AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF TIBURON AMENDING THE HIGHLANDS MASTER PLAN WITH RESPECT TO LOTS 23, 24, AND 25 AND SIMULTANEOUSLY AMENDING ORDINANCE NO. 330 N.S. WHICH APPROVED A MASTER PLAN FOR THE TIBURON HIGHLANDS BE IT ORDAINED by the Town Council of the Town of Tiburon as follows: Section 1. Findines. A. The Town Council has received an application from Capital Property Associates consisting of plans entitled "Tentative Map, Amended Precise Plan, Amended Master Plan", prepared by C.S.W. Consultants, Job No. 1.62612, dated September, 1989. The application requests amendment to the Highlands Master Plan originally approved on March 31, 1988 by adoption of Ordinance No. 330 N.S. B. The Planning Commission held a public hearing on November 8, 1989, and after hearing all testimony on said application, adopted a resolution recommending approval of the Master Plan Amendment subject to certain conditions. The Planning Commission subsequently amended its recommendations by adopting Resolution No. 475-89. C. The Town Council held a public hearing on November 15, 1989, and heard testimony on this application and remanded the item to the Planning Commission for further review. The Town Council now accepts the recommendations of the Planning Commission contained in Resolution No. 475- 89. D. The Town Council finds that the proposed amendment is consistent with the terms of the Highlands Development Agreement. E. The Town Council finds that the proposed amendment is consistent with the General Plan policies, Zoning Ordinance requirements, and subdivision regulations in effect at the time the Development Agreement was recorded. F. The Town Council finds that the proposed amendment is categorically exempt from the requirements of CEQA. Section 2. Approval. The Master Plan Amendment depicted on plans referenced in Finding (A) above is hereby approved subject to the following conditions: 1. Lot lines and building envelopes for Lots 23, 24, and 25 are amended as shown on plans specified in Section 1 (A) above. 2. All previously-adopted terms and conditions of the Highlands Master Plan shall remain in effect, except as modified by this action. 3. Height limits on Lot 24 shall be as approved in the Resolution approving the Precise Plan Amendment and Tentative Map adopted in conjunction with this Ordinance.
