I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the Town Council of the Town of Tiburon, Marin County, California, at a regular meeting thereof, held on the ____ day of January, 1997. AYES: NOES: ABSENT: Mayor ATTEST: Clerk SP2-617iStll 12 Ill:) Bb 1"1.(1 12: is FAX .U5 .199 3i95 llAH 1 \ PARKS llal103 FIRST AMENDMENT TO THE AMENDED JOINT POWERS lAND COMMUNITY FACILITIE~1 AGREBM.ENT or JANUARY 20. 1993 This Agreement dated January 1, 1997, is between the Marin County Open Space District ("District.'), the Town of Tiburon ("Tiburon"), the city of Belvedere ("Belvedere") and the County of Harin ("County"). This Agreement is the First ~end~ent to the Amended Joint Powers (and community Facilities) Agreement between the same parties, dated January 20, 1993 (the "original Agreement") . RECITJ.LS Under the original Agreement, Me11o-Roos proceedings were conducted by the District, resulting in the creation of the District's Community Facilities oistrict No. 1993-1 (the "CFO"). Following the formation of the cro, an election was held, which was successful, thus authorizing the issuance of bonds and the levy of a special tax if an agreement could be reached for the purchase of any eligible property. Agreements were reached for the District to purChase the Terraces Property (all property names used herein are as defined in Exhibit A to the Resolution of Formation -- District Resolution No. 93-09,~dopted March 9, 1993) and a portion of the Harroman property, and bonas were issued. Tiburon, in a separate agreement, purchased another portion of the Harroman property (the "Subject Property") by means of a promissory note (the "Note") which it executed in favor of the seller, secured by a deed of trust on the Subject property. The Note is due on Match 1, 1997. If the Note is not paid when due, it may be foreclosed upon by the seller, and the subject Property may be developed. The parties now desire to authorize change proceedings in the CFD to increase the amount of bonds authorized to be issued, to increase the amount of the special tax, and to more precisely specify the authorized purposes of the CFD. It is proposed to narrow the existing financinq authority to include only: (1) the purchase by the District, from Tiburon, of some or all of the Subject Property, including making payment in part or in full on the Note; (2) the purchase of some or all of the Martha Property; and (3) the possible swap of portions of the Harroman Property already acquired by the District for portions of the subject Property. The change proceedings, if to be successfully completed, will involve another election. Except as it may be amended and augmented by this Amendment, the parties intend that the original Agreement remain in full force and effect. sJl'1..o17lJo9.1 41701.2.CC1I.12/04,'96 12 uti'yO ~Hl 12:19 FAI ~15 ~99 3795 MAHJ~ PARKS IiIJ OO~ NOW THEREFO~E, in consideration of the foregoing, it is hereby mutually understood and agreed as follows: section 1: THE RECITALS The above recitals are hereby adopted and approved. UNFORTUNATELY, THE ACTION TO REPEAL THE PROP 90 ORDINANCE WAS DEFEATED AT THE BOARD OF SUPERVISORS LEVEL LARGELY THROUGH THE EFFORTS OF THE MARIN ASSOCIATION OF REALTORS. ON DECEMBER 17TH. THE BOARD WILL ONCE AGAIN CONSIDER REPEAL OF THIS ORDINANCE. SINCE WE EXPECT TREMENDOUS OPPOSITION FROM THE ASSOCIATION OF REAL TORS AGAIN-- CAN YOU HELP US? Do YOU THINK YOUR MAYOR WOULD SEND A LETTER SUPPORTING REPEAL? AND--CAN YOU CALL BETH POLLARD AND SUPPORT A PRO-REPEAL POSITION BY THE MARIN ASSOCIATION OF MANAGERS? THIS PROPOSITION TAKES $4 MILLION IN PROPERTY TAX DOLLARS OUT OF MARIN COUNTY ANNUALLY. EVERY YEAR THAT THE ORDINANCE REMAINS-THIS NUMBER INCREASES. SINCE INCEPTION OF THE ORDINANCE 9 YEARS AGO, APPROXIMATELY 300 OUT OF COUNTY PROPERTY BUYERS HAVE BENEFITED, THESE BUYERS MAY BE OLD (OVER 55) BUT THEY ARE NOT POOR. PROPERTY PURCHASED UNDER THE PROP 90 BENEFIT AVERAGES 16% HIGHER VALUE THAN OTHER PROPERTIES PURCHASED IN MARIN. i 2, 11 Ho 12:26 'B'415 507 4104 COl:\ fY OF ~lAR I N --+--+-'> 1'1 BL"RON ~ 0021004 COUNTY OF MARIN OFFICE OF THE ADMINISTRATOR .- ....~........~;~...^._.A,.... County AdminUhllf:or December 10,1996 The Board of Supervisors County of Marin Civic Center San Rafael, CA 94903 SUBJ: Repeal of Proposition 90 . Transfer of base year esslIIsed value. Dear Board Members: In 1 988, the voters of California passed Proposition 90. This proposition allows persons 55 years of age or older who own property and are eligible for the homeowner's exemption to transfer their base year value to another California county when they move. In ordar for this to occur, a county has to adopt an ordinance implementing Proposition 90 and allowing these transfers within their jurisdiction. Marin County 'has adopted the enabling ordinance (Marin County Ordinance 2992) which was effective November 9, 1988, This means that the lower base year values from other counties may be transferred into Marin County. Through September 1997 threa hundred Proposition 90 transfers have occurred in Marin and have resulted in a $4 million dollar loss of tax dollars to schools, Iibrarias, cities and other taxing agencies within our County. The County's current annual loss due to these transfers is approximately $1 million. This loss increases every year due to the 2% inflation factor. In 1990, Proposition 110 was passed and extanded the benefits of Proposition 90 to the disabled. The authorization within counties was tied to the ordinance implementing Proposition 90. Since enactment of Proposition 110, only one disabled homeowner within the county has taken advantage of this law. RECOMMENDATION: It is recommended that the enclosed ordinance be read by title only and scheduled for a 0?~Z:17"Ml0AM LINDA CHRISTMAN Assistant County Administrator 'i i')'1196 12:27 '6'41., 507 4104 COlNTY OF ~l:\Rlr\ -H..,. TIBCRON ~ 003/004 DISCUSSION: Only thirteen counties originally adopted Proposition 90 and three of those have acted to repeal the ordinance. Because there are so few counties participating, Marin residents do not usually enjoy a reciprocal benefit if they choose to move and transfer their base year value. FISCAL IMPACTS: The attached chart outlines the fiscal impact of Proposition 90 to Marin County since its inception to September of this year. If you compare Since adoption of this ordinance in 1988. the County's own financial situation as well as that of the other Marin locel governments has taken a severe downward turn. The advent of Proposition 21 8 and the impending welfare reform actions promise a continuation of this trend. This subsidy to 300 homeowners has resulted in a cost to all other taxpayers of more than $4 million annually, The chief beneficiaries of this proposition are persons buying high value property and transferring Inlow out of county base values, The unfair benefit of this proposition is evident when you compare the fifth column from the left labeled "average purchase value" to the seventh column labeled "average base year." From this, you can clearly see the major subsidies that are made available to persons transferring their property and their base value into Marin. If the Ordinance 2992 is repealed, the current subsidies will not cease but repeal will mean that no further tax monies are taken eway from Marin local governments and schools. . Repeal of this ordinance will apply to homeowners 55 years of age and older and to the disabled. It should be noted that in the eight years since the ordinance has been in effect, we believe we have only two disabled homeowners who has transferred value. ]2ill~98 . Note that the Association has fulfilled its commitments-including buying and erecting new street signs. At the same time please note that many of the Town's commitments remain unfulfilled. The LCOTHA Board wishes to express its disappointment. Speeding and lane straddling are still daily hazards on our narrow streets and citizens' efforts alone cannot stop them. We appreciate those few measures that have been taken but they fall far short of what staff itself agreed was needed, The requested "visible enforcement" especially seems nowhere in evidence. As a result, we are denied the simple right to walk our neighborhood safely. Tiburon has a strange way of demonstrating regard for its most historic neighborhood. Moreover, any self-respecting town ought to be embarrassed that citizens have to buy their own street signs and pour their own concrete while the town offers excuses. The LCOTHA asks the Council for immediate action to correct this neglect of our agreement and, more importantly, to correct this chronic traffic problem. Wlf asking, after all, for no more than a basic service for which we pay. lor t~e ASSO~~ -<-b. =/~~ Ian Pearson, Boardmember " ri ~, / OLD TIBURON TRAFFIC ENFORCEMENT PROGRESS REPORT (12/96) '"'" GENERAL Association aiert Lyford Cove & Hiilhaven residents (ietter, meelings) 1 Association survey with town engineer, intorm Town Manager & Police Chief 1 Association provide permission for poiice patrols 10 use driveways 1 Association get resident approval for 2195 Centro E driveway widening 1 Associalion get Engineer & resident approval, fund & inslall .SLOW' signs 1 Ask Councii, Chief for .ongoing & greater traffic enforcement visibility" 1 Ongoing or greater traffic visibility on SoianolDiviso corridor 1 Post traffic advisory on Trestle Glen sign 1 PARADISE & CENTRO EAST Enforce parking reslrictions on Cenlro so cars have room to turn 1 PARADISE & SOLANO Install elliptical median dots approaching intersection from Nand W 1 Public Works 6/19/96 to cut shrubbery to 30' on NE comer 1 Freshen painled street sign above intersection on Solano 1 PARADISE, CAPRICE TO CENTRO EAST Enforce speeding, lane-straddling in spring as weekend traffic increases 1 Install more lighlly-spaced median dots around Paradise curves 1 Consider replacing fallen .Ped Xing" sign W of Solano on Paradise 1 SOLANO & CENTRO EAST Move stop-sign line back to protect stoppers from upcoming traffic 1 Install elliptiCal median dots approaching intersection from Sand W 1 Public Works 10 clear brush obscuring Centro address sign on SE comer 1 Association install Cenlro address sign for trades/tourists at top of intersection 1 Re-pave driveway entry al 2195 Centro East to allow wider traffic turns 1 CENTRO EAST EAST OF DIVISO Post sign (.Road Narrows-25 MPH") Wbound at 2145 Centro E. 1 Median dots on first 2 Of 3 Centro curves approaching Diviso 1 CENTRO EAST & DIVISO InstruCI Public Works to clear brush obscuring SlOP sign on NE side , Work with owner to cut high hedge encroaching on Wbound Centro 11 DIVISO & VISTAZO EAST Install tighter row of dots through intersection from W to S ; Re-paint fading speed sign on pavement S of intersection I DIVISO & VIST AZO WEST Re-survey residents to determine problem ; ALONG VIST AZO WEST Consider painting median lines & posting sign (Road Narrows-25 MPH) on Vistazo ; like the ones On Centro West.
