Dear Mrs. Curran,
On April 20, the residents of Rock Hill Drive wrote to the Community Congregational
Church demanding an immediate end to dangerous and disruptive problems caused
by their recent events. The CCC asked to have until June 6 to reply, and we agreed.
What did we get in return? This last Saturday a CCC event paralyzed this neighbor-
hood for hours with hundreds of cars all the way to and including Tiburon Boulevard.
No fewer than four police officers struggled with illegal parking and impassable
streets over a period of three hours.
The cee has acted in bad faith. But now our larger question is this: if we residents
are to wait until June 6, what will our responsible Town management do to protect us
from this mayhem in the meantime?

3 OFFICERS RESIST TICKETING-IF YOU NEEDED AN AMBULANCE OR FIRE TRUCK, FORGET IT
Saturday afternoon memorial, estimated 200+ cars. Shuttle and 2 limos are overwhelmed.
All parking taken including S1. Hilary's and all street parking for 4 blocks.
A worse mess develops downhill. Overflow cars park illegally on Tiburon Blvd. Officer runs out of
cones, calls for backup and more cones.
eee hires one 17 -year-old to direct traffic. He fails to remove first wave of illegal parkers, so police aide
called to advise him. When event begins, the boy is gone. Illegal parking soars.
Police called 4 times, issue some tickets. As soon as they leave, new iIIegals arrive. This goes on
continuously for 3 hours, from 3:00 pm to 6:06 pm.
Two police--a dispatcher and an officer on site--resist ticketing, saying lilt's a memoriaL"
eHP officer attends event and parks blocking eee drive, walks by illegal cars but does nothing. When
Tiburon officer goes in to consult him, still nothing done.
At regular intervals, Rock Hill and emergency turnaround are completely blocked as shuttles, parkers
and new arrivals all try to fit past each other and create gridlock.

3:15 pm. Illegal parking begins, no attendant in sight.
4:30 pm. Event begins, eeG's teenage supervisor
leaves. Illegal parkers here will remain thru event.

3:25 pm Copycat illegal parking begins, despite many
spaces remaining in eee lot. Police called.
4:40 pm. Motorcycles squeeze in too. Inner cars
here will be trapped for 2 hours.
4:45 pm. eHP officer blocks eee driveway for 40
minutes to attend event.
Meanwhile downhill, a neighbor reports Rock Hill is clogged with new arrivals, stopped shuttles, downhill
traffic, and cars trying to park. No supervision by police or eee. Gridlock ensues.
5:00 pm. Now six illegal vehicles double park in the turnaround, including a eHP unit blocking the
eee driveway. Tiburon officer goes into eee to talk to eHP, returns to say "It's a memorial service."
When asked why he doesn1t simply write tickets, he has no answer.
The officer is suddenly called away because more arriving cars are now parking illegally on
Tiburon Boulevard. Officer lays cones and tries to direct traffic, has to call for backup with
more cones.
In a later call the county dispatcher also resists taking action, saying lilt's a memorial, besides
they have it under control with shuttles, it will be over in a few hours." After being told it was
not under control, a police aide arrives approx. 5:30 pm and tickets vehicles above.
5:20 pm. eHP officer who was blocking the eee driveway leaves. His space is
immediately taken by a van. Meantime, shuttle attempts to back around illegal parkers.
6:05 pm. Memorial dinner begins. New arrival parks illegally until police arrive for
the 4th time.
How many times will we hear "It's just one event?" (just like 1/29, 2/2,
When three law officers are unwilling to ticket violators, what chance does a
17-year-old eee "supervisor" have of controlling this chaos? What will their excuse
be when their own ambulance or fire vehicles can't get through?
When three shuttles, 6 law officers and 3 neighbors standing vigil for 4 hours can't
control 200+ cars, what will it take to convince the Town and eee these train wrecks
are too much for the neighborhood? This is a civic embarrassment.
This is not worship vs. safety. That's a false choice. It's about the eee
controlling the size of its events and traffic vs. failing to. Period.

Dear Ms. Curran,
This letter is to request records of Tiburon town employee salaries that
you have in your possession. We want to inspect and copy these records
pursuant to the California Public Records Act (Government Code Section
6250 et seq.) and Article I, Section 3 of the California Constitution.
The information we want to inspect and copy is as follows:
All Tiburon town employee salaries for the years of 2006 and 2007. This
includes each employee's name (first and last), city of residence, gender,
age, length of service with the county (or hiring date), department, sub-
department, job classification, job title, job status (exempt or hourly),
straight-time hours worked, overtime hours worked, holiday hours
worked, total hours worked, base salary, overtime pay, holiday pay, any
shift differential, any taxable allowances, any bonus, any other form of
compensation and the amount, and the total annual pay.
We also would like to receive detailed records of expense
reimbursements by employee for the same years. This includes the
category of each expense (e.g., mileage, meals, office supplies), the date of
each expense, the amount, the vendor's name and the total paid to each
employee.
As you know, California Government Code Section 6253.1(a) requires
you to:
1. Assist me in identifying the records and information that are
responsive to my request or to the purpose of my request.
2. Describe the information technology and physical location in which
the records exist.
3. Provide me with suggestions for overcoming any practical basis for
denying access to the records and information I am seeking.

Pursuant to Government Code Section 6253(b), we ask that you make
these records "promptly available" for inspection and copying. If you
require a fee to cover direct costs of duplication, please let us know what
that fee will be before you proceed with the copying.
We'd prefer the salary information in an Excel workbook format on disc
or sent via e-mail as an attachment, with the expense reimbursement
information as a separate Excel file.

7:00 p.m. Newland Experienced Board Member Orientation Keith Lester presented and discussed the
history on the formation of The Hilarita, emphasizing the efforts of such a large group of people to create
and then to preserve affordable housing at The Hilarita.
1. MEETING CALL TO ORDER
President Lester determined that a quorum was present and called for order at 7:40 PM in the Community
Resource Center of The Hilarita Apartments.
2. MINUTES OF THE MARCH 10. 2008 MEETING
There was an amendment to the Open Forum, page 2, item 2 response:
"Ms. Tilton, JSC, responded that the HRA proposal was not clear or complete regarding suitable location,
layout plan, maintenance, budget, etc. President Lester said that the garden project is one taken on by
the HRA, and asked Susan to discuss this with HRA and submit a unified plan and budget."
There being no further comments, it was:
M/S/P that the Board accept the March 10, 2008 minutes as amended.
3. OPEN FORUM
Resident Barbara Warren, on behalf of other residents, reported that since her assigned parking space is
underneath trees, her automobile suffers from tree sap and bird droppings on a daily basis. She asked
the Board to consider creating a "car wash" area which provides water only. Users would pay a 'water fee'
and no soap would be allowed.
In discussion, the Directors asked numerous questions and the following suggestions were made:

2. residents obtain car covers to protect their vehicles;

No decision was reached concerning this request, but the request may be discussed again after further
research and investigation.
4. CORRESPONDENCE & ANNOUNCEMENTS
Carl Weichel reported that Director Anne Browne negotiated an agreement with the Child Care Center to
use space at St. Stephen's Church until such time as their new structure is complete. (Recently, there
was a fire which destroyed the Center.)
5. The HILARITA RESIDENTS ASSOCIATION (HRA) REPORT
Meets eve/}' third Monday of the month at 7:30 PM in the Esther Whitman Community Center
President Angela Lorenz reported that:
1. at the most recent HRA meeting, many residents expressed interest in obtaining more information
about Renter's Insurance.
Dorothy Larson suggested that residents should contact the company who provides their auto insurance,
since often there will be a savings in premiums if someone has more than one policy with a particular
insurer. It was also suggested that HRA provide a list of names of insurance companies to come to the
property to meet with residents and provide more specific information.
2. the Angel Island picnic will be held on June 13, 2008.
3. the HRA garage sale will be held on April 19, 2008.
4. the HRA requests a meeting to discuss the H- TEA amendment to the H- TEA Bylaws.
(A meeting was held directly after this Board meeting.)
6. SECRETARY'S REPORT
Barbara Garcia-Romero reported that she sent a card on behalf of the H- TEA to L.A. Wurl, wishing her a
speedy recovery from a recent surgery.
7. TREASURER'S REPORT
Carl Weichel advised that the Board's Bank of Marin checking account balance is $4,483.98, and that
there are no outstanding payables.
8. The JOHN STEWART COMPANY PROPERTY MANAGEMENT REPORT
A-- Linda Tilton, Director of Property Management, reported that:
1 . a HUD Management and Occupancy Review (MOR) is scheduled to begin Wednesday April 16,
2008 and may take one or more business days to complete.
2. the proposed amendment to the H- TEA Bylaws was submitted to HUD for their review and approval,
however, no reply has yet been received.
B - Julius Wilson-Kermah, Administrator, reported that:
1 . the issue of improperly installed satellite dishes is being addressed, now that weather permits.

2. all residents have been notified that HUD issued a new Model Lease and copies of the new lease
have been sent to all residents. There is a 60 day comment period if residents wish to express any
concerns to HUD before the lease will be implemented.
3. also, new House Rules have been distributed. The new rules incorporate all the individual addenda
to the lease to simplify all of this documentation.
Carl Weichel requested that copies of the new Model Lease and the House Rules be distributed to all
Board members for their Board Manual. Ms. Tilton will respond to this request.
9. ON-SITE COMMITTEE REPORT
Meets fourth Thursday of the month at 6:00 PM or as needed. Committee: Barbara Brooks, Ame Brown, Richard Leonards, Carol
Michelson
There was no report.
10. BUILDINGS & GROUNDS COMMITTEE REPORT
Meets the last Friday of the month at 7:30 AM or as needed. Committee: Charles Ouick-c, Mary Ann Alvarado" Michael Peters
Charles Quick reported that he expects a proposal from Mary T eSelle by next week on the re-design of
landscaping at the property entrance. It was noted that Perry Roland has not yet submitted a proposal for
landscape maintenance.
President Lester requested that Buildings and Grounds prepare a recommendation on resident
concerns regarding bird and tree sap droppings onto their cars.
11. COMMUNITY TRAINING & SERVICES COMMITTEE REPORT
Meets the first Friday of the month at 6:00 PM or as needed. Committee: Barbara Garcia-Romero-c, Angela Lorenz
Barbara Garcia-Romero reported that they are in the 25th week of tutoring and will be finishing in June,
2008. She noted that the tutoring program has a particular new student of kindergarten age whose native
language is Farsi, who they are tutoring in English.
Barbara said that Carl Weichel and she will work together to find sources of long-term funding for the
tutoring program.
12. FINANCE COMMITTEE REPORT
· This report is proprietary and not to be discussed outside of this meeting

Carl Weichel- no report.
Mike Peters requested additional clarification from Dennis Leary on the specifics of his request for a
Variance Report (commentary) on the monthly financial reports.
13. OLD BUSINESS
There was none.
14. NEW BUSINESS
1. Charles Quick related that a resident of The Hilarita, Marge Wiegandt sustained a very serious head
injury from a fall that occurred on Saturday, April 12, 2008 and that she was reported to have been in a
coma for more than 24 hours. Julius Wilson-Kermah, Property Manager, said that the only resident
who witnessed any part of the incident had only seen the woman after having fallen and lying on
the sidewalk, and that she called the paramedics.
It appears that Ms. Wiegandt uses a walking cane, and at the time she was handling a small rolling cart and
may have lost her balance or fainted on the sidewalk. Management will report the incident to our insurance

carrier in case of further developments. Update information on Ms. Wiegandt's condition can be obtained
from Barbara Rowe at Westminster Presbyterian Church. Ms. Wiegandt's daughter is staying in her
Mother's apartment for the time being.
2. President Keith Lester and Treasurer Carl Weichel attended the JCS annual conference on Friday
April 4, 2008, and agreed that it was a valuable experience.
Barbara Garcia-Romero expressed her interest in attending the JCS annual conference next year.
15. EXECUTIVE SESSION

16. DATE OF NEXT MEETING - MAY 17.2008 WITH ANNUAL WALK AROUND
At 9:00 a.m. there will be a New/and Experienced Board Member Orientation. The regular business
meeting will be called to order at 9:30 a.m. The Annual Walk Around will follow the business meeting for a
tour that will include apartments which have been rehabbed this year.

The meeting was called to order at 7PM by Bill Lukens. Attending: Diane Lynch, Fran
Wilson, Chris and Cathy Benediktsson, Klaus Meinberg, Madeleine Wood, Alice Fredericks
(until 8pm), Len Sellers, Helen Lindqvist, and Pat Montag. Deborah Mazzolini (until
8:30pm), Eric Schoenberg (until 7:30pm). Guest Nicholas Nguyen Director of Public

terested LCOTHA membership asked to help develop general guidelines for neighborhood
character, since there have been complaints that the DRB criteria of looking at all homes
within 300 feet of the project application was misleading."
BRIEFING FROM NICHOLAS NGUYEN.. PUBLIC WORKS DIRECTOR: The LCOTHA
neighborhood is a challenge for Public Works as it features narrow roads, old roads,
drainage issues, and the lack of engineering in the structural road elements. For exam-
ple, storm drains or cross culverts are on the older side, and can be metal on top and dirt
on the bottom from erosion and corrosion. The Town has replaced some with high den-
sity polyethylene (HDPE) which have an 80 yr. life span.
The Undergrounding District basically put in a joint trench with pipes by contract with
PG&E to install the electrical and take the system over. It was transferred officially about
a month ago. the AT&T work remains, which is necessary for pole removal. AT&T is re-
sponsible for removing the poles. This will happen in about two months; apparently we
fell behind a Belvedere undergrounding project, the work is now however underway.
A slurry seal has been put on Paradise Drive that covers the existing pavement. The
County portion of Paradise has not been done because the County refused the Towns of-
fer of a slurry coat. The County wants the road restored, and the Town is currently in
discussion with the County regarding the specifications of the road. Nick is working with
Eric Staeger, staff person at the County.
Welcome News: Out of the 222 homes in the district 3/4 were on the "downtown circuit",
an effort has been made to add the last 1 / 4. This part of the project has slowed PG&E
work, as it required additional design and electrical work. Mar East homes have been
switched now to the "downtown circuit" which is thought to be more reliable during
storms. It is estimated that the poles will be down in 3 months. Hooray!
Another item discussed was traffic safety. Centro West and Solano as well as other areas
have speeding car problems. Pedestrian safety elements such as rumble strips/pavement
markings are in consideration. The 3 classic elements to traffic safety are - education/
enforcement/ and engineering solutions. Regarding speeding bicycles, it was thought best
addressed via the POST commission (Parks Open Space Tiburon). The traffic safety is-

sues in the narrows in front of the Caprice Restaurant, Nick is going to look into with the
Traffic Safety Committee which includes the Police Chief.
. . Regarding the lighting downtown. The contract to purchase and install new "down" light-
. ." ing was let and the lights are in the corporation yard, however CalTrans permitting has
.~ delayed the work. They are requiring testing. The replacements are just the lights up top-
side, not the poles. Nick is working with CalTrahs. Thanks Nicholas Nguyen for a great

BELVEDERE TIBURON LIBRARY: Deborah Mazzolini our new LCOTHA neighbor on Mar
West, presented an update on the library. A little background history starting at the JPA.
The Library is governed by a Joint Powers Authority (JPA) formed in 1995. The Steering
Committee ceded from the County Library system, in order to become eligible for the tax
revenues for libraries raised from peninsula taxpayers. The basic tax funds of approxi-
mately $700K were transferred to the JPA at this time. A parcel tax was created to fund
the bond to build. The library current budget is $1.4M to run the library per year. This
comes primarily from the basic tax (720/0), parcel tax (110/0), private funds (90/0), and 80/0
from fines, interlibrary state support. There are 94 directors on the Library Foundation
that raises money for the library and 7 on the Board of Trustees for the Library JPA
board (3 Belvedere, 3 Tiburon, and 1 Reed).
Expansion update: The Library is on a floating foundation so a 2nd floor expansion up is
not possible. That leaves the two current options which will be very interesting and we
encourage you to call or email Fran and attend the presentation at Fran's house (details
next paragraph). Alot more public input is needed, to decide the location of the expan-
sion, to understand the reasons for the expansion and be able to speak in a more in-
formed manner.
It is so important to have community input on the Library expansion that Fran
Wilson is offering to host for LCOTHA an informational meeting at her

COMMUNITY CHOICE AGGREGATION (CCA): CCA allows local communities to engage
in the business of buying or generating electrical energy to sell to residents by forming a
joint poser authority (JPA) with other local jurisdictions. Marin County is considering
creating a JPA called Marin Clean Energy that will buy and/ or generate electrical energy
from green and renewable sources to sell to local residents. Every household will be in-
cluded unless they "opt out" and chose to remain with PG&E. The Town Council will have
to decide whether to join Marin Clean Energy in November. The web site for Marin Clean

The CCA program gives the cities and counties the authority to purchase electricity and
resell it to customers within their jurisdiction. Marin Clean Energy, as all JPAs formed as
Community Choice Aggregations, would be allowed to purchase energy from whatever
source they choose at whatever price they can get. As the Marin Clean Energy business
plan states, "Unlike traditional utility service, the source of the electric supply (generation)
and the price paid by customers for the generation services procured by the CCA program
would be determined by the CCA". Some see the possibility of moving toward reducing
greenhouse gas emissions through the use of renewable energy. Marin would enter the

greenhouse gas emissions through the use of renewable energy. Marin would enter the
amazingly complex world of power generation and transmission and compete with other
power players including PG&E. The business plan is making the rounds of cities across
the county. PG&E would still maintain poles and lines and transmit electricity, but under
the plan, MCE would choose the sources of the electricity it buys. PG&E is having diffi-
culty meeting the 200/0 green target by 2010. Power: green or dark green as they
say.......Stay tuned!
TREASURERS REPORTI MEMBERSHIP: Kell Bredsig Larsen sent a report which said in
summary, $5,774 in the bank, and we need to pass a budget. Currently we are operating
on last years budget. Because of the long presentations it was tabled to next meeting to
be addressed with thought and consideration.
The most up to date list of members shows 51 members who have paid so far. Remember
to send in those dues..... form attached on these minutes. Last year our paid member-
ship was 126 members.

ENVIRONMENTAL I ARCHITECTURAL: Helen Lindqvist reports that as a result of neigh-
borhood input the project was scaled down and the number of clerestory windows re-
duced at the 275 Diviso project. Also, 1891/3 Centro West plans were approved. PATHS:
The neighbors & LCOTHA are trying to preserve the path between Vistazo West and Cen-
tro West where the new house was approved. We encourage input to the Town. The nevI
owner has declined to allow this defined and historical path along the property which has
been used for decades. This is an important path because it allows a safe route to Las
Lomas land to get into the town and to the ferry for the residents, especially since Diviso
is such a narrow street and is another 3 block walk.

will provide the board input on the development efforts underway at the Martha property.

MARIN COUNTY TITLE 22 (DEVELOPMENT CODE) AMENDMENTS
NOTICE IS HEREBY GIVEN that the Marin County Planning Commission will conduct a public hearing to
consider proposed revisions to the Marin County Title 22 (Development Code), which includes zoning and
subdivision regulations for the unincorporated areas of Marin County. The project includes proposed text
amendments to the Development Code that would clarify, correct, and update applicable sections of the code,
including amendments needed to meet legal requirements from Government Code Section 65915 which
applies to residential density bonuses. The regulations affected by the proposed amendments include, but
are not limited to, the following: (1) clarification of affordable housing incentives as provided by the
Development Code and Countywide Plan (CWP); (2) update state density bonus law requirements; (3)
definitions; and (4) other standards including, but not limited to those applicable to agricultural structures and
room rentals. Copies of the proposed Development Code amendments may be obtained from the Marin
County Community Development Agency Planning Division, 3501 Civic Center Drive, Room 308, San Rafael,
between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday (excluding holidays).
The proposed amendments to the Development Code are an implementing provision of the CWP update.
Amendments are consistent with the goals and policies of the CWP because they correct,clarify, or otherwise
revise existing regulations that implement policies and programs contained in the CWP. The potential impacts
of implementing these standards have been adequately addressed in the certified CWP Update EIR. A
subsequent or supplemental EIR is not required pursuant to CEQA Guidelines Section 15162 - "Subsequent
. EIRs" because the proposed project (Le., proposed amendments) does not include substantial changes
involving new or more severe environmental effects that would result from the adoption of these amendments,
nor does the proposal involve new information that was not known at the time the EIR for the CWP was
certified.
Said public hearing will be held at the regular meeting of the Marin County Planning Commission on Tuesday
May 27,2008, in the Planning Commission Chambers (Room #328 - Administration Building), Civic Center,
San Rafael, California, at which time any and all persons interested in this matter may appear and be heard.

May 19, 2008, in order to be informed of the place on the agenda and the approximate time of the hearing or

Since 1975, the Community Development Block Grant (CDBG) program has provided
over $59 million to Marin County communities for housing, community facility, and
public service projects benefiting lower income people. In the 2008 funding cycle,
CDBG provided $1.6 million for housing, community facility, and public service
activities, and the HOME Investment Partnerships Program (HOME) provided an
additional $1.1 million for affordable housing projects. These programs have been
uniquely effective in Marin because they combine a steady stream of federal funding with
local control over funding criteria and project selection. In short, CDBG and HOME give
us federal funds for important projects selected by the people of Marin.
Marin County qualifies for CDBG formula funding because cities and the county have,
through cooperation agreements, joined together to receive funding as an "urban county."
These agreements must be renewed every three years. The CDBG cooperation
agreements will expire this year, and in order for us to continue receiving funds for fiscal
years 2009-2011, it is necessary for each city and the county to renew their joint
participation by formally executing a new cooperation agreement by June 30, 2008. The
U.S. Department of Housing and Urban Development (HUD) requires the county to
inform each city that it may elect to be excluded from the urban county, and any city
which chooses to be excluded must notify both the county and HUD in writing by
June 13, 2008. An election to be excluded will be effective for the entire three-year
period for which the urban county qualifies, unless the excluded city specifically elects to
be included in a subsequent year for the remainder of the urban county's three-year
qualification period. Any future change in election must be done in a manner and by a
date to be specified by HUD.

If a city excludes itself from the urban county, programs within its borders will no longer
qualify for the CDBG funding which the urban county receives automatically on a
formula basis each year from the federal government. Unless it has central city
designation, a city must have at least 50,000 population to qualify independently for a
CDBG entitlement formula allocation directly from HUD. While a city remains part of
an urban county, it is ineligible to apply for grants under the State-administered CDBG
program. The State-administered CDBG program requires a competitive application
process that does not automatically provide funds on a formula basis.
If a city remains with the urban county, it is automatically also a participant in the HOME
program if the urban county receives HOME funding, and may receive a HOME formula
allocation only as part of the urban county. Although HUD will permit urban counties
a.Tld cities that are part of the urban cCQnty to apply for State HOME funds, the State of
California does not presently make its HOME allocation available to projects in HUD
urban counties.
To continue to receive maximum CDBG and HOME funding, it is crucial that all the
cities in Marin renew their commitment to the CDBG program.
We will send the new CDBG cooperation agreements to city managers shortly. If you
have any questions or concerns, please contact me or Roy Bateman, Community

With your participation, the cities and the county can continue their impressive 34-year
record of cooperation and achievement in the use of Community Development Block
Grant funds.
