Re:Resolution No. 31-2003
Secondary Dwelling Units
Members of the Town Council,
In July 2003 you adopted Standards for secondary dwelling units in accordance
with the State mandated Sec. 65852.2. The State left it to the Communities to
establish reasonable standards to conform.
As a professional architect it has now come to my attention that Tiburon is
punishing its residents with 'out-of-Iine' requirements. As one item, I am referring to
the maximum allowable floor area for these units.
Allowable area: Tiburon 400 sf.
Belvedere 750 sf.
Corte Madera 750 sf.
San Anselmo 750 sf.
Ross 700 sf.
Mill Valley 1000 sf.
San Rafael min. 500, max 1000 sf.
In addition to your resolution the Planning Code requires four more pages of
conditions. Is this all necessary? I know you had puplic hearings on this but no
one realized the consequences.
We assume that the Planning Staff wrote the conditions under the watchful eye of
the Planning Commission but the 'finer points' come only to surface when the
conditions are in use.
I urge you sincerely to make a revision to alleviate this discrepancy.
