RESOLUTION NO. 2745
A RESOLUTION OF THE TOWN COUNCIL OF
THE TOWN OF TIBURON UPHOLDING AN APPEAL
OF THE BOARD OF ADJUSTMENTS APPROVAL
OF A REMODEL AT 265 ROUNDHILL ROAD
WHEREAS, the Town Council has received an appeal of a Board of
Adjustments and Review (BAR) decision approving a remodel at 265
Roundhill Road (Banke/Jackson)
Section 1. Background, Record and Findings.
A. On September 20, 1990, the Board of Adjustments and Review
(BAR) held a public hearing to consider the approval of the design of a
remodel at 265 Roundhill Road. After fully considering the project and
taking public testimony, the BAR approved the final design for the project.
The BAR's action was appealed to the Town Council within the statutory time
limits.
B. On October 17, 1990, the Town Council held a public hearing to
consider the appeal. The minutes of that meeting accurately reflect the
testimony received.
C. The Town Council, after considering all of the testimony on the
project, remanded the project back to the BAR for consideration of a redesign
for the project. The Town Council found that the bulk and mass of the
building was unacceptable and imposed upon adjacent residences. The
Council further found that view issues were not relevant. The Council felt
that another review by the BAR could help solve the problem.
Section 2. Decision.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the
Town of Tiburon does hereby remand the project at 265 Roundhill Road back
to the BAR for further review with emphasis on reduction of bulk and mass
of the proposed building based on the record before it, and the testimony
received at the public hearing on October 17, 1990.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Tiburon on November 7, 1990 by the following vote:
