ORDINANCE NO. 369 N.S.
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF TIBURON REPEALING ORDINANCES NO. 305 N.S.
AND 308 N.S. AND RESOLUTION NO. 2357 CONCERNING
THE RESTAURANT USE LOCATED AT 5 MAIN STREET
BE IT ORDAINED by the Town Council of the Town of Tiburon as follows:
Section 1.
Findin2s.
A. In 1985, the Town adopted Ordinance Nos. 305 N.S. and 308 N.S., and Resolution
No. 2357 regulating the restaurant use located at 5 Main Street.
B. In 1990, the Town Council adopted Ordinance No. 360 N.S. (Zoning Ordinance)
establishing new procedures for regulation of uses in the Downtown area. Said
procedures allow for issuance of Conditional Use Permits to approve uses, and no
longer require Master Plan and Precise Plan approvals as had been the case with
the previous Zoning Ordinance No.9 N.S..
C. On May 22, 1991, the Planning Commission adopted Resolution No. 91-14
approving an expansion of the restaurant use located at 5 Main Street.
Resolution No. 91-14 incorporated all applicable requirements of the previous
approvals for the site, rendering these obsolete.
D. The Town Council finds that repeal of the previous approvals is therefore
appropriate and necessary.
Section 2.
Repeal.
NOW, THEREFORE BE IT ORDAINED that the Town Council of the Town of
Tiburon does hereby repeal Ordinance Nos. 305 N.S. and 308 N.S., and Resolution No.
2357 regulating the restaurant use located at 5 Main Street.
Section 3.
Severability.
If any portion of this Ordinance is struck down by court action, all other portions
will remain in effect.
Section 4.
Effective Date.
This Ordinance is to take effect and be in force at the expiration of thirty (30)
days from and after its passage, and before the expiration of fifteen (15) days after its
passage, the same, or its legally required equivalent, shall be published with the names
of the members voting for and against the same at least once in a newspaper of general
circulation published in the Town of Tiburon.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Tiburon on .Tune 19, 1991, by the following vote:
