Dear Heidi and Nick,
Weare now eight weeks away from completion.
The boat bench took two weeks longer than expected to form, wiping out any of our cushion for timing.
Complex curves are not easy to make or predict timing for. We may never do another one, it has been
so hard. However, we are hoping they meet our museum-quality expectations.
We intend to get everything done on the plaza by the 8th of September, as previously stated, and then
come in two weeks later with the sails to install. This might work out better for the unveiling, as we
can keep them covered for a few days right up until the dedication. We can talk about whether to turn
the fountain on in the meantime (from the 8th to the 30th) or to leave the water off for a grand splash on
opening day. Let me know what you think.
The sails are coming along finally. The question of whether they could even be made with the
programming information we have has been answered. Yes, it is possible. Sail number one has been
cut and bent and tack welded. With a few adjustments we are moving forward with sail number two.
Sail number five is waiting for special stainless in a roll (since it is over 12-feet tall). This we have
been waiting two months for! (Plus stainless steel has gone up 30% in these last two months!) If it
doesn't come in during the next two weeks, we may need to splice together this last sail. Hopefully, this
won't be the case, as it will show slightly and be much more work.
The dedication plaques of Laleh's are being made. The sail attachments are being made. The timing
mechanism for the sails is just awaiting the sails for testing. We are moving forward on all fronts.
The only item we are putting on the back burner is the grating around the lower pool bottom. It is an
extra that we want for ultimate safety, but is not required by code (since the water is under 18" in
depth). Should we fall further behind in timing, we can put these in after the dedication. If we stay on
track, they will be in sooner. This item is our one-week cushion.

Corrected Re-evaluation of Minimum Current Resale Price of
BMR Unit (6 Marsh Road) with Documentary Proof and Verification
Dear Town and Authority:
The Town Resale Price evaluation of July 2, 2006 per your determination was $161,435. This was
done on~, arbitrary and unspecified 4% simple interest basis.
The method of tabulating 4% per annum is generally understood to be as normally compounded at
4% per annum consistent with a normal real estate 10an, tt;deral bond rates and certificates of deposit and
other normal banking rate~ e
The unspecified and arbitrary tabulation formulated is unfair, unreasonable, and exploitive. It
causes undue 10ss to the seller and unwarranted, unjust enrichment to the Town as purchaser. It is not
consistent or jn line with the median income tabulation of $209,466 upon which the original sale was
based. Your present calculation is unacceptable.
The 4% per annum minimum guaranteed increase was introduced to prevent unjust 10w sales price
and provide the sellers a just price to be transferred to the next median income buyer, which would be
based on the increase in median income is $209,466.
The professional real estate and bank calculations on normal 4% p~ annum basis is on the full or
total purchase cost ($97,434.90, enclosed) and at 4% per annum for 19 years amounts to $205,279.
This is completely in line with the original median income price and the unit should be resold for
that amount without profit to the Town. Please correct your tabulation formulation accordingly. If you do
not comply with this, I request documentary proof in accordance with the Freedom of Information Act.
This is to verify the exact source, meaning, and specific formulation and intent of the inteIjected 4% per
annum minimum resale price. I believe the intended 4% per annum formulation was intended to be
equitable and fair rather than exploitive.

Mr. Herold:
The Housing Authority has advised us of your request for a determination of the
current resale price of the above property based on the Deed Restrictions recorded
with the property, and an initial purchase price of $91 ,900 on 8/11/87. They have
asked us to provide you with following information.
The BMR Deed Restrictions recorded with the property specify that the resale price
shall be fixed at a price not to exceed the lowest of:
1. The original purchase price plus an amount, if any, equal to the original price
multiplied by the percentage increase in the median household income for
Marin County. As of this date, this calculation yields a price of $209.466.
2. The original purchase price plus an amount, if any, equal to the original
purchase price multiplied by one-third (1/3) of the percentage increase in the
Consumer Price Index for the San Francisco/Oakland area. As of this date,
this calculation yields a price of $116.671.
.:J. The fair market value of the premises as determined by an appraiser selected
by the owner and approved by the Housing Authority. This value can be
determined by obtaining an appraisal. However, it is not likely that this value
would yield a resale price lower than that based on calculations No. 1 or No. 2
above.
Notwithstanding the above three calculations, the resale price shall not be lower
than the original purchase price plus an amount equal to the original purchase
price multiplied by four percent (4.00/0) per annum. As of this date, this calculation
yields a price of $161.435.

This letter is a request per our converstion earlier this month
for an evaluation of the current resale value of my BMR CondO~l
minium purchased in 1987.
In this connection I quote from your letter to me on determin-
ation of resale price of June 4, 2001 as attached (verbatum):

On this basis I have asked the following professional sources
to verify the resale amounts for 19 years at 4% per annu~

4% per annum the present resale price is $205,279.

Dear Mr. Herold:
Thank you for contacting me regarding your participation in the Town of Tiburon's Below Market
Rate (BMR) Homeownership Program. I appreciate your taking the time to keep my staff updated
on your discussions with the Town of Tiburon and the Marin County Housing Authority.
In your letter of February 17,2006 you quote the Marin County Board of Supervisors as stating "In
California both the County and Housing Authority are created by the state legislature and granted
specific powers. Neither has been granted the power to review or take action regarding
administrative actions of the Town". Further, you asked this office to confirm if legislatively the
Housing Authority is in fact powerless to review, direct and supervise the Town's administering of
the BMR Homeownership Program.
One of my staff, Mike Lowrie, contacted the state Department of Housing and Community
Development (HCD) and the county Housing Authority regarding this matter. According to HCD.
since the BMR Homeownership Program was created, and is maintained, by the Town ofTiburon
without federal or state funding, HCD has no jurisdiction over this program and cannot regulate
how it is managed. Although the county Housing Authority was granted authorization by the Town
of Tiburon to administer the program, it has no jurisdiction to review or take action against the
Town.
You also request that if the Housing Authority does not have the jurisdiction to review, direct and
supervise the Town's administration of its BMR programs, that legislation be introduced to give the
Housing Authority that right. Unfortunately, the deadline for introducing new legislation this year
has passed and I will not be in office next year. If you would like to pursue this matter further, you
may contact your state Senator Carole Migden to see if she would be willing to introduce such
legislation next year.

As you may already know, it has always been our goal at Comcast to ensure that
your office remains informed of the programming services we offer to our
customers who reside in your community.
In pursuit of keeping with that goal, we are sending you this letter to inform you of
our intent to adjust the programming on the current ehannelline-up.
Effective July 26, 2006, Comeast will add the KFTY-DT channel to the Limited
Basic level of service on channel 199. Customers with the Limited Basic
subscription and a Digital Control Terminal will receive the programming at no
additional cost.
Customers have been notified of the addition via a message on their Digital
Control Terminal.
This channel addition will not result in a price increase at this time.
