AUTHORIZING THE TOWN ATTORNEY
TO ACCEPT CONVEYANCE OF A CONDOMINIUM
LOCATED AT 3 MARSH ROAD
ON BEHALF OF THE TOWN OF TIrnURON
WHEREAS, the Town Council of the Town of Tiburon authorized the purchase and
acquisition of a condominium unit located at 3 Marsh Road, Tiburon, California, by
minute order at its meeting of May 15, 1996: and
WHEREAS, state law provides that the deed to the subject unit shall not be
accepted for recordation without the consent of the Town evidenced by its certificate or
resolution of acceptance attached to or printed on the deed or grant; and
WHEREAS, the acceptance of the subject unit will benefit the residents of Tiburon;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Tiburon that the Town Attorney is authorized to accept conveyance of the unit located at 3,
Marsh Road in Tiburon and execute all documents necessary to memorialize said
acceptance.

AMENDED JOINT POWERS
(AND COMMUNITY FACILITIES) AGREEMENT

The Town Council of the Town of Tiburon resolves:
1. This Council hereby finds that the First Amendment to
the Amended Joint Powers (and Community Facilities) Agreement of
January 20, 1993, dated January 1, 1997, will be beneficial to the
residents of the Town of Tiburon. A copy of the First Amendment to
the Amended Joint Powers (and Community Facilities) Agreement is
attached hereto.
2. The First Amendment to the Amended Joint Powers (and
Community Facilities) Agreement of January 20, 1993 is, therefore,
hereby approved, and the Mayor is hereby authorized to sign the First
Amendment and the Clerk is hereby authorized to attest its execution.

FIRST AMENDMENT TO THE
AMENDED JOINT POWERS lAND COMMUNITY FACILITIE~1 AGREBM.ENT
or JANUARY 20. 1993
This Agreement dated January 1, 1997, is between the Marin
County Open Space District ("District.'), the Town of Tiburon
("Tiburon"), the city of Belvedere ("Belvedere") and the County
of Harin ("County"). This Agreement is the First ~end~ent to
the Amended Joint Powers (and community Facilities) Agreement
between the same parties, dated January 20, 1993 (the "original
Agreement") .
RECITJ.LS
Under the original Agreement, Me11o-Roos proceedings were
conducted by the District, resulting in the creation of the
District's Community Facilities oistrict No. 1993-1 (the "CFO").
Following the formation of the cro, an election was held, which
was successful, thus authorizing the issuance of bonds and the
levy of a special tax if an agreement could be reached for the
purchase of any eligible property. Agreements were reached for
the District to purChase the Terraces Property (all property
names used herein are as defined in Exhibit A to the Resolution
of Formation -- District Resolution No. 93-09,~dopted March 9,
1993) and a portion of the Harroman property, and bonas were
issued.
Tiburon, in a separate agreement, purchased another portion
of the Harroman property (the "Subject Property") by means of a
promissory note (the "Note") which it executed in favor of the
seller, secured by a deed of trust on the Subject property. The
Note is due on Match 1, 1997. If the Note is not paid when due,
it may be foreclosed upon by the seller, and the subject Property
may be developed.
The parties now desire to authorize change proceedings in
the CFD to increase the amount of bonds authorized to be issued,
to increase the amount of the special tax, and to more precisely
specify the authorized purposes of the CFD. It is proposed to
narrow the existing financinq authority to include only: (1) the
purchase by the District, from Tiburon, of some or all of the
Subject Property, including making payment in part or in full on
the Note; (2) the purchase of some or all of the Martha Property;
and (3) the possible swap of portions of the Harroman Property
already acquired by the District for portions of the subject
Property. The change proceedings, if to be successfully
completed, will involve another election.
Except as it may be amended and augmented by this Amendment,
the parties intend that the original Agreement remain in full
force and effect.

NOW THEREFO~E, in consideration of the foregoing, it is
hereby mutually understood and agreed as follows:
section 1: THE RECITALS
The above recitals are hereby adopted and approved.
Section 2: THE DISTRICT
(a) The District finds that this Agreement will be
beneficial to the residents of the District.
(b) The District agrees to provide real estate services and
to pay 50t of the Initial Costs (as defined in the Original
A~eement, but as applied to the change proceedings).
(c) The District agrees to conduct change proceedings under
the Mello-Roos Community Facilities Act of 1982, including the
conduct of an election within the CFD, and including the issuance
of additional bonds if the election is successful, all for the
purpose of raising funds for the acquisition of the SUbject
Property. The District will look to a local task force to take
the lead in formulating the structure of the proposed Mellc-Roos
change proceedings ballot measure. '
section 3: TIBURON
(a) Tiburon finds that this A~eement ~ill be beneficial to
the residents of Tiburon.

(b) Tiburon agrees to pay 40t of the Initial Costs (as
defined in the Original Agreement, but as applied to the change
proceedings).
(c) Tiburon agrees to provide representatives to a local
task tor~e which will take the lead in formulating the structure
of the proposed change proceedings Mello-Roos ballot measure, ~nd
to accept parti~ipation on the task force by representatives of
Belvedere as well as representatives of the District and the
County.
(d) Tiburon ~onsents to the conduct by the District, within
the corporate limits of Tiburon, of the proposed Mello-Roos
change proceedings inClUding the conduct of the election and, if
the election is successful, the annual levy of the higher special
tax within the boundaries designated, and according to the rate
or rates designated, in those change proceedings.
(e) Tiburon agrees to sell to the District all or any
portion of the subject Property in exchange for the payment in
full Or in proportionate part, by the District, of the Note.

section 4: BELV~DERE
(a) Eelvedere finds that this Agreement will be beneficial
to the residents of Eelvedere.
(b) Belvedere agrees to pay 10' of the Initial Costs (as
defined in the Original Agreement, but as applied to the change
proceedings) .
(c) Belvedere agrees to provide representatives to a local
task force which will take the lead in formulating the structure
of the proposed Mello-Roos ballot measure, and to accept
participation on the task force by representatives of Tiburon as
well as representatives of the District and the county.
(d) Belvedere consents to the conduct by the District,
within the corporate limits of Belvedere, of the proposed Mello-
Roos change proceedings including the conduct of the election
and, it the election is successful, the annual levy of the higher
special tax within the boundaries designated, and according to
the rate or rates designated, in those change proceedings.
Section 5: THE COUNTY

(a) The County finds that this Agreement will be beneficial
to the residents of the county.
(b) The county eonsents to the conduet by the Distriet,
within the unincorporated area of the County, of the proposed
Mello-Roos change proeeedings inclUding the conduct of the
election and, if the election is successful, the annual levy of
the higher special tax within the boundaries designated, and
according to the rate or rates designated, in those proceedings.
(c) The County may designate a representative, or a
reasonable number of representatives, who are residents of the
unincorporated area of the County in the vicinity of the proposed
open space/ to serve on the local task force. The county nay
also designate a staff representative to the task force.

C) Building Advisory Committee Composition. Town Manager Kleinert said that Evelyn Woo
could no longer serve on the Committee and asked Council to consider appointing John Hoffmire
to fill the vacancy. He said Hoffinire had volunteered his time for fund-raising. Council
unanimously agreed to the appointment.
D) New Town Hall Security and Fire Alarm System. Chair Wilson said that even though Council
had previously given authorization to proceed, additional prices had come in and the Council
Project Subcommittee [consisting of Thayer and Thompson] had deadlocked on the issue.
Mayor Wolf said the Joint Recreation Department who did not want alarms in their space. Wolf
continued to express concern that the alarms would be set off by accident.
Town Manager Kleinert said the new proposal would secure the two entryways into the Town
Administrative Offices. Chair Wilson said the proposal included securing 43 windows on the
periphery of the building, as well.
During public hearing, Karen Nygren, 22 Paseo Mirasol, said the proposal for installation of a
panic button was a good idea. Chief of Police Herley agreed.
Councilmember Ginalski said Council had already authorized the wiring for windows and
doorways, with the idea of activating the system at a later date, if needed. He said he would not
vote to authorize additional funding for the new proposal.
Councilmembers Thayer and Henessy said they would support the new proposal for wiring and a
panic button. Mayor Wolf and Councilmember Thompson said they would not support the
installation of a panic button. Chair Wilson said the panic button could be installed later as a
wireless system. A representative from Stollmeyer Alarm said the two panic buttons were
included in the wiring bid. Wilson said the the details could be worked out later.
Mayor Wolf said there were four votes to go ahead with the new wiring proposal but insufficient
votes for the panic button. _
7) Flood Plain Property Adjacent to New Town Hall & Library - Parks & Open Space Request
for Funding to Hire Landscape Architect.
Councilmember Hennessy recused herself because her residence is within 300 feet of the Flood
Plain.
Jordan Eth, Chair of Parks & Open Space, said there was a lot of momentum now for the project
on the Commission and said it was a good time to hire a landscape architect.
Mayor Wolf said that she had talked to Jim Wilson and proposed that the Building Advisory
Committee write a project description which would include POSe's recommendations and the
Town Engineer's requirements, as well as obtain estimates for the cost of the project.

size and scope of the Police Station project, beginning w~h the Measure M Bond design and
bringing you up to last evening's meeting.

Comment: It became clear once we began do layout even this simple relationship
diagram that the area required for circulation may exceed the percentage allowed in the
Program. It should also be noted that the floor diagrams are only diagrams and do not
represent an actual floor plan which generally increases the actual building area
somewhat.

WAS DEFEATED AT THE BOARD OF SUPERVISORS LEVEL LARGELY THROUGH THE EFFORTS OF
THE MARIN ASSOCIATION OF REALTORS.
ON DECEMBER 17TH. THE BOARD WILL ONCE AGAIN CONSIDER REPEAL OF THIS ORDINANCE.

SUBJ: Repeal of Proposition 90 . Transfer of base year esslIIsed value.
Dear Board Members:
In 1 988, the voters of California passed Proposition 90. This proposition allows persons
55 years of age or older who own property and are eligible for the homeowner's exemption
to transfer their base year value to another California county when they move. In ordar for
this to occur, a county has to adopt an ordinance implementing Proposition 90 and allowing
these transfers within their jurisdiction.
Marin County 'has adopted the enabling ordinance (Marin County Ordinance 2992) which
was effective November 9, 1988, This means that the lower base year values from other
counties may be transferred into Marin County. Through September 1997 threa hundred
Proposition 90 transfers have occurred in Marin and have resulted in a $4 million dollar loss
of tax dollars to schools, Iibrarias, cities and other taxing agencies within our County. The
County's current annual loss due to these transfers is approximately $1 million. This loss
increases every year due to the 2% inflation factor.
In 1990, Proposition 110 was passed and extanded the benefits of Proposition 90 to the
disabled. The authorization within counties was tied to the ordinance implementing
Proposition 90. Since enactment of Proposition 110, only one disabled homeowner within
the county has taken advantage of this law.
RECOMMENDATION:
It is recommended that the enclosed ordinance be read by title only and scheduled for a

DISCUSSION:
Only thirteen counties originally adopted Proposition 90 and three of those have acted to
repeal the ordinance. Because there are so few counties participating, Marin residents do
not usually enjoy a reciprocal benefit if they choose to move and transfer their base year
value.
FISCAL IMPACTS:
The attached chart outlines the fiscal impact of Proposition 90 to Marin County since its
inception to September of this year. If you compare
Since adoption of this ordinance in 1988. the County's own financial situation as well as
that of the other Marin locel governments has taken a severe downward turn. The advent
of Proposition 21 8 and the impending welfare reform actions promise a continuation of this
trend.
This subsidy to 300 homeowners has resulted in a cost to all other taxpayers of more than
$4 million annually, The chief beneficiaries of this proposition are persons buying high
value property and transferring Inlow out of county base values, The unfair benefit of this
proposition is evident when you compare the fifth column from the left labeled "average
purchase value" to the seventh column labeled "average base year." From this, you can
clearly see the major subsidies that are made available to persons transferring their
property and their base value into Marin.
If the Ordinance 2992 is repealed, the current subsidies will not cease but repeal will mean
that no further tax monies are taken eway from Marin local governments and schools. .
Repeal of this ordinance will apply to homeowners 55 years of age and older and to the
disabled. It should be noted that in the eight years since the ordinance has been in effect,
we believe we have only two disabled homeowners who has transferred value.

Dear Councilmembers:
It has been eight months since you endorsed a plan to reduce traffic hazards in our neighborhood, As
you may recall, our association proposed a multi-pronged effort with the town engineer and police chief
to slow down speeders and reckless drivers_ (We later enlisted the help of the public works chief,)
Attached you will find the checklist of agreed-upon abatement measures. Note that the Association
has fulfilled its commitments-including buying and erecting new street signs. At the same time please
note that many of the Town's commitments remain unfulfilled.
The LCOTHA Board wishes to express its disappointment. Speeding and lane straddling are still
daily hazards on our narrow streets and citizens' efforts alone cannot stop them. We appreciate those
few measures that have been taken but they fall far short of what staff itself agreed was needed, The
requested "visible enforcement" especially seems nowhere in evidence. As a result, we are denied the
simple right to walk our neighborhood safely.
Tiburon has a strange way of demonstrating regard for its most historic neighborhood. Moreover, any
self-respecting town ought to be embarrassed that citizens have to buy their own street signs and pour
their own concrete while the town offers excuses. The LCOTHA asks the Council for immediate action
to correct this neglect of our agreement and, more importantly, to correct this chronic traffic problem.
