RESOLUTION NO. 2684
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON APPROVING A PRECISE PLAN
AMENDMENT TO THE OWLSWOOD EAST PRECISE
PLAN FOR AP 58-132-38 (10 OWLSWOOD ROAD)
WHEREAS, the Town Council of the Town of Tiburon does resolve as follows:
Section 1. Findines.
A. The Town has received an application from Violeta Thomas requesting a Precise
Plan Amendment to adjust a building envelope to accommodate a room addition.
Said application consists of the following:
1. Application form received 12/11/89.
2. Proposed building envelope adjustment map labeled as Exhibit "A", dated
2/21/90.
B. The Planning Commission has held a duly-noticed public hearing on January 10,
1990, and discussed the matter again on January 24, 1990, and February 28,
1990, and has heard and considered all testimony and correspondence from
interested persons and has recommended approval of the application as
described in Resolution 483-90.
C. The Town Council has held a duly noticed and advertised public hearing on
April 4, 1990, and has heard and considered all testimony and correspondence
from interested persons.
D. The Town Council has found the project to be consistent with applicable policies
of the Tiburon General Plan and in conformance with the Tiburon Zoning
Ordinance and with the purpose and intent of the Owlswood East Master and
Precise Plans adopted by the Council in 1976 as Ordinance No. 168 N.S. ~nd
Resolution No. 821, respectively.
D. The Town Council has found that the project is categorically exempt from the
requirements of CEQA.
E. The Town Council has found that the Precise Plan Amendment, as revised
2/21/90, will not be detrimental to the public health, safety, and welfare in that
the area proposed for the building envelope expansion is a well-screened,
physically logical location for residential expansion of the type proposed, and will
not unduly encroach upon adjacent properties.
Section 2. Aoproval.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon does approve the Precise Plan Amendment to the Owlswood East Precise Plan
subject to the following conditions:
1. The building envelope for the subject property is amended as shown on
Exhibit "A", attached hereto and made a part of this resolution.
2. All other conditions and limitations of Ordinance No. 168 N.S. and
Resolution No. 821 shall continue to apply to the property as Zoning
entitlements.
3. The proposed room addition (or any other development proposed for the
site) shall be subject to Site Plan and Architectural Review approval by
the Town.
4. The Council recommends that as part of the required Site Plan and
Architectural Review approval, the Board consider conditions of approval
which would require the maintenance of the existing screening vegetation
in the area around the proposed addition. In the event that construction
would require the removal of some of the vegetation, it is recommended
that such vegetation be replaced by at least its equivalent in screening
quality.
5. The Town Council recommends that as part of the required Site Plan and
Architectural Review approval, the Board consider conditions of approval
which would prohibit upward glaring lights.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Tiburon on Allril 4, 1990, by the following vote:
