free loan. Danforth said the loan could be converted into a 30-year loan at 3%

Tax Credit Agency for all or a portion of the additional funds,

The Tiburon Redevelopment Agency regularly schedules its Annual Meeting in September. The
primary purposes of this meeting are:
(1) To provide updated information concerning the financial status of the Agency for the fiscal
year most recently completed (June 30, 1997), and
(2) To review the previously adopted 1997-98 Agency budget in order to approve
recommended revisions to the Redevelopment Budget Plan,
The Agency's financial assets, liabilities, and fund equity are allocated in accordance with the
purposes of the Agency as described in the Fiscal Agreement, and the requirements of state
community redevelopment laws,
The following sections include financial statements and narrative information concerning the
resources of the Agency's General and Housing Set-Aside FtfrK!s;as well as summary information

I.A,I. REDEVELOPMENT AGENCY GENERAL FUND
This fund is used to account for those financial resources which are used for regular operating
expenses of the Agency, and to make the annual payment to the Point Tiburon Community
Facilities District (CFD) for debt service on the improvement bonds of the CFD.
Fund financial information for fiscal year 1996-97 is presented in the following table.

The Fund began the fiscal y'~ar with available fund equity of$16,092 and ends the fiscal year with
available fund equity of $25,802, The Agency received an allocation of $502,500 in tax increment
revenue from the County, and subsequently made a full payment of $472,500 to the P,t.. Tiburon
CFD, Regular operating costs totaled $28,892, and were associated with administration and the
annual financial audit

This fund is used to account for tax increment revenues which are to be used for low & moderate,
or affordable, housing. Twenty percent (20%) of total tax increment revenue collected is
designated for affordable housing purposes,

The Housing Set-Aside FunP began fiscal year 1996-97 with total fund equity of$1,169,963; of
thi~ amount $501,200 was-feserved for the EAH/Cecilia Project, and $668,771 was available for
other affordable housing purposes. On June 30, 1997 total fund equity was $404,818, During the
fiscal year the Agency received an allocation of$156,735 in tax increment set-aside revenue from
the County, and the fund earned $41,956 in investment earnings.. Regular operating costs totaled
$17,058, and were associated with administration, the annual financial audit, and special
redevelopment legal counsel costs,
In 1997, the Agency concluded funding of two housing projects: the EAH/Cecilia Place Senior

Housing Project ($914,122); and residual carry-forward costs of the 1996 TEA/Hilarita
Renovations Project (at $17,309), Additionally, the Agency authorized and incurred expenditures
associated with initial study and predevelopment planning costs of the proposed Ned's Way
Senior Housing Project ($25,000 appropriated, and $15,347 expended),

During 1996-97 the County collected $783,675 in tax increment revenue from the Tiburon
Redevelopment Agency area, These monies were allocated to the Agency and other taxing
entities as specified in the Fiscal Agreement, and as estimated in the following table:

l.A4. DEBT SERVICE PAYMENT TO COMMUNITY FACILITIES DISTRICT
According to the Fiscal Agreement, the Agency is required to pay a maximum of $7,087,500 to
the Pt., Tiburon Community Facilities District. As of the fiscal year just ended, the Agency has
p~ic;l $4,817,637 to the Distfict - a total of $2,269,863 remains owed to the District. Assuming
sufficient annual tax increment proceeds, annual debt service payments will be made through the
fiscal year ending June 30, 2002,

l.A.S. TAX INCREMENT REVENUE LIMIT
The Fiscal Agreement provides that the Agency will receive tax increment revenue until a total of
$7,687,500 is allocated to the Agency's General Tax Increment Fund. At the close of fiscal year
1996-97 the Agency General Fund has received a cumulative total of $5,293,349 - a total of
$2,394,151 remains to be allocated from July 1,1997 forward. It is estimated that the Agency
will reach the general tax increment revenue limit during fiscal year 2001-02.

In June 1996 the Board of Directors (Town Council) adopted a Two-Year Budget Plan for the
Tiburon Redevelopment Agency, The purpose of this report section is to provide budget
information concerning the recently completed 1996-97 fiscal year, and present recommendations
concerning modification of the revenue and expenditure appropriations of the Agency Budget
Plan for fiscal year 1997-98,
Tiburon Redevelopment Agency General Fund
Summary:
The primary purpose of the Agency General Fund is to make an Annual Debt Service Payment of
$472,500 to the Pt. Tiburon CFD, and to support certain operating administrative, fiscal, and
legal costs, As adopted and as modified, Fund revenues are sufficient to cover estimated
expenditures, The General Fund does not maintain a significant unexpended balance in reserve
(as ofJune 30, 1997, at $25,802),

Tiburon Redevelopment Agency Housing Set-Aside Fund
Summary:
The primary purpose of the Agency Housing Fund is to account for tax increment housing set-
aside revenues which are to be used for affordable housing purposes.
In recent years that Agency has approved the expenditure of housing resources to maintain and
preserve affordable housing (TEAlHilarita), and to construct/produce additional affordable senior
housing (EAR/Cecilia Place). This Fund also supports certain operating administrative, fiscal,
and legal costs, As adopted and as modified, Fund revenues and unexpended reserves are
sufficient to cover estimated administrative and adopted capital projects. The Housing Set-Aside
Fund maintains a significant unexpended balance in reserve (as ofJune 30,1997, $404,818).
Adoption of additional capital projects may be contingent upon sufficient reserves and annual tax
increment proceeds,

Proposal to reduce the total revenue appropriation by $38,400 - from $228,400 to 190,000, This
is based on a revised estimate of tax increment proceeds and lower investment earnings because of
the reduced unexpended balance, __
Housing Set-Aside tax revenue estimates are reduced primarily because the County currently
subtracts its property tax collection fee - approximately $16,000 - from the total amount
collected and remitted as housing set-aside revenue, Total assessed valuation in the Agency area
has increased at very low rates relative to the rest of Town; accordingly, total tax increment
revenue collections have been flat in recent years.
In 1996-97, the Board authorized an additional appropriation of $412,000 in unexpended Housing
Set-Aside monies for the EAR/Cecilia Senior Housing Project, which represented a significant
reduction in the unexpended resources of the Fund. The Board also authorized the appropriation
of $25,000 for predevelopment and initial study costs associated with the proposed Ned's Way
Serlior Housing Project. ,:'

Proposal to revise the total expenditure appropriate upward by $11,300,
Legal Services appropriation revised by upward by $5,000 in anticipation of increased use of
counsel associated with the proposed Ned's Way Senior Housing Project. Estimates of
Administrative Services costs to be recharged to the Housing Fund are reduced by $3,300, as
most administrative costs are required to be recharged to the Agency General Fund, Carry
forward the unexpended portion of the 1996-971 appropriation for the Ned's Way Senior

This item is for budget authorization of the Council-approved Downtown Taskforce's Consultants
Study of the Downtown Tiburon Business Area,
At the regular Town Council meeting of Wednesday, September 3, 1997, Mr. Terry Koenig,
Chairman of the Downtown Taskforce, provided a status report concerning the effort of the
Taskforce to solicit bids to have an independent firm conduct a study of the Downtown Business
Area. Mr Koenig indicated that the cost of such a study would be approximately $7,500, and
proposed that $5,000 of these costs be shared between the City of Belvedere and the Town of
Tiburon, The Council approved of this plan, and directed Staff to return this item for budget
authorization at the meeting of September 17,1997,
Recommendation:
Town Council approve the appropriation of$2,500 from the General Fund Unallocated Reserve,
and authorize the expenditure of these funds for this purpose in the General Fund Town
Administration Operating Budget (Contractual Services). ---

BACKGROUND
This item was continued from the Town Council meeting of September 3, 1997, because there
appeared to be some progress by the property owners toward starting completion of the house
after very lengthy inaction,
As of September 12, 1997, the Building Official reports that while progress toward getting the
project underway appears to be occurring, no actual physical work to complete the building has
occurred, nor has a building permit for said work been issued,
While these steps may be taken soon, Staff believes it appropriate that the Town Council at least
schedule to the matter for public hearing at the October 1, 1 ~91;-regular meeting, If work has
begun by October 1, the Council may choose to not hear the item at that time, .
RECOMMENDATION
That the Town Council schedule the abatement hearing for the October 1, 1997 regular meeting,
and direct the Town Clerk to send the notice of abatement in accordance with Chapter 24 of the
Town Code,

comparative statistics for the same month last year. Also included is a brief swnmary of various
interesting incidents requiring police action.

MONTHLY RECAP
AUGUST 1997
A graveyard Officer on patrol located a window smashed on a car on Circle Drive. It
appeared that someone had started to burglarize a car and was interrupted, as nothing
was taken, The peninsula itself, however, (including parts of the unincorporated areas and
Belvedere) has suffered 23 auto burglaries in the last two weeks. Special units are being
scheduled in an attempt to locate the burglars.
Sacramento Police Department recovered a car that was stolen several days earlier from
Andrew Drive, No suspects were located by Sacramento PD. The Tiburon resident
arranged for transportation to pick up his car.
A Sergeant, while on patrol saw a license plate tab on a truck that appeared to have been
taped on in two pieces. A subsequent check showed the vehicle's registration had expired
in 1991! While impounding the vehicle, the owner contacted and gave false information
to the Officer about the registration. He was arrested and cited to appear in court,
An Officer contacting a suspicious person on a traffic stop located a shotgun in the
person's car. As it was not loaded, there was not a violation of law, so the person was
released.
An Officer on a traffic stop noticed a collapsible police baton secreted in a hole in the door
where a stereo speaker used to be, The weapon was confiscated and the report was sent
to the District Attorney's for prosecution of carrying a concealed weapon.

Officers broke up a mutual fight between a boyfriend and girlfriend that started on Leland
Way and quickly moved to the Cove Center, where one of them struck the other before
leaving the area in a car. Subsequent to our intervention, the suspect was arrested by
Twin Cities later that night, and remains in custody awaiting prosecution,
Calif, State Park Rangers requested our Officers conduct an investigation on a reported
sexual battery that occurred during a field trip to Angel Island, (which is in our jurisdiction).
The victim, suspect, and reporting parties all live in the East Bay, TPD is coordinating the
investigation with Vallejo Police Department.
A resident reported family members overdue and possibly missing, while en route from
Missoula, Montana. Our Department put out a bulletin statewide for Officers to be on the
lookout for the family. The following day, the family was located in Richmond, escorted to
the Richmond- San Rafael Bridge, and given directions for the remainder of their drive!
A resident reported that someone in Inkster, Michigan had accessed personal information
about him and was attempting to obtain credit fraudulently in his name, A courtesy report
was taken and forwarded on to the Inkster Police Department.
An investigation is underway by this Department regarding a poisoned "Heritage Tree".
The tree is valued at $40,000.00. The suspect is a neighbor that had asked the owner to
cut it down numerous times.
Officers rescued an elderly woman who accidentally drove into her carport pilings, causing
the pilings to collapse and the roof to fall, pinning her in her car. Officers got her out and
to safety before the Fire Department arrived.
We assisted the Sheriffs Office on a possible prowler call in the 2900 block of Paradise
Drive, A subject was contacted and interviewed by the Deputies.
Police were called to help a person who had fallen on the bike path, and was bleeding,
Upon the Officers arrival, they found a woman who was trying to commit suicide at the
gazebo near McKegney Green, She had slit both her wrists and was bleeding. When she
sem the officers, she got up and ran. Officers gave chase and had to physically hold her
down so the medics could treat her. After medical treatment, she was taken to the crisis
unit for observation.
Police assisted Fire Department with traffic control and security at a structure fire on
Silverado Drive. The fire partially destroyed the home and its contents.
A major investigation is being conducted on a local resident who has fraudulently obtained
credit in his relatives names. The relatives do not live in America. The loss to date is
$50,000,00,

BACKGROUND
At its meeting ofJune 18, 1997, the Town Council received recommendations from the Traffic
Safety Committee concerning aspects of parking, loading and traffic management along Main
Street, including Upper Main Street (Ark Row), At that time, action on the recommendations
was postponed,
The recommendations of the Committee are attached as Exhibit 1. Please note that Committee
recommendation NO.5 is not intended for discussion at this meeting, as it involves inter-
jurisditional issues with the City of Belvedere, Recommendations No, I through 4 do not directly
involve the City of Belvedere, -_
RECOMMENDATION
That the Town Council consider adopting Recommendations 1 through 4 of the Traffic Safety
Committee report dated 6/12/97 and ordering their implementation.

On June 11, 1997 a special meeting of the Traffic Safety Committee was held. In attendance
were the following: '

Below is a summary of the meeting:

We will appraise our personnel to be aware of the double-par~roblem on Ark Row, and to issue
citations when necessary. .-

Item #2 - Prohibitin!!' tour or passeneer buses on Main Street
The Traffic Safety Committee recommends to prohibit tour/PllS~enger buses on Main Street.
We have an ex"isting sign at the entrance of Main Street prohibiting commercial vehicle deliveries,
we can add a sign to that post stating, "No tour or passenger buses on Main Street." This can also
be added to the existing post on Beach Road, which at this time states "No buses". The signs at both
eqd;; of Main Street will bejthe same and in compliance.

The Committee will attempt to notify the tour companies in the city regarding the changes.

Item #3 - Eliminatine all parkin~ on lower Main Street in the mornines until 11 :30 am excellt
for deliverv vehicles, No delivery trucks on Main Street after 11:30 am
While it would be our recommendations that this be complied with, we would like the input of the
local merchants. It will be necessary to advise delivery people that no double-parking be allowed.
It will be necessary to add to the current signs on Main Street "No double Parking" or replace the
one hour signs. The Town Engineer, Lieutenant, and the Superintendent of Public Works will
decided at a later date as to the wording for the new signs.
The merchants can notify their delivery people of the changes, by letters that we will provide. A
grace period of one to two weeks will be necessary.
Item #4 - Establishin~ a 15 moh speed limit on all of Main Street to be 90sted and painted on
street
The Traffic Safety Committee recommends to establish a 14 mph speed limit instead of the 15 mph
speed limit on Main Street. The Committee feels this will get the attention of the public.

DOWNTOWN TRAFFIC ENFORCEMENT
June 5, 1997
At last night's regular meeting, the Town Council reviewed certain downtown traffic and parking
enforcement suggestions that had been discussed at the joint Bel/Tib Council Workshop on May
22, 1997. Council was generally supportive of each of the specific traffic enforcement
recorrunendations and requested they be reviewed by the Traffic Safety Committee.
Please schedule a special meeting of the Traffic Safety Corrunittee next week and consider the
following downtown parking and traffic safety suggestions/recommendations:
1) Increased parking enforcement along Ark Row, especially prohibiting double-
parking of trucks;
2) Prohibiting tour or passenger buses on Main Street;

3) Eliminating all parking on lower Main Street in the mornings until 11 :30 a.m.
except for delivery vehicles. No delivery trucks on Main Street after 11 :30 a.m.;
4) Establishing a 15 mph speed limit on all of Main Street to be posted and painted
on street;

Although in Belvedere's jurisdiction, should the intersection at Beach Road and

This item is for reaffirmation of prior Town Council approval to acquire Condominium Unit No,
18 in the Point Tiburon Marsh Area, for purposes of rental as a Very Low Income unit, This
action was adopted in the 1996-97 fisca1/budget year, and is before Council now for reaffirmation
and incorporation into the fiscal year 1997-98 Capital Improvement Budget.
Discussion:
At the meeting of June 18, 1997, Town Council adopted unanimously the motion: "To approve
the Acquisition and Conversion of a Unit at the Point Tiburon Marsh Complex for Very Low
Income Rental."
Because of and due to unfortunate circumstances, purchase ofthis Unit has been delayed until
recent notification by Marin Housing Authority (MHA) that the seller's estate is now ready to
proceed with sale of the Unit,

At this time the acquisition price of the Unit is approximately $97,100; including costs associated
with title and escrow the final purchase price will be about $100,000, Very Low Income status
qualifies households with an income that is no greater than fifty percent (50%) of the Marin Area
Median (in accordance with State Department of Housing and Community Development (HCD)
guidelines,) The 1997 HCD Income Limits for Very low Incom~ Households are as follows:

MHA has indicated to the Town that it is available to administer the Unit as Very Low Income
under the Section 8, Program requirements,
Resources of the Town's Housing In-Lieu Fund (to be distinguished from the Redevelopment

available resources of the Housing In-Lieu Fund were $647,000,

A) SHAC Chair Larry Smith said the committee would come back to Council on July 2 with a
recommendation concerning selection of a developer.
B) Councilmember Ginalski asked Town Attorney Danforth to render a legal opinion about the
propriety of moving money out of the Town's Redevelopment account to pay the developer [to
subsidize the project].
Town Attorney Danforth responded that if the Town were to sell the property to a developer for
the worth of 25 market rate units and to pay the developer a subsidy on that basis, it would be
proper.
C) Mayor Hennessy recused herself Council concurred that the Town had a commitment to
provide low income housing and that the purchase of an additioruu unit at the Marsh complex
would help meet those goals. Town Manager Kleinert said some of the Marsh property owners
had expressed concern about having very low income housing units in their complex. Vice
Mayor Thayer said the same concerned had been expressed about The Hilarita but it had worked
out fine,

Background
The Town is considering the purchase ofa one-bedroom Below-Market Rate Unit in Point
Tiburon, which may be administered in accordance with the Marin County Housing Authority's
Very Low Income (VLI) guidelines. The following sections provide general information
concerning our acquisition of the unit and the VLI program and rent subsidy levels,
Rate of Return on Town-Owned One-Bedroom Units
The Town now owns three (3) one-bedroom condominium units, which it has purchased using
cash resources of the Town's Low & Moderate Housing In-Lieu Fund (Housing Fund). All rent
proceeds are received into the Housing Fund, and conversely, all appropriate and related costs -
association fees, maintenance and repair, etc. - are 'expensed' from the Housing Fund.
The current rent for one-bedroom units is $825 per month, following adjustment for association
fees the net rent to the Housing Fund is aporoximately $600 per month. By way of inference the
rate of return on the monies used to acquire the units may be calculated, as follows:

Assuming net rent to the Fund is $600 per month the Table shows that the Town is currently
realizing a six-percent (6,0%) rate of return on the monies used to acquire the units. Ifnet rent is
further adjusted to set aside funds for future maintenance (e.g. $40 per month) the rate of return
may be further reduced bY,nearly one-half of 1.0% - or a 5.5% return on the investment.
Rate of Return on Acquisition of Unit for Very Low Income Purposes
The Marin Housing Authority has indicated that the maximum rate of rent the Town could levy,
and realize a rent subsidy, would be approximately $775 per month. Accordingly, the net rent
payment to the Housing Fund would be about 550 per month. The rate of return for the VLI unit
would then be approximately 5.2%; further adjustment for maintenance reduces the net rate of
return to approximately 4.6%.

Appropriate Rates of Return and Other Considerations
The Town currently realizes a 5.6% rate of return on monies invested in the State Local Agency
Investment Fund (LAIF). The rate has ranged from nearly 9,0% in 1989 to current levels which
have been relatively stable for a 18 months.
The Marin Housing Authority suggests that if the Town is able (through rent of the BMR units)
to realize a rate of return which is approximately equal to what is earned through regular
investment of Town monies, and still meet community affordable housing goals, then the
investment may be of overall benefit to the Town. In this instance the rate of return on purchase
of the VLI Unit would be 4.6% to 5.1%, versus the current LAIF return of5.6% - a difference
(loss) of 0,5% to 1.0%.
Finally, current estimated available cash resources of the Housing Fund are approximately
$640,000 (June 30, 1997).

days before that meeting, it became apparent that the appellants of this case had not been properly
notified of the date of the public hearing. The Town COWlcil continued the matter to September
17,1997,
The appellants and the applicants have been notified in writing of the continued hearing date. The
previously submitted Staff report summarized the issues of this appeal. No additional information
or. correspondence has been.received since the September 3 meeting.
RECOMMENDATION:
Deny the appeal and direct Staff to return with a Resolution memorializing the action.

California COPS Funding

The State of California, as it did last year, has granted law enforcement a total of approximately
$100,000,000 through a COPS funding bill. The monies are, subsequently, distributed to the cities,
Our share of the monies are approximately $19,500. One of the requirements for receiving these
funds is that during the month of September, the governing bodies of the cities must discuss the
possible use of these funds.
Last year, the COPS funds from many of police departments in Marin County were consolidated to
purchase laptop computers for use by our field officers. Consolidated purchasing has proven to be
much more cost-effective than each individual police department purchasing on their own.
At the September 11, 1997 meeting of the Marin County PollceChiefs As~ociation, many of the
police departments in the county agreed that the monies received from for this year's COPS grant
should be pooled to help defray the each city's future cost of needed replacement of an antiquated
communications system in the county.
It is recommended that the Tiburon Town Council follow its PoIiee Department's recommendation
for the use of these funds for this very important endeavor.

Immigration Station, Angel Island in Tiburon, California, for the purpose of nominating it for possible
designation as a National Historic Landmark. We enclose a copy of the nomination. The National Park
System Advisory Board will consider the nomination during its next meeting, at the time and place
indicated on an enclosure. This enclosure also specifies how you may comment on the proposed
nomination if you so choose. The Board will make its recommendation to the Secretary of the Interior
based upon the criteria of the National Historic Landmarks Program.
You have 60 days to submit your views in writing, if you so desire. After the 60-day period, we will
submit the nomination and your comments to the National Park System Advisory Board's Landmarks
Committee, which will then inform the full Advisory Board of the Committee's recommendations at the
Board's meeting. The Secretary of the Interior will then be informed of the Board's recommendations for
his final action.
To assist you in considering this matter, we have enclosed a copy -of:!ee regulations governing the National
Historic Landmarks Program. They describe the criteria for designation (Sec. 65-:4) and include other
information on the Program. We are also enclosing a fact sheet that outlines the effects of designation.

The Landmarks Committee of the National Park System Advisory Board will evaluate this property at a
meeting to be held on Wednesday, November 5, 1997 beginning at 9:00 a.m. in Room 7000 B, Main
Interior Building, 1849 C Street, NW, Washington, DC. The Landmarks Committee evaluates the studies
of historic properties being nominated for National Historic Landmark designation in order to advise the
full National Park System Advisory Board at their meeting on Thursday and Friday, November 20 and 21,
1997, in San Francisco, California, and will recommend to the full Board those properties that the
Committee finds meet the criteria of the National Historic Landmarks Program.
Owners of private properties nominated for NHL designation have an opportunity to concur with or object
to listing in accord with the National Historic Preservation Act and 36 CFR 65. Any owner or partial
owner of private property who chooses to object to designation must submit a notarized statement
certifying that the party is the sole or partial owner of the private property and objects to the designation.
Each owner or partial owner of private property has one vote regardless of the portion of the property that
the party owns. If a majority of private property owners object, a property will not be designated, Letters
objecting to or supporting nominations may be sent to Ms. Carol D. Shull, Chief, National Historic
