Dear Mayor Paul Smith:
The San Francisco Bay Chapter of the Sierra Club would like to recognize you and your staff for
encouraging the installation of solar power systems in your city . We recently completed a study on solar
electric permit fees in 48 jurisdictions (in Alameda, Contra Costa,. Marin and San Francisco counties)
and found that your city has one of the most progressive fee structures (see comparative chart
attachment). Installation costs for solar power systems are substantial and low permit fees make a solar
system more affordable for the average homeowner.
In 2005 a state law (by Assembly Member Lois W olk) became effective, which encourages cities to
have minimal permit fees and to cease aesthetic reviews for installation approval of solar energy
systems. A letter of intent from Assembly Member W olk was sent to all cities in California on June 7,
2006 (see attachment). Some cities have yet to take action on implementing a reasonable solar permit
fee policy (see attached ranking chart). We are writing to officially recognize your city for providing
affordable solar permits in your community, thus promoting clean, renewable solar energy.
California voters feel strongly about renewable energy. A 2005 Field Research Institute poll of 954
Californians found that 77% support increasing the state's investment in solar energy. Such sentiments
will increase as citizens look for solutions to rising utility rates and rolling blackouts. Solar electricity is
a clean, reliable, and renewable alternative to polluting fossil fuel power plants and will help alleviate
California's energy problems. Since local sunlight and available roof space are plentiful, only the
number of installations can limit the production potential of solar power.
We want to thank you for the work you are doing to encourage solar power system installations and
encourage you to continue your leadership role in promoting a clean and secure energy future for the
residents in your city. If you have any questions about the permit fee study, please feel free to contact

RE: PROPOSED SEWER LINE OVER TOWN OPEN SPACE LAND
Dear Mr. Lynch:
This letter is in response to your letter dated July 6,2006 (received July 17) regarding
a possible land development application for the purpose of installing and maintaining
a sewer line on Town open space lands in the Middle Ridge portion of the Tiburon
Peninsula. In your letter, you ask what the appropriate land development application
might be for this project. Based on my understanding of the project and process,
Sanitary District No.5 (SD5) does not need to apply for a land development
application from the Town at this time, since it has already requested an easement
from Town as of April 2006. What is needed is completion of the appropriate
environmental documentation for the Town Council to consider the easement request
in the context of making an informed decision.
First of all, let me state my belief that the Town of Tiburon shares SD5's goal of
bringing all properties in the SD5 sphere of influence into a public sewer system, for
both environmental and public health purposes. That said, the Town must have the
results of the analysis of the project's impacts prior to makinga decision on the
request for easement.
As I understand it, SD5 has devised several design alternatives for a project that would
convey all effluent that is currently treated at the. Paradise Cove package plant to the
main plant on Paradise Drive at Mar West Street for treatment. There are several new
elements to the proposed conveyance system, including pump stations, pipelines, and
ancillary equipment. The ultimate service area for this conveyance system may
include substantial additional territory beyond that currently served by the Paradise
Cove treatment plant, including Seafirth Estates, the Acacia Drive Subdivision, the
Romberg Center, and all properties off Paradise Drive from Trestle Glen Boulevard
south to Bluff Point. In short, this is a major project with a broad scope that has the
potential to affect a large number of properties, with corresponding potential impacts
on the environment.
At this point in time, SD5 appears to favor an alignment for a new sewer conveyance
system that would pump effluent over the Tiburon Ridge and across Town open space
in the Middle Ridge area, eventually connecting to existing sewer lines within
Gilmartin Drive. Other alignments remain feasible options.

Town Staffhas previously informed SD5 representatives that the easement request
could be controversial and that environmental review of potential issues would be
required, including but not limited to, accurately describing the scope of the total
project, analyzing any growth-inducing potential of the project, reviewing project
alternatives, and addressing topical issues such as potential effects on special status
plants. Town Staff described these CEQA issues as separate from the "policy" issue
of using public open space for provision of utilities. Town Staff strongly
recommended the retention of a qualified environmental firm to assist SD5 through
the process. ,Town Staff also indicated that the above-described documentation would
likely need to be completed before the Town Council could provide meaningful
feedback on the easement request.
Town Staff also mentioned the possibility of broom removal and/or trail restoration as
quid pro quo measures for the easement. A Councilmember also raised the
outstanding issue of a sewer line relocation in the Lyford Cove undergrounding
district during the SD5 presentation at the Council meeting on June 21, 2006. At that
meeting, the Town Council as a whole indicated that it looked forward to receiving the
environmental documentation and detailed project description for the SD5 plan so that
it could consider the easement request with sufficient information.
In my opinion, SD5 needs to define its project and initiate and complete the
environmental review process for the project, as outlined in the California
Environmental Quality Act (CEQA). These steps will be necessary before any
physical work on the proj ect may commence, and will require professional assistance
from qualified environmental consultants. To the extent that the Town of Tiburon is a
Responsible Agency under CEQA, it will comment on the environmental document
and, if required by law, take action upon it prior to considering the granting of an
easement or any permit it may issue in furtherance of the project. While
environmental review is often time-consuming and costly, it is simply part of the cost
of undertaking proj ects in California.

know which application would be required. They left an application for Land
Development on the counter for me. The Consultant Team for the District is quit
expensive and I have limited fund at the present time. Please advise the District on what
the next steps are and any addional documents the Town ofTiburon will require from the
Sanitary District for this proposed project, so I can get my consulting staff working on
them.

beautification project for the median on Redhill Circle. Although no formal application has been submitted
to the Town for this project, a letter has previously been received from another resident registering
opposition to the potential project. A copy of the correspondence is attached to give the Council some
additional background on this issue.

My wife and I reside on Red Hill Circle and will be out of the country on the night of
the meeting April 18 at 7:00 pm at the Town of Tiburon. I as a licensed engineer and
general building contractor respect and appreciate that the City of Tiburon has kept the
landscape in primarily a natural state. My wife and I chose this area because it is a unique
city and not a series of developments. We both prefer that Lyford St. entrance remain in
its current natural state, as do some of the other residents on this street.
I expressed this to Candace by letter on February 27th and attach the response I
received. I also attach for your review my second letter to Candace reiterating my
opinions of the proposed changes to the landscape.
Please place this in the file of the proposed desire of some residents to change the
entry to Lyford St.

My wife and I will be out of the country on April 18th and unable to attend the
scheduled meeting.
Please read my letter at your meeting as I have very strong opinions on changing the
character of our street. I moved to Tiburon for the naturalness of the area. I believe the
city of Tiburon planning, design review and parks and recreation have done an excellent
job in keeping the landscaping natural. I do not want to change one thing to the entrance
to Red Hill Circle. Based upon the preliminary layout you left I still believe it looks
similar to Oakhurst and Blackhawk. I much prefer it be left as it is. As stated in my prior
letter because of my very strong opinions and motivations to moving to this area I will
not payor help to maintain, any changes to the current laid back entrance.
Thank you and I also take pride in our neighborhood we merely differ on the natural
state vs. non conforming landscape design.

I am sorry it has taken me so long to respond to your letter sent on February 27.
Unfortunately, I would have liked to call and chat with you, but your number was
not listed in your letter.
We had a great turn out at the meeting a few weeks ago. Everyone who
attended was very excited about making a few, inexpensive changes to the
entrance of our neighborhood. I wanted to let you know that I informed them that
not everyone would be interested in donating time and/or money to the project.
Respectfully, without giving your name and address, I let them know of your
Jetter.
I must admit that the response from those who attended was one of confusion.
They did not understand how someone could say that they are 'Idefinitely not
interested" in a plan they had not even seen or heard of. I think you'd be happy
to know that all of our ideas were very conservative, keeping in mind a natural
and drought resistant design. (VERY FAR FROM AN ENTRANCE TO
BLACKHAWK, that's for sure)1 Also, one of the main reasons for the
landscaping is to keep the dogs OUT by bordering the area with rock and "hard
to step over" plants. We feel that if the apartment complex is going to allow
dogs, they should accommodate a doggy park within their area.
We are having another meeting on April 18 at 7pm at the Town of Tiburon. At
this meeting, I will be sharing the information J have received from the Public
Works Department, the Town of Tiburon Design and Review Department,
amongst other information pertaining to this project. I encourage you and your
wife to attend with an open mind. Please understand that we are not demanding
that you get involved in any way, shape or form. We just ask that you listen to
what your neighbor's feelings are, and if you still choose not to get involved, that
wilJ absolutely be your choice.
Thank you for your concerns. We all want to keep our neighborhood looking

change the right of way of Red Hill Circle from a grass median to rock with a garish ~','
red sign that delineates the street. I and 30 plus homes are not in agreement with the
changes. None'ofthe apartment owners on the uphill sign are in agreement with the
proposed changes either. It is my opinion that the rock changes the character of the
entrance from the natural setting of all of Tiburon to an appearance to Oakhurst,
Blackhawk and Sacramento. This is not in the overall character of Tiburon.
I request that should this rock garden proposal come for review before the City of
Tiburon design review, planning department or public works department that a
hearing be set for public comment. At this forum, the majority of neighbors who
oppose it, can voice their opinions and objections before the appropriate department
for review by the City. ,

Have Pride In Red Hill Circle
At our last neighborhood meeting, it was suggested that we get an updated "Name, Address, Phone,
E-mail" list from all of the neighbors that use Red Hill Circle, so that communication can be done
easier (for me) bye-mail. IF you don't have an e-mail address, please note "NONE" and I will do my
best to keep you in the loop. Note: This list will ONL Y be used for communication between neighbors!
So far, we have over 20 honles on Red Hill Circle, Lyford Drive, and Corinthian Court interested in
beautifying our entrance island. Although this idea is voluntary, and by donation only, the more
people who are interested in donating, the less the cost for everyone.
Because the Vista Belvedere Apartments have chosen NOT to participa,te in donating ANY water,
time, or money, we are in the process of designing a rock garden, which will cost around -$10,000.00.
We have had some neighbors offer as much as $1,000.00, and others that would love a change, but
cannot donate anything right now. However, I am confident that if we all work together in the next few
months, all of our homes on and off of Red Hill Circle will benefit from our efforts of truly "Having
PRIDE in Red Hi/lGircle".

Good news - n10re of the Metropolitan Transportation Commission's (IvfTC) meeting
packets are now available online!
You may have been receiving MTC's Commission mailing - including a copy of the
monthly meeting schedule, the Commission's agenda and minutes from the last
Commission meeting - for some time now, or you might be new to the mailing list.
Either way, you no longer have to wait to get your information via the U.S. mail.
Online packets offer all of the above and more. Agenda items that have memos and
attachments are loaded onto MTC's Web site and are available for browsing and
download approximately one week before the meeting. Plus, the streaming audio
feature allows you to listen to the meeting while you're viewing the online packet.
Meetings are archived on the site, so if you can't get to your computer at the exact
meeting time, you can listen in later.
We recognize the fact that resources are finite, and we need to save those resources

Dear Mayor,
I am a proud mother of two wonderful kids, named Asia (age 15) and Andrew (age 9).
I have devoted my best effort to make both my children grow up with good morals &
values. I have encouraged my children to find their own happiness so that they do not feel
empty-handed when they tackle problems that come their way.
Happiness comes from all shapes and sizes. Most people would choose to believe that
happiness is based on how much money you have, how huge your house is or how
expensive your car is. I, however, believe that happiness may come from the smallest of
things, most of which have no monetary value at all.
One kind of happiness that I can think of is receiving a letter from a respectable Mayor.
Since the Holiday Season 2006 is only six months away, I was thinking that this year, my
gift to my children will be a collection of letters from several Honorable City Mayors
who will give us ideas as to what makes them happy, whether it is the greatness of things
or their simplicity.
My children will be extremely delighted to receive such valued comments from
distinguished people like you.
Thank you for taking the time to read this letter. Although you are not obligated to reply,

C. STAFF BRIEFING
Staff noted that the application for 490 Ridge Road has been continued to the August 3,
2006 meeting.
D. NEW BUSINESS BEFORE THE BOARD
1. 95 JYlT. TIBURON ROAD ASH, ADDITIONS/GARAGE CONVERSION
The applicant is requesting Design Review approval for the construction of additions to
an existing single family dwelling on property located at 95 Mt. Tiburon Road. An
existing two-car garage would be converted into a family room. A series of small storage
rooms would be constructed adjacent to the converted garage, with an 8-foot tall wall
extending behind the storage rooms. The wall would not extend into any required
setbacks. The proposed garage conversion does not meet the standards set within the
Town's garage conversion policy. Therefore, in accordance with that policy, this
application has been referred to the Design Review Board.
Theresa Tamley, architect, discussed the project and noted that due to the nature of the
size of the lot and the configuration, it is not possible to adequately replace the garage on
the site without encroaching into the setbacks.
Boardmember Teiser stated that the application is appropriate as adequate parking would
be provided and the neighbors would not be affected.

Boardmember Beales noted that the interior courtyard could be enclosed, but that would
destroy the house. He said that he could support the project as the applicant is
constrained by the setbacks.
Vice Chair Doyle noted that the bushes surround and screen the parking area and was
pleased that the neighbors support the request.

from the provisions of CEQA and approve the application subject to the conditions

The applicant has submitted a request for Site Plan and Architectural Review for
additions to an existing single-family dwelling, located at 695 Hawthorne Drive.
Additions include a two-car garage and master bedroom, as well as the expansion of the
existing living room, kitchen and laundry area, totaling 1,097 square feet. Th.e proposed
additions are well below the gross floor area requirement, but will result in excess lot
coverage. Therefore a variance for excess lot coverage has been requested.
Mohamad Sadrieh, architect, discussed the project and apologized that the applicants
could not attend the meeting due to business matters. Mr. Sadrieh noted that there was no
opposition from the neighbors.
Elaine Stevens stated that she supports the project.
Boardmember Beales noted that the only possible issue would be view impact on the
adjoining house, but as he visited the site he noticed that the view impact would be
minimal, if any. He appreciated that the applicant had tapered the addition to eliminate
any view impact.
Boardmember T eiser stated that he had also looked at the story poles from the
neighbor's house and found that there will be no view impact.

problem with the addition.

The applicant has submitted a request for Site Plan and Architectural Review for the
construction of an addition and alteration to the existing single family dwelling, located at
9 Palmer Court. The existing dwelling is 1,775 square feet and contains a kitchen, living
room, two bedrooms, and a garage. The addition would involve raising the existing
dwelling and constructing new floor area below. A new family room, living room, dining
room, kitchen, study, and bedroom would be added as the new lower level of the house.
The proposed additions will however, increase the floor area by 1,755 square feet,
resulting in gross floor area of 3,355 square feet, which is 265 square feet over the
maximum allowed. Therefore, the applicant is requesting a floor area exception.
Alex Mast discussed the project and noted that all the houses on the block have been
updated. He stated that the intention was to originally go with a ground-level project but
after consulting with architects and contractors they came up with the solution to raise the
home approximately eleven feet and fill in below to gain the additional square footage.
Mr. Mast noted that he met with neighbors and from his understanding there would be
little to no view impact caused by the project.
Judy Bell stated that she supports the project.
Elaine Stevens stated that she supports the project and it is a great improvement for the
neighborhood.
Bob Van Blaricom stated that he cannot see the storey poles for the proposed project and
that he supports the project.

Marianne Longstreth stated that her view could be impacted a little, but noted that her
main concern is the large willow trees.
Boardmember Teiser stated that he was concerned with the increased height to take place
and the mass of the project. In response, Mr. Mast noted that the elevation would allow
for nine-foot ceilings.
Boardmember Beales noted that the ridgeline of the house would be substantially within
the Town's height limits. He stated that he visited the neighborhood on Hilary and
Hawthorne Drives and could not see the story poles as the trees shield them.
Chair Doyle stated that nine foot tall ceilings are not excessive and he felt that the design
was beautiful.

from the provisions of CEQA and approve the application subject to the conditions
of approval as set forth in the Staff report.
