Public Works has been diligent during this fiscal year implementing the Pavement Management
System philosophy adopted by Council. I would like to take this opportunity to update you on our
key paving projects of this year~ Overall, this year's street improvement program has been a
success in which we accomplished everything we planned.
1. The Lyford Cove Undergrounding project paving work is complete. We deleted Paradise
Drive from the resurfacing scope since A T& T is still working within the area and not
ready for the slurry work. Factoring out this work and the associated item cost of
approximately $10,000, we still came in under budget by about $39,000. We contracted
with Maggiora & Ghilotti to perform the work for approximately $426,500. With good
oversight and inspection, the final tally came in at $377,135. The final product came out
well and the project was a success. The design and scoping for this work were done in-
house with inspection performed by an outside firm.
2. The Failed Streets Improvement project is complete. We plan to accept the project in
January, 2008. Not only did the design team come up with a lower cost solution to repair
the roads, we anticipate delivering this project under contracted budget as well when all
accounting is available. There is one change order that we anticipate, but we hope to get
this reimbursed by Richardson Bay Sanitary. The final product from WK McLellan came
out well. The design, scoping, and inspection were performed by.CSG Consultants and
in-house oversight.
3. The Mar West Overlay project is nearly complete. The project experienced some
difficulty, primarily with a design fee overage. However, we anticipate it will also come
under contracted construction budget The final product from Ghilotti Construction came
out generally well, but some areas could have been done better. The slurry seal of
Esperanza Street did not take to the existing pavement and will be repaired under
warranty by the contractor. This project was one of the last projects designed by Harris
Associates through the Town's past association with the firm. Inspection was provided
by Gannett Fleming. We anticipate accepting the project in the spring when final repair
work is made.

Lyford Cove Utility Underground Project Status
The project contractor, Maggiora & Ghilotti, has completed all basic contract
work. PG&E have completed the wiring of their system and the overhead to
underground conversion work. Therefore, each individual property should be
served underground for power.
Comcast has completed the wiring of their mainline in the street but has not
completed the wiring of individual service laterals. Their ability to complete the
wiring of their service laterals and conversion of the service laterals from
overhead to underground is being held up pending resolution of a project
participation obligation to the Town.
AT&T has not begun the wiring of either their mainline in the street or the
property service laterals. AT&T has determined that four (4) additional boxes
need to be installed on Paradise Drive and, also, will be replacing eleven (11) box
frames/lids on Paradise Drive and other locations in an effort to address
neighborhood complaints concerning the AT&T box noise problem.
The Town intends to place a slurry seal treatment on Paradise .:q~ive but must wait
for the utility companies to complete their work in the street right of way. We
expect the three utilities to complete their pending work in April-May of this year.
PG&E has removed some of their wiring off the utility poles and continues to do
so. Comcast and AT&T must completely activate their respective systems prior to
the removal of their wiring off of the utility poles. AT&T will be the last utility to
remove utility pole wiring and then must remove the utility poles. We now expect
the utility poles to be removed in May-June 2008 and then, hopefully, your view
to the Bay and general surroundings will be unobstructed.

NOTICE OF PUBLIC HEARINGS

Notice is hereby given that the Tiburon Planning Commission and Tiburon Town
Council will hold public hearings to consider adoption of various text amendments to
the Tiburon Zoning Ordinance (Title IV, Chapter 16, of the Tiburon Municipal Code).
The text amendments would be made to the Village Commercial (VC) and
Neighborhood Commercial (NC) Zoning Districts, located primarily in the Downtown
area. The purpose of the amendments is to implement policies adopted as part of the
Town's General Plan Tiburon 2020, as required by Downtown Element Program DT-
a. The zoning text amendments would, among other things:
~ Prohibit new street-fronting, ground-floor commercial office uses on
most of the length of Main Street and a portion of Ark Row (1 Main
Street through 100 Main Street); and along Upper Tiburon Boulevard
(all addresses, both odd and even, between, and including 1501
Tiburon Boulevard and 1601 Tiburon Boulevard). An exception
process is proposed to allow such uses in limited circumstances
(Downtown Element Policies DT-16 and DT-13).
~ Prohibit drive-through restaurants and restaurants that primarily offer
fast-food and/or take-out service, while allowing beverage or specialty
food providers such as coffee and tea houses, juice bars, and ice
cream/frozen yogurt shops (Downtown Element Policy DT -10).
~ Establish provisions for minor floor area additions to existing
buildings over the existing Floor Area ratio maximum in limited
circumstances and allow for rebuilding or reconstruction of Downtown
commercial buildings to the same floor area as exists (Downtown
Element Policies DT -8 and DT -6). " t' ,

Development Department. Questions regarding the proposed zoning text amendments

435-7392. The public hearing before the Planning Commission will be held on
Wednesday, January 23,2008 and the public hearings before the Town Council will
be held on Wednesday, February 6, 2008 and Wednesday, February 20, 2008. All
hearings will be held at the Town Council Chambers, 1505 Tiburon Boulevard,
Tiburon, California, and all meetings at which the hearings will be held will begin at
7:30 P.M.

Recently the Town of Tiburon, through its contractor (Ghilotti Construction),
resurfaced Esperanza Street. The application of a slurry seal over the existing
pavement was designed to extend the life of the road and provide for a new
wearing surface.
F or unknown reasons, the slurry seal mixture did . not take to the existing pavement
and has started to unravel. A similar seal coat was applied very successfully on an
adjacent street, Centro East. The contractor warrants its work and will re-apply
the seal coat in the spring time when the weather is more conducive to asphalt
work.

NOTICE OF PUBLIC HEARING
MARIN COUNTY TITLE 22 (DEVELOPMENT CODE) AMENDMENTS
NOTICE IS HEREBY GIVEN that the Marin County Planning Commission will conduct a public hearing to
consider proposed revisions to the Marin County Title 22 (Development Code), which includes zoning
and subdivision regulations for the unincorporated areas of Marin County. The project includes proposed
amendments to the Development Code that would clarify, correct, and update applicable sections of the
zoning and subdivision regulations in order to improve its readability and ensure that the Development
Code meets legal requirements and conforms to State law. The regulations affected by the proposed
amendments include, but are not limited to, the following: (1) planned district general standards; (2)
general property development and use standards; (3) inclusionary housing regulations; (4) native tree
protection and preservation; (5) large family day care facilities; (6) residential second units; (7)
telecommunications facilities; (8) appeals; (9) temporary use permits; and (10) definitions. Copies of the
proposed Development Code amendments may be obtained from the Marin County Community
Development Agency Planning Division, 3501 Civic Center Drive, Room 308, San Rafael, between the
hours of 8:00 a.m. and 4:00 p.m., Monday through Friday (excluding holidays).
The project is exempt from the requirements of the California Environmental Quality Act (CEQA)
pursuant to Sections 15307 and 15308 of the CEQA Guidelines because the proposed amendments are
intended to strengthen and ensure consistent application of standards for the maintenance, restoration,
enhancement, and protection of natural resources and the environment.
Said public hearing will be held at the regular meeting of the Marin County Planning Commission on
Monday, January 14, 2008, in the Planning Commission Chambers (Room #328 - Administration
Building), Civic Center, San Rafael, California, at which time any and all persons interested in this matter
may appear and be heard. Please call the Community Development Agency - Planning Division at (415)
499-6269 on or after Monday, January 7, 2008, in order to be informed of the place on the agenda and
the approximate time of the hearing or to obtain a copy of the staff report, or visit our website at
