.
The proposal area is not contiguous to the boundary of the Town of Tiburon. In order to
comply with the terms of LAFCO's Dual Annexation Policy, the Town recommends that
property owners be required to enter into an agreement with the Town of Tiburon to
provide for the future annexation to the Town, as has been the practice in recent similar
annexations.
Environmental Review
This proposal is exempt from the provisions of the California Environmental Quality Act
(CEQA) under Section 15319 of the State CEQA Guidelines which provides exemption for
annexations involving areas developed to the density allowed by the current zoning.

Recommendation
Sanitary District #5 has sufficient treatment capacity available to provide service to the
proposal area: The proposal is consistent with the adopted sphere of influence for the
District. Staff recommends approval subject to standard terms and conditions for the
implementation of the Dual Annexation Policy as stated below.
Recommended Commission Action, by Resolution:
1. Adopt a resolution making determinations approving the proposed Annexation of the
Lands of Hill to Sanitary District #5 (File #1286) subject to the following conditions:
A. Proceedings for annexation shall not be completed until the property owner and
the Town of Tiburon execute and record an agreement wherein:
1) The property owner agrees on behalf of himself, his heirs, successors and
assigns that, in the event any future proceedings for the annexation of the
property to the Town of Tiburon shall be initiated by the City, the owner shall
neither directly nor indirectly oppose or protest such annexation; and
2) That the owner agrees that his obligations under the agreement shall run with
the property and that the property shall be held, conveyed, hypothecated,
encumbered, leased, rented, used and occupied subject to the provisions of the
agreement and that the obligations undertaken by the owner shall be binding
on all parties having or acquiring any right, title, or interest in the property.
B. The applicant shall provide a map and legal description conforming to the standards
of the State Board of Equalization as determined by the County Department of Public
Works.
2. Authorize staff to initiate subsequent proceedings pursuant to Government Cqde 957000
without notice and hearing.

Tiburon Sanitary District

Beginning at the most southerly corner of those certain parcels of land annexed to
the Tiburon Sanitary District (TSD) as Annexation Mapping No. 18/20 and LAFCO
File 1231:
1 .) thence along the southeasterly line of said TSD Annexation, North 070 1 5'
East 266.60 feet to the centerline of Teaberry Lane;
2.) thence, along said centerline and annexation line, South 580 41' East 13.86
feet;
3.) thence along the arc of a curve to the left, tangent to the preceding course,
with a radius of 200 feet, through a central angle of 240 22', an arc length
of 85.06 feet;
